Guarantees by their nature are independent of the underlying contract.
Basic parties to a bank guarantee
Applicant/principal: the party that requests a bank to issue a bank guarantee. Beneficiary: the party in whose favour a bank guarantee is opened and who has the right to claim for compensation in accordance with the terms and conditions of the guarantee. Guarantor: the bank that issues a letter of guarantee at the request of its customer. Instructing Party: the bank acting as an instructing party that issues a counter guarantee acting on the instruction of a principal in favor of a bank or a financial institution located in the beneficiary’s country.
