建筑合同（Building Contract）

业主方：XYZ投资集团
1. 全文范围
本合同约定双方就XYZ投资集团向ABC建筑公司施工的项目进行承包和监理工作，双方应遵守以下的约定并按照本合同中的规定工作。

2. 付款方式
2.1 XYZ投资集团应在本合同签订之日起三日内向ABC建筑公司支付合同总金额的20%作为定金。

2.2 工程款的发放方式：XYZ投资集团将根据施工进度，将承包款项分期支付给ABC建筑公司。

具体支付比例和时间将由双方在合同中具体约定。

3. 工程施工规范
3.1 ABC建筑公司必须根据国家相关规范和标准来进行施工，确保工程质量符合标准。

3.2 ABC建筑公司在施工中应遵守安全施工规范，确保施工现场的安全。

4. 工程延期与变更
4.1 如果由于不可抗力等因素导致工程延期，双方应当协商处理，ABC建筑公司应提前告知XYZ投资集团，并采取相应措施减少延期影响。

4.2 如遇到工程变更，双方需重新商议变更事项并进行补充合同
签订。

5. 工程质量保证
5.1 工程完工后，ABC建筑公司应对工程进行质量保证，保证工
程在正常使用情况下的使用年限。

5.2 工程竣工验收合格后，ABC建筑公司应对工程质量提供一定
期限内的保修服务。

6. 争议解决
6.1 双方在履行本合同过程中如发生争议，应首先友好协商解
决。

6.2 如协商无果，可向相关政府部门申请调解或者选择仲裁解
决。

7. 其他条款
7.1 如果本合同中的任何条款出现歧义或者不完备，双方应当友好沟通，协商解决。

7.2 本合同一式两份，双方各执一份，自签订之日起生效。

任何未尽事宜，双方应当在签订合同前进行协商并签署补充协议。

1. Scope of the Contract
This contract is agreed upon by both parties for the contracting and supervision of the project by XYZ Investment
Group to ABC Construction Company. Both parties shall abide by the following agreements and work according to the provisions in this contract.
2. Payment Terms
2.1 XYZ Investment Group shall pay 20% of the total contract amount to ABC Construction Company as a deposit within three days of signing this contract.
2.2 Payment method for project funds: XYZ Investment Group will pay the contract amount to ABC Construction Company in installments according to the construction progress. The specific payment ratio and time will be specified in the contract by both parties.
3. Construction Standards
3.1 ABC Construction Company must conduct construction in accordance with national regulations and standards to ensure that the quality of the construction meets the required standards.
3.2 ABC Construction Company must adhere to safety construction standards to ensure the safety of the construction site.
4. Project Extension and Changes
4.1 If the project is delayed due to force majeure and other factors, both parties should negotiate and handle it. ABC Construction Company should inform XYZ Investment Group in advance and take appropriate measures to reduce the impact of the delay.
4.2 In the event of project changes, both parties must
re-negotiate the changes and sign a supplementary contract.
5. Project Quality Assurance
5.1 After the completion of the project, ABC Construction Company should provide quality assurance for the project to ensure the service life of the project under normal conditions.
5.2 After the completion acceptance of the project, ABC Construction Company should provide warranty service for the project quality for a certain period of time.
6. Dispute Resolution
6.1 In the event of a dispute during the performance of this contract, both parties should first try to resolve it amicably.
6.2 If negotiation fails, parties may seek mediation from relevant government departments or choose arbitration to resolve disputes.
7. Other Terms
7.1 If there are any ambiguities or incompleteness in any of the provisions of this contract, both parties shall communicate amicably and resolve them through negotiation.
7.2 This contract consists of two copies, each party holding one copy, effective from the date of signing. Any unsettled matters should be negotiated and supplemented with additional agreements before signing the contract.
