【中文摘要】我国外国人入境后地方公安管理是指公安主管机关依据宪法和有关法律、法规,对从边境口岸入境的外国人在国内居留、旅行及其它有关事务所实施的一种行政管理。

随着苏州改革开放的不断深入和对外交往的同趋频繁,来苏外国人人数逐年递增。

同时,外国人非法入境、非法就业、非法居留等问题也进一步突出。

对我城市中数目庞大、日益增多的外国人实施有效监督、管理和控制成为公安社会治安工作中面临的一个新挑战。

如何在确保外国人合法入境后权益的同时,又有效打击外国人在苏犯罪,成为我们所面临的重要课题。

在此背景之下,笔者根据在公安出入境条线多年来收集和掌握的资料为基础,结合国内外先进治理理念,采用了文献、调查等研究方法,力图通过对公安出入境管理机构的沿革、建制、现状的纵向考察,同时结合地方对受权执行中央事权任务与人力、物力资源的保障机制这种二元分权来横向研究、运用公共管理的知识,尤其是新公共管理理念作为先导,以国外外国人管理体制和治理理论为依据,具体探究在新形
势下,苏州地方公安出入境管理机构应如何应对二元分权的结构不合理,科学地进行自主改革创新,治理好来苏的外国人,从而把理论与实际相结合,充分发挥公共产品的价值功能,实现“管理与服务并重”目标,文章最后对如何治理与服务外国人提出了相应的对策、建议。

因此,论文对在苏的外国人的系统研究旨在回答三个方面的问题:一、在苏外国人的组成、现状。

二、公安机关在履行社会管理和服务职能时
遇到了哪些主要困难。

三、关于对在苏外国人治理和服务的对策建议。

借以探讨在面对新形势下,苏州地方公安出入境管理机构如何在以维
护国家主权和安全为中心的前提下,既圆满完成中央事权工作、确保
国门通畅、安全,又主动争取地方充足配置,促成地方经济发展。

【英文摘要】local public security management refers to the public security authority in accordance with the Constitution and the relevant laws and regulations, to foreigners who enter the border and residence in domestic, travel and other relevant implementation. It is a kind of administration. Accompany with the continuous deepening of reform and opening policy in Suzhou, foreign exchanges become more frequently. The number of foreigners increased yearly. At the same time, the issues also further highlight for illegal entry aliens, illegal employment, illegal residence and others. In our city, how to ensure the legitimate rights and interests of foreigners, and how to effective against foreigners crime becomes an important topic. With the background, the author according the experience of long time working in the public security entry-exit line , based with the collection and control of the data, combined of domestic and foreign advanced management concept, using literature, survey and other research methods to study public security entry-exit management institution evolution,
organizational system status of the longitudinal study. Combined with the local to the central powers empowered task and manpower, material resources guarantee mechanism of this binary of decentralization to cross-sectional study, the use of public management knowledge, especially the new public management theory as the guide, the paper does specific research in the area of the new situation, Suzhou local public security entry-exit management mechanism how to deal with binary of unreasonable decentralized structure, scientific autonomy reform innovation, the combination of theory with practice. The paper gives full play to the value of public goods function, realizes the” management and service pay equal attention to” target, finally the article analyzes how to management and service to foreigners and puts forward the corresponding countermeasures, suggestions. Therefore, system study aims to answer three questions: first, foreigners composition in suzhou and current situation. Second, which main difficulties encountered when the public security organs in performing the social management and the service function. Third, give advice and countermeasures regarding to the Suzhou service and management. In order to explore the new situation, Suzhou local public security entry-exit management mechanism
how to deal with binary of unreasonable decentralization structure, the paper scientifically analyzes the independent innovation, so as to combine theory with practice, give full play to the value of public service function, realize the target of management and service pay equal attention, in order to safeguard national sovereignty and security, successful completion of the central powers, ensure safety work abroad patency, and take the initiative to gain local adequacy configuration, promote the development of local economy.
