法律英语学习之我见去年的时候就答应《英姿》的同学要写一篇关于法律英语学习的文章,可是由于我自己的事情实在太多,所以一再爽约,在这里先表示歉意了。

我们的话题是法律英语学习,不过我想我们却要先从法律英语学习之外讲起。

正如我上大学时的翻译老师曾经说过的“汝果欲学诗, 功夫在诗外”(后来得知,是陆游说的)。

有许多与英语学习无关的因素反倒是决定了我们能否学好英语。

首先,还是那句老话,“兴趣是最好的老师”。

学习法律英语不能没有兴趣,即使大家都知道,可我还是想再次强调一番。

众所周知,法律法规、条文多少都是有些枯燥单调晦涩生硬的;而英语单词、语法也往往是一成不变索然无味的。

如果没有强大的意志力和兴趣的支撑,恐怕是很难面对法律和英语的双重“折磨”的。

在我带过的学生里面,不喜欢英语的人不在少数。

每当问到原因的时候,我们的同学总是回答说“没兴趣、没意思、没动力”。

如果真是这样的情形,我想一定是学不好法律英语的。

因为的确很难想象一个不喜欢英语的人,会喜欢法律英语,会有动力学好法律英语。

另一方面,我所说的兴趣也一定是真兴趣。

总是会有不少同学会把英语当作工具来看,也会有同学因为觉得学习法律英语能够“挣大钱”,所以“慕名而来”。

这样的观点也同样不可取。

对于“语言学习工具说”的观点,我一直都是持谨慎态度的。

因为“有“工具并不等于“爱”工具。

仅是谨小慎微地循规蹈矩、生硬刻板地墨守陈规,虽说无可指责,但这种毫无生气的“无作为”的态度恐怕难以达到法律英语的真境界。

学习任何一门课程,尤其是我们喜欢的课程,还是需要一些Passion的!至于另外的观点,我只想说同学们“想挣钱”的观点,其动机是单纯可爱的,而目标和方法却是没有的。

至少当我们有了足够的能力和见识时,我们的眼界就会更加开阔、长远,而不是仅仅总停留在某一方面。

所以在我看来,要想学好法律英语一定要有兴趣,也要有把它学好的决心和为之付出的努力。

所谓“事虽难做则必成”,正是这个道理。

回想我们所认识的法律以及法律职业,其实就是为我们的各项行为提供了一种规范,以告诉我们在违反了这些规范后我们可能承受的不利后果,法律职业者也是在运用法律给他人提供建议,以避免可能风险的发生、争取自己的权利;我们所说的法律是一种行为准则,其实也就隐含了霍姆斯所说的“法律就是预测”的观点。

但是现实生活中,我们很多时候缺少这种预测风险的习惯,我们总是在损害或争议发生之后才想到怎样运用法律来维权,在学习法律之后,亲戚朋友总是会问我许多生活中的法律问题,有些问题我觉得有些无能为力,可能我们普通中国公民太过“好人化”,所以我们总是习惯以道德、人情等来引导我们的行为,而不能像美国那样用理性的角度来用法律提前预测、规避风险,所以,在我国,我们学习法律主要是在学习怎样用法律来事后维权,但是这也并不妨碍我们学会用法律来预先规避风险。

具体工作职责包括以下几个方面:(1)审阅尽职调查文件、撰写尽职调查总结(英文)、起草补充尽职调查文件清单并跟踪、解决相关尽职调查法律问题,(2)参与电话会议和现场会议,翻译(有时甚至是同声传译)并总结会议内容,(3)审阅并修改法律意见书、招股说明书等交易文件。

在此,我想就我在lawspirit法律英语培训班的学习体验,结合我在香港的学习和工作经历,与大家共同分享我的一些心得体会。

随着中国经济和社会的发展,涉外法律服务项目的数量越来越多,而加入WTO 后,中国已正式进入了法律服务的全球化时代。

与之相伴的,法律人才市场的竞争也日趋激烈,并呈现了全球化的趋势。

这是一个机遇,但同时也是一种挑战。

与来自其他国家和地区的法律职业人员相比,中国大陆地区律师的优势在于:(1)中文,和(2)中国法律知识及中国法律服务经验。

但是,中国大陆律师的劣势也是很明显的,主要在于英语。

因此,在这种时代大背景下,法律英语的重要性不言而喻,甚至可以说,谁率先攻破了法律英语这座堡垒,谁就能够在新时代的法律人才竞争中脱颖而出,谁就能够走在时代的前沿。

就法律英语学习而言,首先也是最重要的一点在于要持之以恒、坚持不懈。

古人云:“不积跬步,无以致千里”。

众所周知,英语学习是“慢功夫”,法律英语学习更是如此。

法律英语培训班可能只有短短一个月,但法律英语的学习是个不断积累、不断强化的过程。

一个法学院学生在国际律师事务所的实习感悟一个法学院学生在国际律师事务所的实习感悟进外资律所今年我在一个极负盛名的外国律所(西欧)的北京代表处,获得了trainee律师助理的机会,授薪,先期四个月(外所在华雇佣中国实习生月薪一般是1600RMB/月.不足某一规定时间段时,往往倾向于多给一些,对我便是如此)。

