Finally, a distinction is made between a contract that is „void'. A void contract is a legal nullity; for the law it is as if the contract had never existed and no claim can be entertained under it. This happens, for example, if one or more of the basic elements described above is missing, or if the contract is unlawful, or where there has been an „operative mistake' (a shared unrectifiable error concerning the subject-mat- of the contract). On the other hand, a ter voidable contract is one that can be avoided (declared void) by only one of the parties, e.g. on the grounds of fraud, misrepresentation or mistake by the other party.
