MOFCOM |Home >DTA Agreements >Text AGREEMENT BETWEEN THE GOVERNMENT OF THE PEOPLE'S REPUBLIC OF CHINA AND(ii) any legal person, partnership and association deriving its status as such from the laws in force in a Contracting State;h) the term "international traffic" means any transport by a ship or aircraft operated by an enterprise of a Contracting State , except when the ship or aircraft is operated solely between places in the other Contracting State;i) the term "competent authority" means, in the case of China, the State Administration of Taxation or its authorized repre sentative,and in the case of Uganda , the Minister responsible for finance orhis /her authorized representative .2. As regards the application of the Agreement at any time by a Contracting State, any term not defined therein shall, unle ss the context otherwise requires, have the meaning which it has at that time under the law of that State for the purposes of the t axes to which the Agreement applies, any meaning under the applicable tax laws of that State prevailing over a meaning given to the term under other laws of that State.Article 4RESIDENT1 . For the purposes of this Agreement, the term "resident of a Contracting State" means any person who, under the laws of that State,is liable to tax therein by reason of his domicile, residence, place of incorporation, place of management , or any ot her criterion of a similar nature, and also includes that State and any local authority thereof. This term, however, does not inclu de any person who is liable to tax in that State in respect only of income from sources in that State.2. Where by reason of the provisions of paragraph 1 an individual is a resident of both Contracting States, then his status s hall be determined as follows:a) he shall be deemed to be a resident only of the State in which he has a permanent home available to him; if he has a per manent home available to him in both States, he shall be deemed to be a resident only of the State with which his personal and economic relations are closer (centre of vital interests);b) if the State in which he has his centre of vital interests cannot be determined, or if he has not a permanent home availab le to him in either State, he shall be deemed to be a resident only of the State in which he has an habitual abode;c) if he has an habitual abode in both States or in neither of them, he shall be deemed to be a resident only of the State of which he is a national;d) if he is a national of both States or of neither of them, the competent authorities of the Contracting States shall settle the question by mutual agreement.3. Where by reason of the provisions of paragraph 1 a person other than an individual is a resident of both Contracting Sta tes, then it shall be deemed to be a resident only of the State in which its place of effective management is situated.Article 5PERMANENT ESTABLISHMENT1. For the purposes of this Agreement, the term "permanent establishment" means a fixed place of business through which the business of an enterprise is wholly or partly carried on.2. The term "permanent establishment" includes especially:a) a place of management;b) a branch;c) an office;d) a factory;e) a workshop;f) a sales outlet; andg) a mine, an oil or gas well, a quarry or any other place of extraction of natural resources.3. The term "permanent establishment" likewise encompasses:a) a building site, a construction, assembly or installation project or supervisory activities in connection therewith, but onl y where such site, project or activities continue for a period of more than six months; andb) the furnishing of services, including consultancy services, by an enterprise through employees or other personnel, wher e activities of that nature continue (for the same or a connected project) within the country for a period or periods aggregating more than 183 days within any twelve month period.4. Notwithstanding the preceding provisions of this Article, the term"permanent establishment" shall be deemed not to in clude:a) the use of facilities solely for the purpose of storage, display or delivery of goods or merchandise belonging to the enter prise;b) the maintenance of a stock of goods or merchandise belonging to the enterprise solely for the purpose of storage, displa y or delivery;c) the maintenance of a stock of goods or merchandise belonging to the enterprise solely for the purpose of processing by another enterprise;d) the maintenance of a fixed place of business solely for the purpose of purchasing goods or merchandise or of collecting information, for the enterprise;e) the maintenance of a fixed place of business solely for the purpose of carrying on, for the enterprise, any other activity of a preparatory or auxiliary character;f) the maintenance of a fixed place of business solely for any combination of activities mentioned in sub-paragraphs a) to e),provided that the overall activity of the fixed place of business resulting from this combination is of a prepa ratory or auxiliary character.5. Notwithstanding the provisions of paragraphs 1 and 2, where a person --other than an agent of an independent status to whom paragraph 6 applies --is acting in a Contracting State on behalf of an enterprise of the other Contracting State, has and habitually exercises an a uthority to conclude contracts in the name of the enterprise, that