劳动合同法第40条
Labor Contract Law Article 40
《中华人民共和国劳动合同法》第40条(以下简称“法律”)规定:
工资支付制度是根据劳动者经济实际情况、劳动量及具体工作所进行的,劳动者应当适应支付制度上变化而作出相应调整,但各单位不得
以此为由减低劳动者应当支付的工资水平。
The Labor Contract Law of the People's Republic of China, Article 40 (hereinafter referred to as "the Law"), stipulates that the wage payment system should be based on the economic actuality of the laborer, labor intensity and specific work. Laborers should make corresponding adjustments to changes in the payment system, but units shall not reduce the wage level which laborers should receive on this account.
法律规定,各单位必须根据劳动者经济实际情况、劳动量及具体工作,建立合理的工资支付制度,以保障劳动者的合理利益得到有效保障。
劳动合同规定,劳动者的工资同时受到政府和企业的监管,因此,企
业在支付劳动者的工资时,一定要遵循政府的相关工资政策和规定,
实行以合理的工资和奖金给予劳动者。
制定具体的工资支付制度将有
助于更好地对企业的劳动者进行公平合理的支付。
The law stipulates that units must establish a reasonable
wage payment system according to the economic actuality of
the laborers, labor intensity and specific work, in order to effectively protect the lawful interests of the laborers. The
labor contract stipulates that the wages of the laborers are supervised by both the government and the enterprise. Therefore, when paying the wage of the laborers, the
enterprise must follow the relevant wage policies and regulations of the government and implement a reasonable wage and bonus for the labor. The formulation of a specific wage payment system will help to better pay the laborers of the enterprise fairly and reasonably.
此外,《中华人民共和国劳动合同法》第40条强调了劳动者应当适应
支付制度上变化而作出相应调整的要求。
无论是支付工资或奖金,劳
动者都应该根据当前经济市场形势,与企业重新磋商合理的支付方式,包括调整工资和奖金的金额,以使劳动者获得应有的报酬。
In addition, Article 40 of the Labor Contract Law of the People's Republic of China emphasizes the requirement that laborers should make corresponding adjustments to changes in the payment system. 总而言之,《劳动合同法》第40条对企业支付劳动者工资及奖金有明
确的规定,即应当根据劳动者的经济实际情况、劳动量及具体工作制
定合理的工资支付制度,以保障劳动者的合法利益不受侵犯。
同时,
劳动者也应当主动配合企业在支付上的变化,并能积极去适应和调整
这些变化。
In a word, Article 40 of the Labor Contract Law has clear
