装卸时间事实记录_sof装卸事实记录装卸时间事实记录是订有滞/速计算的船舶在干装卸作业的实际状况记录。
它反映船舶从抵港之装卸完毕的全面状况,是船、租、港、货各方计算装卸时间与结算速遣/滞期费的重要依据,是外勤业务员现场工作中的一项重要内容。
工作须知(一)熟识租约/买卖合同/协议书等规定。
缮制事实记录,要求实事求是,有理有利,兼顾管家经济利益切实熟识把握有关规定,特殊要留意不同租约的不同规定。
例如:“作业期间的开仓盖”、“装货前的铺垫舱:、”“允许两次移泊”等常常有异的时间计算。
(二)具体记录,分清责任(1)记录的时间必需逐日时连贯,中间不得有空隙或省略,防止计算装卸时间的无法确定其是否属于应予计算的装卸货时间。
(2)船舶抵达锚地,联检后在等泊过程中遇有不良天气,应同时注明“等泊”和“不良天气”,以便按合约不同规定扣除或不扣除。
(3)装卸开头前及装卸过程中,留意等泊/等工人/等货物期间的一般公认的坏天气,或不适合货物装卸的坏天气,应按“坏天气”记录,不作“装卸货时间”计算。
等泊期间的坏天气,可参照当地气象台或其他习惯饮用的资料。
(4)在港作业过程中消失的坏天气,大浪日(SURF DAY),雨、雪天、雪后清扫船上积水,积雪所用去的时间必需做好记录。
(5)与港方订有滞/速计算的船舶,同一舱口的两对吊杆中一对损坏,应把舱口号数,损坏时间记载清晰。
(6)属船方缘由造成装卸停工(如纹车故障,货灯熄灭,索具更换,船电中断等),记录中必需注明“由船方某某缘由熬成停工”以明责任。
纹车动力不足,影响装卸,亦应具体记载缘由和时间。
(7)因工人损坏纹车造成停工,并为港方确认,可以把损失的时间和缘由记载清晰,也可以照旧记载为“装卸”,记为装卸时间。
(8)移泊时间:1.移泊前,从停止装卸至等候移泊所占去的时间,可并入移泊时间,按“移泊”登录,或记录为“预备移泊”; 2.如等候移泊时间较长,超过正常所需时间,属港方缘由,应按“等候移泊”记录;属船方缘由,“船舶预备移泊”记录;属潮小缘由,按“候潮移泊”记录,绝不能用“停工”或者“候装卸”等缘由不明的记录。

装卸时间的计算装卸时间的计算一、装卸事实记录或装卸时间表装卸事实记录(1aytime statement of fact),有的使用装卸时间表(1aytime sheet),是用以记载船舶从到达港口引航站时起,到装卸货物完毕时止的这段期间内船舶所进行的装卸作业的起止时间和待时的起止时间和其待时原因等事项的记录。
装卸事实记录的内容主要包括:船舶抵港时间,NOR的递交时间及接受时间、引航员登船引领时间、靠泊时间、海关检疫完成时间,每天装卸作业起止时间、星期日、节假日、不良天气、装卸设备故障、等待货物和等待接运工具等中断或除外事项的起止时间,以及装卸完毕时间和装卸货物数量等。
装卸事实记录是计算装卸时间的事实依据。
它通常由船舶代理人根据船长或港口的作业记录编制而成。
装卸作业完毕时,船长、货主或其代理人须对记录的事实逐一核对,认为没有异议后,船长、发货人、收货人或其代理人在该文件上签字。
签字后的事实记录船长保留一份,船舶代理人转交出租人、货方各一份。
有了上述三份文件,出租人便可以制作滞期费/速遣费计算单(demurrage/despatch money calculation sheet),然后将此表连同前面提到的三份文件交给承租人索要滞期费。
当然,在存在速遣费时,这些文件通常由承租人作出,向出租人索要速遣费。
在租约对索要滞期费/速遣费有时间限制时,应在规定的时间内作出并送达对方,否则,视为索赔方放弃索赔要求。
在无索赔时间规定时,索赔时效应按租约适用的法律规定执行。
一般地,租约中都规定滞期费/速遣费在装卸完毕后一个月内结算。
二、滞期时间的计算通常滞期时间是按“滞期连续计算”原则计算的(demurrage runs continuously),也称作“一旦滞期,永远滞期”(once on demurrage,always on demurrage)。
其含义是在开始进入滞期后,所有的中断、除外时间都算作滞期时间,如遇星期天、节假日、坏天气等都不再作扣除。