enterprise shall be deemed to have a permanent establishment i n the first-mentioned Contracting State in respect of any activities which that person undertakes for the enterprise, unless the activities of such person are limited to those mentioned in paragraph 4 which, if exercised through a fixed place of business, would not mak e this fixed place of business a permanent establishment under the provisions of that paragraph.6. An enterprise of a Contracting State shall not be deemed to have a permanent establishment in the other Contracting St ate merely because it carries on business in that other State through a broker, general commission agent or any other agent of a n independent status, provided that such persons are acting in the ordinary course of their business.However, when the activiti es of such an agent are devoted wholly or almost wholly on behalf of that enterprise, he will not be considered an agent of an in dependent status within the meaning of this paragraph.7. The fact that a company which is a resident of a Contracting State controls or is controlled by a company which is a res ident of the other Contracting State, or which carries on business in that other State(whether through a permanent establishmen t or otherwise), shall not of itself constitute either company a permanent establishment of the other.Article 6INCOME FROM IMMOVABLE PROPERTY1. Income derived by a resident of a Contracting State from immovable property (including income from agriculture or fo restry)situated in the other Contracting State may be taxed in that other State.2. The term "immovable property" shall have the meaning which it has under the law of the Contracting State in which the property in question is situated. The term shall in any case include property accessory to immovable property, livestock and e quipment used in agriculture and forestry, rights to which the provisions of general law respecting landed property apply, usufr uct of immovable property and rights to variable or fixed payments as consideration for the working of,or the right to work, mi neral deposits, sources and other natural resources. Ships and aircraft shall not be regarded as immovable property.3. The provisions of paragraph 1 shall apply to income derived from the direct use, letting, or use in any other form of im movable property.4 . The provisions of paragraphs 1 and 3 shall also apply to the income from immovable property of an enterprise and to i ncome from immovable property used for the performance of independent personal services.Article 7BUSINESS PROFITS1. The profits of an enterprise of a Contracting State shall be taxable only in that State unless the enterprise carries on busi ness in the other Contracting State through a permanent establishment situated therein. If the enterprise carries on business as a foresaid, the profits of the enterprise may be taxed in the other State, but only so much of them as is attributable to that perman ent establishment.2. Subject to the provisions of paragraph 3, where an enterprise of a Contracting State carries on business in the other Con tracting State through a permanent establishment situated therein, there shall in each Contracting State be attributed to that per manent establishment the profits which it might be expected to make if it were a distinct and separate enterprise engaged in the same or similar activities under the same or similar conditions and dealing wholly independently with the enterprise of which it is a permanent establishment.3. In determining the profits of a permanent establishment, there shall be allowed as deductions expenses which are incurr ed for the purposes of the business of the permanent establishment, including executive and general administrative expenses so incurred, whether in the State in which the permanent establishment is situated or elsewhere.4. Insofar as it has been customary in a Contracting State to determine the profits to be attributed to a permanent establish ment on the basis of an apportionment of the total profits of the enterprise to its various parts,nothing in paragraph 2 shall prec lude that Contracting State from determining the profits to be taxed by such an apportionment as may be customary. The metho d of apportionment adopted shall, however, be such that the result shall be in accordance with the principles contained in this A rticle.5. No profits shall be attributed to a permanent establishment by reason of the mere purchase by that permanent establish ment of goods or merchandise for the enterprise.6. For the purposes of the preceding paragraphs, the profits to be attributed to the permanent establishment shall be deter mined by the same method year by year unless there is good and sufficient reason to the contrary.7. Where profits include items of income which are dealt with separately in other Articles of this Agreement, then the pro visions of those Articles shall not be affected by the provisions of this Article.Article 8SHIPPING AND AIR TRANSPORT1. Profits derived by an enterprise of a Contracting State from the operation of ships or aircraft in international traffic shal l be taxable only in that State.2. The provisions of paragraph 1 shall also apply to profits from the participation in a pool, a joint business or an international operating agency.Article 9ASSOCIATED ENTERPRISES1. Wherea) an