个人捐赠协议书英文版Donation Agreement
This Donation Agreement ("Agreement") is entered into on this __ day of ____ 20___, by and between:
[Donor Name], located at [address], [city], [state/province], [country], hereinafter referred to as the "Donor", and
[Recipient Name], located at [address], [city],
[state/province], [country], hereinafter referred to as the "Recipient".
WHEREAS, the Donor desires to make a donation to the Recipient, and the Recipient is willing to accept such donation, subject to the terms and conditions set forth in this Agreement;
NOW, THEREFORE, in consideration of the mutual covenants and agreements set forth herein, the parties agree as follows:
1. Donation. The Donor hereby agrees to donate the sum of [Amount in words] [Amount in Numbers] [currency] to the Recipient.
2. Purpose. The donation shall be used by the Recipient for the following purpose(s): [insert purpose(s)].
3. Identity and Capacity. The Donor represents and warrants that he/she is the legal owner of the donation, and that the
donation is free and clear of all liens, claims, encumbrances, and debts. The Recipient represents and warrants that it is a
non-profit organization, duly organized and existing under the laws of [country], and has the power and authority to accept the donation.
4. Terms of Donation. The Donor hereby agrees to donate the sum of [Amount in words] [Amount in Numbers] [currency] by [insert payment method], which shall be paid in full to the Recipient on or before [insert date]. The donation shall be irrevocable and non-refundable once made.
5. Obligations of the Recipient. The Recipient hereby agrees to use the donation solely for the purpose(s) stated in Section 2 above, and to provide written proof to the Donor of such use upon request. The Recipient further agrees to comply with all applicable laws and regulations, and to provide the Donor with any information reasonably requested by the Donor regarding the use of the donation.
6. Confidentiality. The parties acknowledge that this Agreement and any information exchanged between them in connection with this Agreement is confidential, and shall not be disclosed to any third party without the express written consent of the other party.
7. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of [Country], and any legal
action arising out of or in connection with this Agreement shall be brought in the courts of [Country].
8. Entire Agreement. This Agreement constitutes the entire understanding of the parties and supersedes all previous communications, understandings, and agreements between them, whether oral or written.
9. Amendment and Waiver. This Agreement may be amended or waived only in writing signed by both parties.
10. Binding Effect. This Agreement shall be binding upon and shall inure to the benefit of the parties hereto and their respective heirs, legal representatives, successors, and assigns.
11. Severability. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be severed, and the remaining provisions shall remain in full force and effect.
12. Counterparts and Facsimile Signatures. This Agreement may be executed in counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument. Facsimile and electronic signatures shall be deemed original signatures for purposes of this Agreement.
