Sentencing policy agendas, like HB 210 and any other efforts to balance sentencing patterns, are ambitious and complex and should be monitored for their effectiveness.

Creation: Two unlikely criminal policy agendas
were the forerunners of House Bill 210
► Some saw the minimum mandatory drug selling penalties as too harsh.
Drug Trafficking: 3 year minimum mandatory for possession of five grams of cocaine, 5 years for 50 grams, and 15 years for 100 grams.
Repeat Drug Sales: 5 year minimum mandatory for a repeat drug selling any weight.
The 2003 Anticipated HB 210 DOC Bed Tradeoff
Showed a quick phase-in for newly reduced drug sentences, and
A slower phase-in of increased violent and serious property crime sentences, which over the long run would balance and be DOC bed impact neutral

► Burglary 2nd with a 1 year presumptive sentence became a 1 year minimum and a 2 year minimum for a repeat conviction.
► Assault 1st with at least some presumptive jail time as Felony C became a 2 year minimum term as a Felony B with a maximum of 25 instead of 10 years.
► 5 year minimum mandatory for a repeat drug selling conviction became 3 year minimum with an option to serve the last 6 months at Level IV.
The HB 210 TRADEOFF Increased Violent and Serious Property Crimes Penalties
And HARSHER Penalties for Serious Person and Property Crimes
With the anticipation that the projected tradeoff be DOC bed NEUTRAL.
The Context for the HB 210 was much more complex than the tradeoff of just harsh vs. light
DOC Beds

DOC Beds
Changing Fortunes for HB 210
In 2003, we expected a short term DOC bed savings followed after many years by a neutral bed impact. Instead, because of unanticipated outcomes actual impacts have varied dramatically.
► Robbery 1st with a 2 year minimum became a 3 year minimum and 5 year minimum for a repeat conviction
► Burglary 1st with a 2 year presumptive sentence became a 2 year minimum and a 4 year minimum for a repeat conviction
► The Attorney General had been seeking tougher penalties for violent crimes such as –
Robbery 1st with a 2 year minimum sentence Burglary 1st with a 2 year presumptive sentence Burglary 2nd with a 1 year presumptive sentence Assault 1st with at least some jail time presumptive
After Three Years of Negotiation and Many Impact Studies
in July 2003 HB 210 passed and was signed and
provided for a TRADEOFF of …
LIGHTER Drug Trafficking and Repeat Drug Selling Penalties
Delaware drug sentencing also includes provisions for ◆ Suspended instead of TIS for “Key” Prison Sentences
◆ Diversions to “Boot Camp” for 6 months of work and drug treatment
Tradeoff Drug Beds Saved Violent Crime Beds
DOC Beds
Second Surprise – Robbery 1st prosecution toughened after
2004 and volume of Drug Selling cases increased 24 percent off-setting shorter drug sentences. Habitual Sentences come into play with longer drug sentences. Assault and Burglary volume impact start to exceed expectation.