enterprise of a Contracting State participates directly or indirectly in the management, control or capital of an enterp rise of the other Contracting State, orb) the same persons participate directly or indirectly in the management, control or capital of an enterprise of a Contractin g State and an enterprise of the other Contracting State,and in either case conditions are made or imposed between the two ent erprises in their commercial or financial relations which differ from those which would be made between independent enterpris es, then any profits which would, but for those conditions, have accrued to one of the enterprises, but, by reason of those condit ions, have not so accrued, may be included in the profits of that enterprise and taxed accordingly.2. Where a Contracting State includes in the profits of an enterprise of that State -- and taxes accordingly --profits on which an enterprise of the other Contracting State has been charged to tax in that other State and the profits so inclu ded are profits which would have accrued to the enterprise of the first-mentioned State if the conditions made between the two enterprises had been those which would have been made between inde pendent enterprises, then that other State shall make an appropriate adjustment to the amount of the tax charged therein on thos e profits. In determining such adjustment, due regard shall be had to the other provisions of this Agreement and the competent authorities of the Contracting States shall, if necessary, consult each other.Article 10DIVIDENDS1. Dividends paid by a company which is a resident of a Contracting State to a resident of the other Contracting State may be taxed in that other State.2. However, such dividends may also be taxed in the Contracting State of which the company paying the dividends is a re sident and according to the laws of that State, but if the beneficial owner of the dividends is a resident of the other Contracting State, the tax so charged shall not exceed 7.5 per cent of the gross amount of the dividends. The competent authorities of the C ontracting States shall by mutual agreement settle the mode of application of this limitation.This paragraph shall not affect the taxation of the company in respect of the profits out of which the dividends are paid.3. The term "dividends" as used in this Article means income from shares, or other rights, not being debt-claims, participating in profits, as well as income from other corporate rights which is subjected to the same taxation treatment as income from shares by the laws of the State of which the company making the distribution is a resident.4. The provisions of paragraphs 1 and 2 shall not apply if the beneficial owner of the dividends, being a resident of a Cont racting State, carries on business in the other Contracting State of which the company paying the dividends is a resident, throug h a permanent establishment situated therein, or performs in that other State independent personal services from a fixed base sit uated therein, and the holding in respect of which the dividends are paid is effectively connected with such permanent establish ment or fixed base. In such case the provisions of Article 7 or Article 14, as the case may be, shall apply.5. Where a company which is a resident of a Contracting State derives profits or income from the other Contracting State, that other State may not impose any tax on the dividends paid by the company, except insofar as such dividends are paid to a re sident of that other State or insofar as the holding in respect of which the dividends are paid is effectively connected with a per manent establishment or a fixed base situated in that other State, nor subject the company's undistributed profits to a tax on the company's undistributed profits, even if the dividends paid or the undistributed profits consist wholly or partly of profits or inc ome arising in such other State.Article 11INTEREST1. Interest arising in a Contracting State and paid to a resident of the other Contracting State may be taxed in that other Sta te.2. However, such interest may also be taxed in the Contracting State in which it arises and according to the laws of that St ate, but if the beneficial owner of the dividends is a resident of the other Contracting State, the tax so charged shall not exceed 10 per cent of the gross amount of the interest. The competent authorities of the Contracting States shall by mutual agreement s ettle the mode of application of this limitation.3. Notwithstanding the provisions of paragraph 2, interest arising in a Contracting State and derived by the Government of the other Contracting State, a local authority or the Central Bank thereof or any financial institution wholly owned by the Gov ernment of that other State, or by any other resident of that other State with respect to debt-claims insured or guaranteed or indirectly financed by the Government of that other State, a local authority or the Central Bank thereof or any financial institution wholly owned by the Government of that other State, shall be exempt from tax in the first-mentioned Contracting State.4. The term "interest" as used in this Article means income from debt-claims of every kind, whether or not secured by mortgage and whether or not carrying a right to participate in the debtor's profi ts, and in particular, income