我是该所历史上唯一一个工作过的本科生。

在该所从事过法律工作的人员(包括实习生在内)都至少是国内或国外名牌大学的硕士生,这里一半人员是外国人,另一半的中国人很多还是海归,必须承认,我是很幸运的。

(但,后来因为,尚未毕业,学校要求回校一段,我并没有完成整四个月的实习期)。

该所像其他一些有名的律所一样,自身便在北京上海几个最著名的法学院设立奖学金,奖学金的内容就是给予出色的学生提供费用在该所的中国分所实习。

我不是通过这种途径进入的,而是主动出击,凭借自己的主动精神、商法知识和外语能力拼过了简历筛选、笔试、面试等各个关卡。

现说一下我的经历:准备考研的时候,我就下定决心考完后一定要去高质量的外国律所的中国代表处实习,感觉那里才是职业的殿堂,做涉外律师锻炼的天堂。

(但,实习之后,熟悉了顶尖外所的工作,有一点不满意,见后文)1月15日考完研之后休息了两天,便按照上述的想法如是做,(之前我一心考研,没做过投过简历,也没考过公务员,孤注一掷)一、找可以接受实习生的外所1、在华外所概况外国及香港律师事务所在华有一百多个分所,主要集中在北京和上海,其他还有一些零星分布在主要的大城市,大连一个所,青岛一个,广州两个,成都一个,只有这六个城市有外国律所,可以在司法部20xx年网页上找到。

另外,还有其他城市分布有香港的律所。

北京上海的外国或香港律所的分所基本都是有本地大规模业务的,而其他的城市的外所或香港律所分所有一些是不尽人意的。

Ie:a、我曾经在大三暑假的时候,给天津的一个香港律所打电话问是否需要实习生,结果发现,这天津的所谓“分所”只有一个人,即接电话的小姐,显然这个所谓“分所”只是一个联络处,没有任何实质业务。

如果我们能够在繁忙的学习、工作之余每天抽出一、两个小时学习法律英语,如此坚持下去,一定会取得显著的进步。

“行胜于言”,我们应该从现在就行动起来!绝大多数中国人的读写能力都远强于听说能力,因此就法律英语的长期学习而言,重点在于听说实力的提高。

在这方面,lawspirit网站为我们提供了丰富、实用、有效的资源——学习平台、工具软件、电子辞典等,而且这些资料在不断更新、完善中,我们可以在日后的工作和学习中充分利用这些资源。

至于这些资料的具体使用方法,我想和大家分享我的两条经验:(1)在lawspirit法律英语学习平台上我们可以找到一些有文字答案和音频的听力学习材料,我们可以利用这些材料作“跟读模仿”练习,具体操作流程如
下:1.不看文字答案、听2——3遍,2. 精读文字答案:遇到生词、词组查辞典,扫清阅读障碍,3. 看文字答案、听一句、读一句(1遍),4. 看文字答案、听、同时跟读2——3遍,5. 不看文字答案、听、跟读,直到几乎可以完全听懂为止。

这种方法可谓一箭三雕,可以同时练习法律英语的读、听、说。

(2)过去我们在学习合同法、公司法翻译时比较重视在于重点法条的笔译,其实这些法条还可以作为口译练习材料,争取能够做到:看着中文法条能够流利地翻译成英文。

这是一种比较高阶的能力要求,可以为将来作听译、视译、同声传译打下坚实的基础。

虽然我们应当把法律英语学习当作一项长期的任务,但绝大多数来上lawspirit法律英语学习班的同学都有短期目标:入职考试、跳槽、职位升迁等,因此,我在此介绍一些法律英语水平短期突破的方法。

短期突破的关键在于“有的放矢”。

一般的律师事务所入职考试都包括两个主要部分:笔试和口试。

一、笔试的准备。

在法律英语班学习的一个月期间,课上要专心听讲、记好笔记、积极思考,课后要认真复习并做老师布置的作业;学习班结课后,要消化课上所讲的重点内容——与合同和公司法有关的内容。

二、口语。

重点准备面试的常规问题,要做到简历中的每一点都能够做到详细论述。

面试中的经典问题包括:
1. self-introduction
2. Why are you the best person for this job?
3. What class did you like best in school?
4. What did you learn from your last job?
5. your biggest strength and weakness
6. Why do you want to joint this firm?
7. your short-term and long-term plan
8. How do you define the word “success”?
9. What is your biggest failure or mistake?
10. How do you work under pressure? / How do you
handle emergency?。
