1945年7月26日中美英三国敦促日本投降的《波茨坦公告》第10项指出:“吾人无意奴役日本民族或消灭国家,但对于战罪人犯,包括虐待吾人俘虏在内,将处以法律之严厉制裁。

”这明明白白地宣告了远东国际军事法庭设立的必要性和合理性。

影片中有两个镜头令我十分震撼:镜头一:狗日的日本鬼子在电影中和田正夫两次喊出了“狗日的日本鬼子”,一个日本人为什么会这样说日本人呢?他是亲历了这场战争的人,而且与他杀死宏二有很大关系。

他亲眼看到了一个天真的孩子变成了杀人狂魔,而且一定有人在他们面前狂喊“狗日的日本鬼子”。

他是一个热爱和平的人,他是被骗到战场上去的。

所以,他回来后整日饮酒,为了忘记残酷的记忆;所以,他在面对肖南他们时跪下谢罪;所以,他在酒馆内自杀后看着自己的伤口有些许安慰;所以,他死在北野雄一的枪下时,他笑了,因为他解脱了;所以,他们临死前,仍用这句骂自己人的`话,告诉他的国人,他们错了。

镜头二:酒馆老板娘的死在一个小酒馆,当美丽的老板娘轻轻哼着日本民歌,带着对战后的憧憬,带着对生活的热爱,带着她天性中的纯良翩然起舞时,一颗不知从何而来的子弹射穿了她的身体,她于是那样倒下去,灿烂的笑容还未来得及绽放便萎谢了,春花在战争所带来的阴郁中随风飘零,她那样倒下去了,满地的鲜血,她的眼中还有不甘,还有迷惑。

这条通告全称为:《设置远东国际军事法庭的特别通告》。

1945年8月15日,日本宣布无条件投降,9月2日,在美国军舰“密苏里”号上签订投降书,第二次世界大战正式落下帷幕。

战争虽然结束,但世界遍地残垣,硝烟虽然散去,但冤魂仍在哀泣。

谁该负责?谁该受惩?如何判定?如何惩罚?这些都是要清算的。

麦克阿瑟的这份通告发出,意味着这场清算审判的前期准备工作已经全部完成,负责审判日本战犯的机构——“远东国际军事法庭”正式成立。

就在麦克阿瑟发出公告后不久,中央社从重庆发出一则电文:“我政府业已派定名法官梅汝璈、向哲濬二氏为首批出席代表,向氏将任该庭检察官,梅氏将任审判官,闻二氏日内均将首途赴日。

”作为二战中受日本伤害最深,损失最重的中国,自然要派出自己的代表。

一场全世界瞩目的“东京审判”,即将拉开序幕。

2这场很多中国人认为胜券在握的审判,一开始就遇到了“麻烦”。

按照规定,组成远东国际军事法庭的法官,来自中、美、英、苏、澳、加、法、荷、新、印、菲十一个国家,每个国家各提名一名法官,由麦克阿瑟任命,共同组成审判庭。

还没开庭,一个事先谁都没想到的问题就发生了:十一名法官的座次怎么分?远东军事法庭的章程对法官的座次并没有明确规定。

一开始,大多数法官也没把“座次”当回事,中国派出的法官梅汝璈认为,就按当时盟军在“密苏里”号舰上盟军受降时签字的次序来不就行了:美中英苏澳……对此,多数法官都赞同。

但来自澳大利亚的庭长卫勃却表示:他希望他亲近的英国法官和美国法官坐在他左右两边——这样一来,中国就等于是排到了第三位。

1945.9.2 在美国军舰密苏里号上日本外相重光葵代表日本与同盟国各国代表正式在投降书上签字,这些国家有美国,英国中国澳大利亚苏联加拿大法国新西兰荷兰,这个时刻标志着长达8年的中国抗日战争以及给世界各国人民带来深重灾难的第二次世界大战正式结束了。

战争结束了,但对历史的清算才刚刚开始,1945.9.11驻日盟军最高统帅麦克阿瑟发布了一号逮捕令,东条英机等39人被宣布为首批战争嫌疑犯,在接下来的两个多月里,2号3号4号逮捕令相继发布,一共逮捕了118名战争嫌疑犯,这些战犯被关押在东京的巢鸭监狱候审,这些人个个都是狂热的军国主义分子,他们曾经不可一世,官居要职,手里掌握着生杀大权,而如今却成了阶下囚,麦克阿瑟将军发布的1号逮捕令上,位列首位的就是这位,东条英机。

日本陆军大臣,曾任第40任内阁首相,在他的任期内发动了太平洋战争,策划日本军队偷袭美国夏威夷珍珠港,疯狂侵略,践踏了十几个亚洲国家地区,是上千万生灵涂炭。

东条英机心里很清楚自己作恶太多,一旦被推上审判台就不会有好结果,于是他就琢磨着用一种体面的方式结束自己的生命。

就在盟军去逮捕他的那天,东条取出自己珍藏的希特勒送给他的科尔特自动手枪,对准这个圆圈,开了一枪,可是他并没有死,打偏了。

当逮捕东条的盟军到达他家的时候,他躺在血泊之中,还对前来逮捕他的盟军说,请不要抢救我,我不愿意在征服者的法庭上受审,可是这事可就由不得他了,3个月后,东条英机的伤被治好了,1946.1.19,远东国际军事法庭正式成立了。

后面,就是城里当天的情况。

它的地点就在日本前陆军省。

根据章程规定,远东国际军事法庭,任命美国人约瑟夫·季南为检察长。

就是照片上这位,任命澳大利亚人威廉·韦伯为法庭庭长,中国方面由向哲濬jun担任检察官。

远东国际军事法庭由11名法官组成,各国派出自己的精兵强将组成了强大的阵容,奔赴东京。

All of the accused joined in a formulation and execution of a plan, a conspiracy whose purpose was to establish Japan's military, political and economic control over the countries within the Pacific and Indian Oceans. In order to achieve this goal, Japan alone or working with other countries of like mind, embarked on a war of aggression, to subjugate all who stood in their way.
My prosecution team and I have produced more than enough evidence to prove the participation of the accused in these criminal actions.
Throughout the history of civilization, no one has ever seen human nature at such a peak of cruelty and barbarity. Countless people have died horrendous, unthinkable deaths to feed Japan's insatiable appetite for expansion. By their actions, they have challenged human civilization, they have challenged peace and they have challenged the whole world. Their common objective, a criminal objective, was to ensure the domination of Japan's Empire.
There is no greater crime than plotting and executing a war of aggression. The security of the world and its people was threatened by this plot and destroyed by this war, the only possible outcome of which is the great suffering the world has faced. Therefore, I, Joseph Keanan, on behalf of my colleagues in the ally prosecution team, solemnly request the honorable judges of the International Military Tribunal for the Far-east to severely punish those responsible for this horrible war of aggression in the name of justice, in the spirit of compassion and in the name of humanity!!!