from government securities and income from bonds or debentures, including premiums and prizes attaching to such securities, bonds or debentures. Penalty charges for late payment shall not be regarded as interest for the purp ose of this Article.5. Gains from the alienation of any property other than that referred to in paragraphs 1 to 4 shall be taxable only in the Contracting State of which the alienator is a resident.Article14INDEPENDENT PERSONAL SERVICES1. The term "professional services" includes especially independent scientific, literary, artistic, educational or teaching act ivities as well as the independent activities of physicians, lawyers, engineers, architects,dentists and accountants.Article 15DEPENDENT PERSONAL SERVICES1. Subject to the provisions of Articles 16, 18, 19, 20 and 21, salaries,wages and other similar remuneration derived by a r esident of a Contracting State in respect of an employment shall be taxable only in that State unless the employment is exercise d in the other Contracting State. If the employment is so exercised, such remuneration as is derived therefrom may be taxed in t hat other State.2. During World War II, he served as supreme commander of the allied forces in Europe, with responsibility for planning and supervising the successful invasion of France and Germany in 1944–45, from the western front. He was the first term-limited president in accordance with the 22nd amendment. His two termswere peaceful, and generally prosperous except for a sharp economic recession in 1958–59. Historians typically rank Eisenhower among the top ten U.S. presidents.Athletic careerEisenhower later said that “not making the baseball team at west point was one of the greatest disappointments of my life, maybe my greatest.” however he did make the high visibility football team, and was a varsity starter as running back and linebacker in 1912. In a bit of a fabled match-up, he even tackled the legendary Jim Thorpe in a 1912 game. But Ike injured his knee; it became permanently damaged on horseback and in the boxing ring. He would later serve as junior varsity football coach and yell leader.In 1916, while stationed at fort Sam Houston, Eisenhower was football coach for St. Louis College, now St. Mary’s university.Eisenhower played golf very enthusiastically later in life, and joined the Augusta national golf club in 1948. Roberts also advised Eisenhower on tax aspects of publishing his memoirs, which proved to be financially lucrative.World War IIAfter the Japanese attack on Pearl Harbor, Eisenhower was assigned to the general staff in Washington, where he served until June 1942 with responsibility for creating the major war plans to defeat Japan and Germany. He was appointed deputy chief in charge of pacific defenses under the chief of war plans division, General Leonard T. Gerow, and then succeeded Gerow as chief of the war plans division. Then he was appointed assistant chief of staff in charge of operations division under chief of staff general George C. Marshall, who spotted talent and promoted accordingly.In 1942, Eisenhower was appointed commanding general, European theater of operations (ETOUSA) and was based in London. The word “Expeditionary”was dropped soon after hisappointment for security reasons. In February 1943, his authority was extended as commander of AFHQ across the Mediterranean basin to include the British 8th army, commanded by General Bernard law Montgomery. The 8th army had advanced across the western desert from the east and was ready for the start of the Tunisia campaign. Eisenhower gained his fourth star and gave up command of ETOUSA to be commander of NATOUSA. After the capitulation of axis forces in North Africa, Eisenhower oversaw the invasion of Sicily and the invasion of the Italian mainland.In December 1943, Roosevelt decided that Eisenhower—not Marshall—would be supreme allied commander in Europe. In January 1944, he resumed command of ETOUSA and the following month was officially designated as the supreme allied commander of the allied expeditionary force (SHAEF), serving in a dual role until the end of hostilities in Europe in may 1945. In these positions he was charged with planning and carrying out the allied assault on the coast of Normandy in June 1944 under the code name operation overlord, theliberation of Western Europe and the invasion of Germany. A Month after the Normandy d-day landings on June 6, 1944, the invasion of southern France took place, and control of the forces which took part in the southern invasion passed from the AFHQ to the SHAEF. From then until the end of the war in Europe on May 8, 1945, Eisenhower through SHAEF had supreme command of all operational allied forces2, and through his command of ETOUSA, administrative command of all U.S. forces, on the western front north of the Alps.As recognition of his senior position in the allied command, on December 20, 1944, he was promoted to General of the Army, equivalent to the rank of field marshal in most European armies. In this and the previous high commands he held, Eisenhower showed his great talents for leadership and diplomacy. Although he had never seen action himself, he won the respect of front-line commanders. He dealt skillfully with difficult subordinates such as Patton, and allies such as Winston Churchill, field marshal Bernard Montgomery and General