破坏村委会选举行为的刑法规制

【摘要】Villagers′ election is connected with many benefits with the development of villagers′ autonomy and the mode conversion of rural distribution of benefits;the village committee elections underlie many benefits.Meanwhile,disrupting election of villagers′ committee becomes more and more serious.Some negative phenomenon such as bribing election and violence come into being,and get worse,and become a direct threat to the social stability at the grassroots level.However,the existing legal framework for this punishment is light,it is difficult to produce deterrence and educational role.So the criminal law should be actively involved in village committee electoral behavior,and it will undermine the crime,and configures the appropriate punishment.%随着村民自治的深入,农村利益分配模式的转换,村委会选举牵连着诸多利益。

与此同时,破坏村委会选举现象也日趋严重,并呈现出贿选数额巨大、暴力手段猖獗等特征,并有愈演愈烈之势,直接威胁到基层社会的稳定。

然而,现行法律框架体系对此的惩罚力度明显偏轻,难以产生威慑与教育作用。

为此,刑法应该积极介入,将破坏村委会选举行为犯罪化,并配置相应的刑罚。
