AI has a wide range of application scenarios in education, including adaptive assessment, personalized learning, and virtual reality teaching. With the help of AI, students could adopt personalized, interactive and efficient learning methods; while teachers can gain accurate and real-time teaching and management support. However, the application of such digital technologies results in several ethical problems, such as the invasion on the privacy of students and increasing educational inequality. Under this condition, it is crucial to explore how ethical problems in the application of AI in learning could be addressed. Ethical analysisIn the past few years, generative AI has developed quickly and has caused profound impacts on many different fields, including education. This is particularly significant after the emergence of ChatGPT, which is a typical generative tool that driven by AI technology. Generative AI makes use of a large amount of publicly available data to generate humanlike text, and has been proven as an efficient tool in writing texts (Grassini, 2023). As a result, generative AI like ChatGPT currently has become an important tool that used by students to assist their learning. In addition, Nguyen et al (2023) also suggest that the application of AI in education could help enhance the understanding of the learning of students and improve their learning performances. Grassini (2023) points out that AI could be applied for essay grading, delivering feedbacks to students, and the evaluation of students’ learning challenges. However, the use of such technology also causes the ethical crisis of academic integrity (Grassini, 2023). Technology is a double-edged sword. On the one hand, it could help increase the efficiency and bring positive impacts for learning; but on the other hand, there is also a need to consider and address the ethical dilemmas caused by the application of the technology.In general, the application of AI in learning could generated ethical problems in three important fields, namely policy, academic and practical fields. At present, although AI has experienced a quick development at the global level in the past years, there is still a lack of effective policy or regulation to address the ethical problems that caused by the application of AI in education (Holmes et al, 2021). It should be noticed that this situation has been improved in recent years with increasing attention attached to the ethical problems caused by the application of AI in education. However, as it is claimed by Nguyen et al (2023), although increasing countries have started to publish guidelines for the ethical use of AI in education, there is still no clear understanding about what ethical principles should be included to guide the design, development, and application of ethical AI in education. Garrett et al (2020) also state that since AI education is still in its infancy stage of development, ethical guidance for AI education currently is an embryo. This means that the existing policies and regulations to regulate ethical problems in the application of AI for education are still limited. Moreover, Mittelstadt (2019) points out that although ethical guidelines are increasingly introduced, they often do not end in tangible implementation. This suggests the need to enhance the implementation of ethical guidelines for AI education.Student plagiarism is also an important ethical concern about the application of AI in learning. With the development of AI technology, AI writing tools have been widely used by students in their learning practices (Grassini, 2023). This brings negative impact on the academic integrity in the learning process. An important solution to deal with this problem at present is the use of plagiarism-detection tools. However, the advance in generative AI tools like ChatGPT makes it difficult to successfully detect plagiarized contents since the generative AI tools could circumvent plagiarism detectors. Under this condition, the detection of AI-generated contents becomes particularly important to address the ethical problem along with the evolution of AI technology. More importantly, whether the contents that generated by students with generative AI tools are still original contents is still remained debated. However, it is also argued that the use of AI for writing and learning does not necessary result in plagiarism behavior as some stents may not use such tool to cheat on their assignments, but to learn how to improve the writing performance (Cotton et al, 2023). From this perspective, the application of AI couldnot be identified as the fundamental cause of the ethical problem of plagiarism. This actually adds barriers and difficulties to the development and implementation of ethical guidelines for the application of AI in learning.Another important ethical problem that caused by the use of AI in learning is inequality in education (Schiff, 2022). As it has been mentioned above, it has been argued that AI is not always used by students for academic dishonesty. Instead, AI could be applied by students to improve their academic performances and acquire better academic skills. However, despite such possible benefits, the use of AI in learning may cause an inequal academic playing field (Cotton et al, 2023). An important cause of this ethical problem is the inequal access to AI. Due to the powerful capabilities of AI, students with the access to AI are more likely to gain unfair advantage over those without the access to AI or students who choose not to use AI for learning because of ethical considerations. As a result, the personal efforts and hard work of students who do not use AI may be neglected in academic recognition and assessment. It adds barriers for educators to accurately assess the academic performances of different students. Moreover, it is also suggested that the use of AI for learning