Charles De Gaulle. He had fundamental disagreementswith Churchill and Montgomery over questions of strategy, but these rarely upset his relationships with them. He negotiated with soviet marshal Zhukov, and such was the confidence that President Franklin D. Roosevelt had in him; he sometimes worked directly with Stalin, much to the chagrin of the British high command who disliked being bypassed.It was never certain that operation overlord would succeed. The seriousness surrounding the entire decision, including the timing and the location of the Normandy invasion, might be summarized by a second shorter speech that Eisenhower wrote in advance, in case he needed it. Long after the successful landings on d-day and the BBC broadcast of Eisenhower’s brief speech concerning them, the never-used second speech was found in a shirt pocket by an aide. It read:Our landings in the Cherbourg Havre area have failed to gain a satisfactory foothold and I have withdrawn the troops.My decision to attack at this time and place was based on the best information available. The troops, the air and the navy did all that bravery and devotion to duty could do. If any blame or fault attaches to the attempt, it is mine alone.Presidency 1953–1961Throughout his presidency, Eisenhower preached a doctrine of dynamic conservatism. He continued all the major new deal programs still in operation, especially social security. He expanded its programs and rolled them into a new cabinet-level agency, the department of health, education and welfare, while extending benefits to an additional ten million workers. I have come tonight to bring our silence to an end. I bear a message of challenge, not self-congratulation. I want your attention, not your applause.I would never have asked to be HIV positive, but I believe that in all things there is a purpose; and I stand before you and before the nation gladly. The reality of AIDS is brutally clear. Two hundred thousand Americans are dead or dying. A million more are infected. Worldwide, forty million, sixty million, or a hundred million infections will be counted in the coming few years. But despite science and research, White House meetings, and congressional hearings, despite good intentions and bold initiatives, campaign slogans, and hopeful promises, it is -- despite it all -- the epidemic which iswinning tonight.In the context of an election year, I ask you, here in this great hall, or listening in the quiet of your home, to recognize that AIDS virus is not a political creature. It does not care whether you are Democrat or Republican; it does not ask whether you are black or white, male or female, gay or straight, young or old.Tonight, I represent an AIDS community whose members have been reluctantly drafted from every segment of American society. Though I am white and a mother, I am one with a black infant struggling with tubes in a Philadelphia hospital. Adolescents don’t give each other cancer or heart disease because they believe they are in love, but HIV is different; and we have helped it along. We have killed each other with our ignorance, our prejudice, and our silence.We may take refuge in our stereotypes, but we cannot hide there long, because HIV asks only one thing of those it attacks. Are you human? And this is the right question. Are you human? Because people with HIV have not entered some alien state of being. They are human. They have not earned cruelty, and they do not deserve meanness. They don’t benefit from being isolated or treated as outcasts. Each of them is exactly what God made: a person; not evil, deserving of our judgment; not victims, longing for our pity -- people, ready for support and worthy of compassion.My call to you, my Party, is to take a public stand, no less compassionate than that of the President and Mrs. Bush. They have embraced me and my family in memorable ways. In the place of judgment, they have shown affection. In difficult moments, they have raised our spirits. In the darkest hours, I have seen them reaching not only to me, but also to my parents, armed with that stunning grief and special grace that comes only to parents who have themselves leaned too long over the bedside of a dying child.With the President’s leadership, much good has been done. Much of the good has gone unheralded, and as the President has insisted, much remains to be done. But we do the President’s cause no good if we praise the American family but ignore a virus that destroys it.We must be consistent if we are to be believed. We cannot love justice and ignore prejudice, love our children and fear to teach them. Whatever our role as parent or policymaker, we must act as eloquently as we speak -- else we have no integrity. My call to the nation is a plea for awareness. If you believe you are safe, you are in danger. Because I was not hemophiliac, I was not at risk. Because I was not gay, I was not at risk. Because I did not inject drugs, I was not at risk.My father has devoted much of his lifetime guarding against another holocaust. He is part of the generation who heard Pastor Nemoellor come out of the Nazi death camps to say,“They came after the Jews, and I was not a Jew, so, I did not protest. They came after the trade unionists, and I was not a trade unionist, so, I did not protest. Then they came after the Roman Catholics, and I was not a Roman Catholic, so, I