第八讲外贸函电(六)装 运(Shipment)(施 玲 上海兰生学院)装运条件是买卖合同中的一项重要条款,包括装运时间(Time of Shipment)、装运港/地(Port/ Place of Shipment)、目的港/地(Port / Place of Destination)、运输方式(Transport Modes)、装卸时间、装运单据(Shipping Order, S/O)等。
海洋运输是对外贸易中最主要的运输方式之一。
海洋运输主要有班轮运输(Liner Transport)和租船运输(Charter Transport)两种。
装运是卖方履行交货义务的行为。
就国际贸易而言,装运大多数由远洋轮来承担,即不定期货船或定期班轮。
不定期货船是没有固定航线或航行日程的一种货船,经常往返于需要舱位的港口之间。
而定期班轮则是在特定港口之间有确定的常规启航和到达日程的一种货船。
当出口商在接到进口商寄来的装运指示及相关信用证之后,就应该马上准备下列装运事宜:1) 向船运公司租订舱位2) 向海关进行出口申报3) 等待船运公司签发的装运单4) 收到装运单后开始装船:装运前买方将装运要求以书面形式通知卖方,说明装船方式、包装规定和唛头。
这份书面通知即称为装运须知(Shipping Instructions)。
5) 装运结束后凭装运单换取承运货轮大副签发的收据。
卖方于货物装船后,向买方或其指定的收货人及时发出装运通知。
6) 起航之前,再换取正式的海运提单(Bill of Lading)。
装运通知一旦发出,即意味着合同的实现。
海运提单是装运的重要单证,具有物权凭证的特点。
因此可以通过背书、甚至无需背书即可以转让提单,从而将货物的所有权让出。
近来国际贸易为了加快交货速度,经常采用航空运输,但航空运输的运单不是物权凭证。
有关装运的信函通常涉及以下几个方面:装运指示,装运通知、催促早日装运、修改装船条款,关于分批和转运的要求,装运单据等。