also adds barriers and difficulties for educators to evaluate students’ understanding of learning materials. With the help of AI, students may still demonstrate good performance in assessments without the clear understanding of the learning materials.Original CODE of ethicsAccording to Holmes et al (2018), the main problems that related with the management ethical issues that related with the use of AI in learning include the lack of research, the lack of ethical guidelines, and the lack of policies and regulations to address ethical issues. Hence, there is a need to develop new ethical guidelines and codes in order to address ethical issues that involved in the application of AI for learning. This section proposes the original codes to deal with the main ethical issues that involved in the use of AI for learning.There are many ethical issues that involved in the application of AI for learning, such as fairness, privacy, informed consent, accountability, biases, transparency, and identity and confidentiality (Sacharidis et al, 2020; Nguyen et al, 2023). As it has been suggested by previous studies (e.g.,Holmes et al, 2021; Slade & Prinsloo, 2013), the ethics in AI learning actually involve in several important problems, including the purpose of education, surveillance, the management of student data, power relations, and informed consent and privacy. This reveals that there is actually a wide range of ethical issues should be addressed in the application of AI in learning. The codes that proposed in this section attempts to address these ethical issues, and also attempt to regulate the behaviors of different stakeholders, including educators, students, AI developers, and education departments. Nguyen et al (2023) have proposed several ethical principles for the application of AI in learning, including multistakeholder, international cooperation, transparency, accountability, responsibility, local alignment, data privacy, safety, diversity, inclusiveness, human oversight, human dignity, and human right. These principles are integrated into the development of the below proposed codes.Table 1: The codes of ethicsProposal for an INTERVENTIONAs the application of AI in learning involves in several ethical problems, there is a need to develop effective intervention in order to address the problems. The intervention should emphasize on the all-round development of people, focus on educational equity and student needs, and establish a sound legal protection and regulatory framework in order to address the ethical dilemmas faced in the application of AI in learning. First of all, it is suggested that the intervention should be based on the people-oriented principle. Education is centered on human development and pays attention to the future of human development and social inclusiveness. This is the basic value concept and basic principle for constructing educational ethics.The application of AI in education should be centered on the needs and interests of students and promote their cognitive, emotional, social and creative development, so it needs to be closely scrutinized to ensure that it serves human development goals (Kiemde & Kora, 2022). At present, some schools have deployed intelligent monitoring in classrooms, which can capture students' behavioral data in real time and determine whether they are studying. Although this method has a good effect on correcting students' bad behavior, it is also suspected of being intrusive and dehumanizing, which will cause anxiety and rejection in students, and a crisis of trust between teachers and students. Therefore, this should be avoided in the use of AI in the field of education.To implement the people-centered principle, it is also essential to pay attention to the individual differences and diversity of students, meet individual needs through personalized learning paths and teaching strategies, and promote the all-round development of students (Holmes & Porayska-Pomsta, 2022). Teachers play an irreplaceable role in education. Even with the assistance of AI technology, they still need to take the lead. In addition, teachers and developersalso need to receive ethics training to increase their awareness and sensitivity to ethical issues so that they can make scientific and reasonable decisions when using AI applications. Furthermore, the intervention should also integrate legal requirements. Both ethics and law are important components of social norms. Different from morality, law is a code of conduct formulated and enforced by the state. When people cannot restrain themselves morally, law can come into play. At present, the public's awareness of AI ethics is weak, and incidents similar to infringement of personal privacy rights are very common. The root cause is the lack of ethical regulations and the lack of relevant laws and regulations (O'Sullivan et al, 2019).In the education field, students are the most vulnerable group, and the abuse of their data is still a serious problem. Legal protection is the last line of defense for students' interests. First, governments should formulate strict data protection regulations to ensure that personal data is used legally, compliantly and safely in AI education applications. Second, there is also a need to establish an independent regulatory agency or committee responsible for supervising the ethical behavior and compliance of AI educational applications (Holmes & Porayska-Pomsta, 2022). Third, it is suggested that governments should strengthen the legal responsibility and investigation mechanism for illegal activities in AI education applications, clarify the responsibilities of developers and educational institutions in terms of data use, privacy protection and ethical norms, and those who violate the regulations should bear the corresponding legal consequences. At last, international cooperation is also necessary in the intervention.