did not protest. Then they came after me, and there was no one left to protest.”The -- The lesson history teaches is this: If you believe you are safe, you are at risk. If you do not see this killer stalking your children, look again. There is no family or community, no race or religion, no place left in America that is safe. Until we genuinely embrace this message, we are a nation at risk.Tonight, HIV marches resolutely toward AIDS in more than a million American homes, littering its pathway with the bodies of the young -- young men, young women, young parents, and young children. One of the families is mine. If it is true that HIV inevitably turns to AIDS, then my children will inevitably turn to orphans. My family has been a rock of support.My 84-year-old father, who has pursued the healing of the nations, will not accept the premise that he cannot heal his daughter. My mother refuses to be broken. She still calls at midnight to tell wonderful jokes that make me laugh. Sisters and friends, and my brother Phillip, whose birthday is today, all have helped carry me over the hardest places. I am blessed, richly and deeply blessed, to have such a family.But not all of you -- But not all of you have been so blessed. You are HIV positive, but dare not say it. You have lost loved ones, but you dare not whisper the word AIDS. You weep silently. You grieve alone. I have a message for you. It is not you who should feel shame. It is we -- we who tolerate ignorance and practice prejudice, we who have taught you to fear. We must lift our shroud of silence, making it safe for you to reach out for compassion. And where examples of m orality should be set, the opposite is seen. Sm all men, seeking great wealth or power, have too often and too long turned even the highest levels of public service into m ere personal opportunity.Now, certainly, simple honesty is not too much to dem and of m en in government. We find it in most. Republicans demand it from everyone. They dem and it from everyone no m atter how exalted or protected his position might be. Now the -- the growing menace in our country tonight, to personal safety, to life, to limb and property, in homes, in churches, on the playgrounds, and places of business, particularly in our great cities, is the m ounting concern, or should be, of every thoughtful citizen in the United States.Security from domestic violence, no less than from foreign aggression, is the m ost elem entary and fundamental purpose of any government, and a government that cannot fulfill this purpose is one that cannot long command the loyalty of its citizens.History shows us -- it dem onstrates that nothing, nothing prepares the way for tyranny more than the failure of public officials to keep the streets safe from bullies and m arauders.Now, we Republicans see all this as m ore, much m ore, than the result of m ere political differences or m ere political mistakes. We see this as the result of a fundamentally and absolutely wrong view of m an, his nature, and his destiny. Those who seek to live your lives for you, to take your liberties in return for relieving you of yours, those who elevate the state and downgrade the cit izen m ust see ultim ately a world in which earthly power can be substituted for Divine Will, and this Nation was founded upon the rejection of that notion and upon the acceptance of God as the author of freedom.Now those who seek absolute power, even though they seek it to do what they regard as good, are simply dem anding the right to enforce their own version of heaven on earth. They -- and let m e remind you, they are the very ones who always create the m ost hellish tyrannies. Absolute power does corrupt, and those who seek it m ust be suspect and m ust be opposed. Their mistaken course stem s from false notions, ladies and gentlemen, of equality. Equality, rightly understood, as our founding fathers understood it, leads to liberty and to the em ancipation of c reative differences. Wrongly understood, as it has been so tragically in our time, it leads first to conformity and then to despotism.Fellow Republicans, it is the cause of Republicanism to resist concentrations of power, private or public, which -- which enforce such conformity and inflict such despotism. It is the cause of Republicanism to ensure that power remains in the hands of the people. And, so help us God, that is exactly what a Republican President will do with the help of a Republican Congress.It is further the cause of Republicanism to restore a clear understanding of the tyranny of m an over m an in the world at large. It is our cause to dispel the foggy thinking which avoids hard decisions in the delusion that a world of conflict will som ehow mysteriously resolve itself into a world of harmony, if we just don't rock the boat or irritate the forces of aggression -- and this is hogwash.It is further the cause of Republicanism to remind ourselves, and the world, that only the strong can rem ain free, that only the strong can keep the peace.Now, I needn't remind you, or m y fellow Americans regardless of party, that Republicans have shouldered this hard responsibility and m arched in this cause before. It was Republican leadership under Dwight Eisenhower that kept the peace, and passed along to this adm inistration the m ightiest arsenal for defense the world has ever known. And I