瑕疵结婚登记处理方式的体系化思考

【摘要】When handling defective marriage registration through the administrative procedure, we should not only comply with the provision of Marriage Law and Marriage Registration Regulation, but also have to consider the influence of the judgment on related subjects in terms of results. For other defective marriage registration except for invalid marriage and revocable marriage, if the litigants have been consistent with the marriage substantial essentials in administrative action and established a de facto marriage relation, People’s Court ought to declare the administrative act of the marriage registration illegal, then order the marriage registration organization to redress the defect and maintain the legal validity of the marriage registration.%依行政程序处理瑕疵结婚登记，应当严格遵循婚姻法和婚姻登记条例的规定，充分考虑裁判对实体结果的影响，除法定无效和可撤销情形外，其他存在瑕疵的结婚登记，凡当事人在行政诉讼时符合结婚实质要件形成了事实婚姻关系的，人民法院应当对结婚登记行政行为违法做出宣告，并责令婚姻登记机关对存在的瑕疵予以补正，继续维持结婚登记的法律效力。
