摘要

言论自由是公民基本权利。是公民在法律规定或认可的情况下，使用各种媒介或方式表明、显示或公开传递思想、意见、观点、主张、情感、或信息、知识等内容而不受他人干涉、约束或惩罚的自主状态。在信息时代，网络广泛使用，为人们创造了一个全新的虚拟世界，成为人类基本的工作方式和生活方式，极大地提高了人类传播知识、交流信息的能力，改善了公民的言论自由、受教育权等项基本人权。与此同时，信息的快速传递和泛滥及人们无规则地滥用信息也给我们每个人的合法权利的保护带来了隐患，甚至会对民族和国家利益造成危害。因此，与网络更加广泛、便捷的言论自由的权利相对应的的是，网络言论自由也必然受到诸多的约束和限制。本文通过对言论自由的概念、网络言论自由的界定进行分析，总结了网络和网络言论自由的特点，以德国为例阐述了其在网络言论自由方面的宪法、法律保护和规制，在此基础上，分析了我国言论自由保障机制存在的立法不健全、效用不高、监督和求助机制缺失三个主要问题，提出了提高网络立法的效力、加强网络科技手段的介入和完善网络监督和救济体制的建议和对策，得出了当前的我国网络言论自由的形势仍然比较严峻、政府还有待于进一步通过完善立法和健全机制来保护网络言论自由的结论。

Abstract

Freedom of speech is a basic civil rights. Be citizens before the law or approval, use a variety of media or show, display or public transmission of ideas, opinions, ideas, emotions, or information, knowledge, etc without interference from others, restrict or punish autonomous state. In the information age, the network is widely used, for people to create a new virtual world, become a basic human way of life and work, greatly improve the human communication knowledge, ability to communicate information, improving the citizens' freedom of speech, the right to education as a basic human right. At the same time, a rapid flow of information and flooding and people without rules to misuse the information also gives each of us the protection of lawful rights brought hidden trouble, and even damage to nation and national interest. Therefore, with the network more widely, convenient and free speech rights corresponding is, the freedom of speech on the Internet is bound by the constraints and limitations. Based on the concept of free speech, freedom of speech on the network definition carries on the analysis, summarizes the characteristics of network and network freedom of expression, to Germany as an example expounds the network freedom of speech in constitution, legal protection and regulation, on this foundation, analysed our country free speech safeguard mechanism in the legislation is not perfect, efficiency is not high, supervise and help the lack of the mechanism of three main problems, put forward to improve the effectiveness of network legislation, strengthen the network technology intervention and improve the network supervision and relief system the suggestion and the countermeasure, the current our country network freedom of speech situation is still grim, the government has yet to be further through the improvement of legislation and perfect mechanism to protect the freedom of speech on the Internet to the conclusion.