needn't remind you that it was the strength and the [un]believable will of the Eisenhower years that kept the peace by using ourstrength, by using it in the Form osa Straits and in Lebanon and by showing it courageously at all tim es.It was during those Republican years that the thrust of Communist imperialism was blunted. It was during those years of Republican leadership that this world moved closer, not to war, but closer to peace, than at any other tim e in the last three decades.And I needn't remind you -- but I will -- that it's been during Democratic years that our strength to deter war has stood still, and even gone into a planned decline. It has been during Democratic years that we have weakly stum bled into conflict, timidly refusing to draw our own lines against aggression, deceitfully refusing to tell even our people of our full participation, and tragically, letting ou r finest m en die on battlefields, unmarked by purpose, unmarked by pride or the prospect of victory.Yesterday, it was Korea. Tonight, it is Vietnam. Make no bones of this. Don't try to sweep this under the rug. We are at war in Vietnam. And yet the President, who is the Commander-in-Chief of our forces, refuses to say -- refuses to say, m ind you, whether or not the objective over there is victory. And his Secretary of Defense continues to m islead and misinform the Am erican people, and enough of it has gone by.And I needn't rem ind you -- but I will -- it has been during Democratic years that a billion persons were cast into Communist captivity and their fate cynically sealed.Today -- Today in our beloved country we have an administration which seem s eager to deal with communism in every coin known -- from gold to wheat, from consulates to confidences, and even human freedom itself.Now the Republican cause dem ands that we brand communism as the principal disturber of peace in the world today. Indeed, we should brand it as the only significant disturber of the peace, and we must make clear that until its goals of conquest are absolutely renounced and its relations with all nations tempered, communism and the governments it now controls are enemies of every man on earth who is or wants to be free.Now, we here in Am erica can keep the peace only if we rem ain vigilant and only if we remain strong. Only if we keep our eyes open and keep our guard up can we prevent war. And I want to m ake this abundantly clear: I don't intend to let peace or freedom be torn from our grasp because of lack of strength or lack of will -- and that I promise you, Americans.I believe that we m ust look beyond the defense of freedom today to its extension tom orrow. I believe that the communism which boasts it will bury us will, instead, give way to the forces of freedom. And I can see in the distant and yet recognizablefuture the outlines of a world worthy of our dedication, our every risk, our every effort, our every sacrifice along the way. Yes, a world that will redeem the suffering of those who will be liberated from tyranny. I can see -- and I suggest that all thoughtful men must contem plate -- the flowering of an Atlantic civilization, the whole of Europe reunified and freed, trading openly across its borders, communicating openly across the world.Now, this is a goal far, far m ore meaningful than a moon shot.It's a -- It's a truly inspiring goal for all free men to set for them selves during the latter half of the twentieth century.I can also see -- and all free men must thrill to -- the events of this Atlantic civilization joined by its great ocean highway to the United States. What a destiny! What a destiny can be ours to stand as a great central pillar linking Europe, the Am ericas, and the venerable and vital peoples and cultures of the Pacific. I can see a day when all the Am ericas, North and South, will be linked in a m ighty system, a system in which the errors and misunderstandings of the past will be submerged one by one in a rising tide of prosperity and interdependence. We know that the misunderstandings of centuries are not to be wiped away in a day or wiped away in an hour. But we pledge, we pledge that human sympathy -- what our neighbors to the South call an attitude of "simpatico" -- no less than enlightened self'-interest will be our guide.And I can see this Atlantic civilization galvanizing and guiding em ergent nations everywhere.Now I know this freedom is not the fruit of every soil. I know that our own freedom was achieved through centuries, by unremitting efforts of brave and wise men. And I know that the road to freedom is a long and a challenging road. And I know also that som e m en m ay walk away from it, that som e m en resist challenge, accepting the false security of governmental paternalism.And I -- And I pledge that the Am erica I envision in the years ahead will extend its hand in health, in teaching and in cultivation, so that all new nations will be at least encouraged -- encouraged! -- to go our way, so that they will not wander down the dark alleys of tyranny or the dead-end streets of collectivism.My fellow Republicans, we do no m an a service by hiding freedom's light under a bushel of mistaken humility.I seek an America proud of its past, proud of its ways, proud of its dreams, and determined actively to proclaim them. But our example to the world m ust, like charity, begin at hom e.In