Building Contract Template。

This Building Contract ("Contract") is made and entered into as of [Date], by and between [Builder Name], with a principal place of business at [Address] ("Builder"), and [Owner Name], with a principal place of residence at [Address] ("Owner").
1. Scope of Work。

Builder agrees to provide all labor, materials, equipment, and services necessary for the construction of [Description of Project] ("Project") in accordance with the plans and specifications attached hereto as Exhibit A. Builder shall complete the Project in a good and workmanlike manner, in compliance with all applicable laws, regulations, and codes.
2. Payment。

Owner agrees to pay Builder the total contract price of [Total Contract Price] for the completion of the Project. The payment shall be made in installments as follows:
a. [Percentage]% of the total contract price upon the execution of this Contract;
b. [Percentage]% of the total contract price upon completion of [Milestone 1];
c. [Percentage]% of the total contract price upon completion of [Milestone 2];
d. [Percentage]% of the total contract price upon substantial completion of the Project; and。

e. The remaining balance upon final completion and acceptance of the Project.
3. Changes。

Owner may request changes to the plans and specifications, or additional work not included in the original scope of work. Any change or additional work shall be agreed upon in writing by both parties and shall be subject to an adjustment in the contract price and/or schedule.
4. Delays。

Builder shall use its best efforts to complete the Project within the timeframe specified in Exhibit A. However, Builder shall not be liable for any delays in the completion of the Project caused by events beyond its reasonable control, including but not limited to acts of God, labor disputes, and material shortages.
5. Warranties。

Builder warrants that all work performed under this Contract shall be free from defects in materials and workmanship for a period of [Warranty Period] from the date of substantial completion. Builder shall remedy any defects
or deficiencies promptly at its own cost and expense.
6. Insurance。

Builder shall maintain comprehensive general liability insurance, including coverage for bodily injury, property damage, and completed operations, with a minimum coverage of [Minimum Coverage Amount]. Builder shall provide Owner with a certificate of insurance upon execution of this Contract.
7. Indemnification。

Builder shall indemnify, defend, and hold harmless Owner from and against any and all claims, losses, damages, liabilities, and expenses arising out of or in connection with the performance of the Project, except to the extent caused by the negligence or willful misconduct of Owner or its agents.
8. Termination。

Either party may terminate this Contract upon written notice to the other party in the event of a material breach by the other party that remains uncured for a period of [Cure Period] days after written notice of such breach.
9. Dispute Resolution。

Any dispute arising out of or in connection with this Contract shall be resolved through mediation, and if mediation is unsuccessful, through binding arbitration in accordance with the rules of the American Arbitration Association.
10. Governing Law。

This Contract shall be governed by and construed in accordance with the laws of the state of [State], without regard to its conflict of laws principles.