一、装卸事实记录或装卸时间表装卸事实记录(1aytime statement of fact),有的使用装卸时间表(1aytime sheet),是用以记载船舶从到达港口引航站时起,到装卸货物完毕时止的这段期间内船舶所进行的装卸作业的起止时间和待时的起止时间和其待时原因等事项的记录。
装卸事实记录的内容主要包括:船舶抵港时间,NOR的递交时间及接受时间、引航员登船引领时间、靠泊时间、海关检疫完成时间,每天装卸作业起止时间、星期日、节假日、不良天气、装卸设备故障、等待货物和等待接运工具等中断或除外事项的起止时间,以及装卸完毕时间和装卸货物数量等。
装卸事实记录是计算装卸时间的事实依据。
它通常由船舶代理人根据船长或港口的作业记录编制而成。
装卸作业完毕时,船长、货主或其代理人须对记录的事实逐一核对,认为没有异议后,船长、发货人、收货人或其代理人在该文件上签字。
签字后的事实记录船长保留一份,船舶代理人转交出租人、货方各一份。
有了上述三份文件,出租人便可以制作滞期费/速遣费计算单(demurrage/despatch money calculation sheet),然后将此表连同前面提到的三份文件交给承租人索要滞期费。
当然,在存在速遣费时,这些文件通常由承租人作出,向出租人索要速遣费。
在租约对索要滞期费/速遣费有时间限制时,应在规定的时间内作出并送达对方,否则,视为索赔方放弃索赔要求。
在无索赔时间规定时,索赔时效应按租约适用的法律规定执行。
一般地,租约中都规定滞期费/速遣费在装卸完毕后一个月内结算。
二、滞期时间的计算通常滞期时间是按“滞期连续计算”原则计算的(demurrage runs continuously),也称作“一旦滞期,永远滞期”(once on demurrage,always on demurrage)。
其含义是在开始进入滞期后,所有的中断、除外时间都算作滞期时间,如遇星期天、节假日、坏天气等都不再作扣除。

所谓假日是指本可以用来装卸工作,但根据当地法律 或习惯终止工作的时间;
即使在非正常工作时间内进行了装卸作业,所用时间 也不计为装卸时间.

NOR及装卸时间(LAYTIME)计算(2012-10-05 20:45:25)1)船东是否可以在LAYCAN前递交通知书除非另有约定,船东只有义务在抵达第一装货港时递交通知书,目的是为了使装货人知道船舶已经抵达并已经备妥装货。
递交通知书以后才可以起算装货时间。
实践中当事人往往约定,在递交通知书后还约定有个通知时间“notice time”,比如第二条早上的8:00,这是为了给发货人必要的时间准备。
LAYCAN 是LAY DAY 和CANCELLING DAY的合并,LAYDAY 是能最早起算装卸时间的一日,CANCELLING DAY是销约期,就是说,如果在CANCELLING DAY 船舶还没有抵达,承租人有权取消租约。
那么,问题在于,船东是否可以在LAYCAN 之前就递交通知书呢比如,LAYCAN 是6月15至6月25日,船舶在6月10日抵达并递交通知书。
答案是通知书是可以在LAYCAN之前递交的。
但装货时间不是马上计算。
如果租约有约定通知时间,而通知时间在LAYDAY之后届满的,则从通知时间届满开始算;如果通知时间届满却仍然在LAYDAY之前,则从LAYDAY第一天0001时起算。
如果没有通知时间,则从LAYDAY 的第一天0001时起算。
这在LMLN (1983)案例,它的LAYDAY是7月22日,船舶7月21日的0800时抵达并递交通知书。
仲裁庭判7月21日的通知书有效,但装卸时间要从7月22日的0001时起算。
如果本案有24小时的通知时间,则应当从7月21日0800往后算24小时即7月22日的0800时起算。
当然在实践中,如果通知时间届满仍然在LAYDAY之前,船东和承租人往往会约定,租船人可以提前使用船舶,但使用时间只算一半。
这对双方都有利。
2)装卸时间(LAYTIME)计算LAYTIME计算以C/P规定为准,C/P中对LAYTIME计算可能是多样的或者很简单,在此归纳几种规定如下:LAYTIME起算:1. NOR TENDERED AS PER GENCON CP(以GENCON CP规定为准,递交NOR,NOR有效递交便开始计算装卸时间)NOR递交必须按GENCON CP规定。

一、装卸事实记录或装卸时间表装卸事实记录(1aytime statement of fact),有的使用装卸时间表(1aytime sheet),是用以记载船舶从到达港口引航站时起,到装卸货物完毕时止的这段期间内船舶所进行的装卸作业的起止时间和待时的起止时间和其待时原因等事项的记录。
装卸事实记录的内容主要包括:船舶抵港时间,NOR的递交时间及接受时间、引航员登船引领时间、靠泊时间、海关检疫完成时间,每天装卸作业起止时间、星期日、节假日、不良天气、装卸设备故障、等待货物和等待接运工具等中断或除外事项的起止时间,以及装卸完毕时间和装卸货物数量等。
装卸事实记录是计算装卸时间的事实依据。
它通常由船舶代理人根据船长或港口的作业记录编制而成。
装卸作业完毕时,船长、货主或其代理人须对记录的事实逐一核对,认为没有异议后,船长、发货人、收货人或其代理人在该文件上签字。
签字后的事实记录船长保留一份,船舶代理人转交出租人、货方各一份。
有了上述三份文件,出租人便可以制作滞期费/速遣费计算单(demurrage/despatch money calculation sheet),然后将此表连同前面提到的三份文件交给承租人索要滞期费。
当然,在存在速遣费时,这些文件通常由承租人作出,向出租人索要速遣费。
在租约对索要滞期费/速遣费有时间限制时,应在规定的时间内作出并送达对方,否则,视为索赔方放弃索赔要求。
在无索赔时间规定时,索赔时效应按租约适用的法律规定执行。
一般地,租约中都规定滞期费/速遣费在装卸完毕后一个月内结算。
二、滞期时间的计算通常滞期时间是按“滞期连续计算”原则计算的(demurrage runs continuously),也称作“一旦滞期,永远滞期”(once on demurrage,always on demurrage)。
其含义是在开始进入滞期后,所有的中断、除外时间都算作滞期时间,如遇星期天、节假日、坏天气等都不再作扣除。