our vision of a good and decent future, free and peaceful, there m ust be room, room for deliberation of the energy and the talent of the individual; otherwise our vision is blind at the outset.We m ust assure a society here which, while never abandoning the needy or forsaking the helpless, nurtures incentives and opportunities for the creative and the productive. We must know the whole good is the product of m any single contributions.And I cherish a day when our children once again will restore as heroes the sort of men and wom en who, unafraid and undaunted, pursue the truth, strive to cure disease, subdue and make fruitful our natural environment and produce the inventive engines of production, science, and technology.This Nation, whose creative people have enhanced this entire span of history, should again thrive upon the greatness of all those things which we, we as individual citizens, can and should do. And during Republican years, this again will be a nation of m en and women, of families proud of their role, jealous of their responsibilities, unlimited in their aspirations -- a Nation where all who can will be self-reliant.We Republicans see in our constitutional form of governm ent the great fram ework which assures the orderly but dynamic fulfillment of the whole m an, and we see the whole m an as the great reason for instituting orderly government in the first plac e.We see -- We see in private property and in econom y based upon and fostering private property, the one way to m ake government a durable ally of the whole m an, rather than his determined enemy. We see in the sanctity of private property the only durable foundation for constitutional government in a free society. And -- And beyond that, we see, in cherished diversity of ways, diversity of thoughts, of motives and accom plishments. We don't seek to lead anyone's life for him. We only seek -- only seek to secure his rights, guarantee him opportunity -- guarantee him opportunity to strive, with government performing only those needed and constitutionally sanctioned tasks which cannot otherwise be performed.We Republicans seek a government that attends to its inherent responsibilities of maintaining a stable m onetary and fiscal clim ate, encouraging a free and acom petitive econom y and enforcing law and order. Thus, do we seek inventiveness, diversity, and creative difference within a stable order, for we Repub licans define government's role where needed at m any, m any levels -- preferably, though, the one closest to the people involved.Our towns and our cities, then our counties, then our states, then our regional com pacts -- and only then, the national government. That, let m e remind you, is the ladder of liberty, built by decentralized power. On it also we must have balance between the branches of governm ent at every level.Balance, diversity, creative difference: These are the elem ents of the Republican equation. Republicans agree -- Republicans agree heartily to disagree on many, many of their applications, but we have never disagreed on the basic fundamental issues of why you and I are Republicans.This is a Party. This Republican Party is a Party for free men, not for blind followers, and not for conformists.In fact, in 1858 Abraham Lincoln said this of the Republican party -- and I quote him, because he probably could have said it during the last week or so: "It was composed of strange, discordant, and even hostile elem ents" -- end of the quote -- in 1858. Yet -- Yet all of these elem ents agreed on one paramount objective: To arrest the progress of slavery, and place it in the course of ultimate extinction.Today, as then, but m ore urgently and m ore broadly than then, the task of preserving and enlarging freedom at home and of safeguarding it from the forces of tyranny abroad is great enough to challenge all our resources and to require all our strength.Anyone who joins us in all sincerity, we welcom e. Those who do not care for our cause, we don't expect to enter our ranks in any case. And -- And let our Republicanism, so focused and so dedicated, not be m ade fuzzy and futile by unthinking and stupid labels.I would remind you that extrem ism in the defense of liberty is no vice.(Thank you. Thank you.)And let m e remind you also that m oderation in the pursuit of justice is no virtue.Why the beauty of the very system we Republicans are pledged to restore and revitalize, the beauty of this Federal system of ours is in its reconciliation of diversity with unity. We must not see m alice in honest differences of opinion, and no m atter how great, so long as they are not inconsistent with the pledges we have given to each other in and through our Constitution.Our Republican cause is not to level out the world or m ake its people conform in com puter regimented sam eness. Our Republican cause is to free our people and light the way for liberty throughout the world.Ours is a very human cause for very humane goals.This Party, its good people, and its unquenchable devotion to freedom, will not fulfill the purposes of this campaign, which we launch here and now, until our cause haswon the day, inspired the world, and shown the way to a tom orrow worthy of all our yesteryears.I repeat, I accept your nomination with humbleness, with pride, and you and I are going to fight for the goodness of our land.Thank you.。
