租船方式5种租船方式租船方式主要有定期租船和定程租船两种,最近几年也发展了一些其他形式。
(1)定期租船(Time Charter)。
又称期租船,是指按一定期限租赁船舶的方式,即由船东(船舶出租人)将船舶出租给租船人在规定期限内使用,在此期限内由租船人自行调度和经营管理。
租期可长可短,短则数月,长则数年。
这种租船方式不以完成航次数为依据,而以约定使用的一段时间为限。
定期租船的特点是:在租赁期间,船舶交由租船人管理、调动和使用。
货物的装卸、配载、理货等一系列工作都由租船人负责,由此而产生的燃料费、港口费、装卸费、垫舱物料费等都由租船人负担。
租金是按月(天或日历月)以每一夏季载重吨为计算单位计收。
租金一经约定即固定不变。
船方负担船员薪金、伙食等费用,并负责保持船舶在租赁期间的适航状态(Seaworthy)以及因此而产生的费用和船舶保险费用。
所谓适航状态一般是指使船舶能够正常运转,具有航海安全能力,能够适用接受和保管货物。
(2)定程租船(Voyage Charter, Tip Charter)。
又称程租船或航次租船,它是根据船舶完成一定航程(航次)来租赁的,租船市场上最活跃,且对运费水平的波动最为敏感的一种租船方式。
一般可分为:按单航次、来回航次、连续单航次和连续来回航次等方式租赁船舶。
在国际现货市场上成交的绝大多数货物(主要包括液体散货和干散货两大类)都是通过航次租船方式运输的。
程租船的“租期”取决于航次运输任务是否完成,由于航次租船并不规定完成一个航次或几个航次所需的时间,因此般舶所有人对完成一个航次所需的时间是最为关心的,他特别希望缩短船舶在港停泊时间。
而承租人与船舶所有人对船舶的装卸速度又是对立的,所以在签订租船合同时,承租双方还需约定船舶的装卸速度以及装卸时间的计算办法,并相应地规定延滞费和速遣费率的标准和计算方法。
定程租船的特点是:无固定航线、固定装卸港口和固定航行船期,而是根据租船人(货主)的需要和船东的可能,经双方协商,在程租船合同中规定;程租船合同需规定装卸率和滞期、速遣费条款;运价受租船市场供需情况的影响较大,租船人和船东双方的其他权利、义务一并在程租船合同中规定。
