中国太平洋人寿保险股份有限公司附加门(急)诊团体医疗保险条款(2009年9月呈报中国保险监督管理委员会备案)第一条 合同构成本附加险合同附加于本公司一年期各类团体人身保险合同(以下简称“主险合同”)。
本附加险合同是投保人与本公司约定保险权利义务关系的协议,由保险单和其他保险凭证、所附条款及主险条款、投保单、与本附加险合同有关的投保文件、声明、批注、附贴批单构成。
“附加门(急)诊团体医疗保险”简称“附加团体门(急)诊”。
第二条 合同成立与生效投保人提出保险申请、本公司同意承保,本附加险合同成立。
合同生效日期在保险单上载明。
第三条 投保范围投保时年满16周岁(含16周岁)至法定退休年龄,身体健康、能正常工作或正常劳动的投保人在职人员,可以作为本附加险合同的被保险人;处于全休或半休的投保人员工,不能作为本附加险合同的被保险人;出生满90天至18周岁(含18周岁)、身体健康、能正常学习、生活的被保险人子女,以及身体健康、能正常工作、生活的被保险人配偶,经本公司同意可作为共同被保险人,由投保人统一向本公司投保本附加险。
除特别指明外,本条款以下所称“被保险人”均包括共同被保险人。
第四条 保险责任在保险期间内,且在主险合同和本附加险合同均有效的前提下,被保险人遭受意外伤害或患疾病,在本公司指定的医疗机构进行门(急)诊治疗,本公司对被保险人因门(急)诊治疗(不包括急诊留院观察期)而支出的符合保单签发地政府基本医疗保险管理规定的必要且合理的治疗费、检查费、手术费、药费中超过免赔额的费用在约定限额内按约定给付比例进行补偿。
具体的免赔额、给付比例以及每次门(急)诊给付的最高限额由投保人和本公司在投保时约定。
在任何情况下,本公司累计给付金额达到该被保险人的门(急)诊医疗保险金额时,本公司对该被保险人的保险责任终止。
若被保险人已参加公费医疗或基本医疗保险,则其应先向公费医疗或基本医疗保险机构申请赔付,本公司在被保险人从公费医疗、基本医疗保险中取得医疗费用补偿后,对剩余医疗费用按本条前三款的约定承担保险责任。

附件:中国太平洋财产保险股份有限公司神行车保机动车综合险(2009版)机动车损失保险条款总则第一条本保险合同为不定值商业保险合同,由保险条款、投保单、保险单、批改申请书、批单和特别约定组成。
凡涉及本保险合同的约定,均应采用书面形式。
第二条本保险为基本险。
投保了本保险后,可选择投保相应的附加险和特约条款。
基本险条款、附加险条款、特约条款的法律效力为:特约条款高于附加险条款,附加险条款高于基本险条款。
附加险条款未尽事宜,以基本险条款为准;特约条款未尽事宜,以基本险条款或附加险条款为准。
第三条本保险合同中的机动车是指以动力装置驱动或者牵引,上道路行驶的供人员乘用或者用于运送物品以及进行工程专项作业的轮式车辆或履带式车辆,不含摩托车和拖拉机。
第四条保险机动车灭失或发生全部损失、推定全损、部分损失一次赔款金额与免赔金额之和达到保险金额时,本保险责任终止。
保险责任第五条保险期间内,保险机动车在被保险人或其允许的合法驾驶人使用过程中,因下列原因造成保险机动车的全部损失或部分损失,保险人依照保险合同约定负责赔偿:1、碰撞、倾覆;2、火灾、爆炸,党政机关、事业团体用车、企业非营业用车的自燃;3、外界物体倒塌、空中物体坠落、保险机动车行驶中坠落;4、受保险机动车所载货物、车上人员意外撞击;5、雷击、暴风、暴雨、洪水、龙卷风、雹灾、台风、海啸、热带风暴、地陷、崖崩、滑坡、泥石流、雪崩、冰陷、雪灾、冰凌、沙尘暴;6、载运保险机动车的渡船遭受自然灾害(只限于有驾驶人随船照料者)。
第六条发生保险事故时,被保险人或其代表为防止或者减少保险机动车损失而采取施救、保护措施所支出的必要合理的费用,保险人负责赔偿。
本项费用的最高赔偿金额以保险金额为限。
责任免除第七条下列情况下,不论任何原因造成保险机动车的任何损失和费用,保险人均不负责赔偿:(一)交通肇事后逃逸;驾驶人、被保险人、投保人故意破坏现场、伪造现场、毁灭证据;被保险人或其允许的驾驶人的故意行为、犯罪行为;(二)驾驶人有下列情形之一者:1、饮酒、服用国家管制的精神药品或者麻醉药品;2、无驾驶证,驾驶证失效或者被依法扣留、暂扣、吊销期间;3、驾驶与驾驶证载明的准驾车型不相符合的机动车;4、实习期内驾驶公共汽车、营运客车或者执行任务的警车、消防车、救护车、工程救险车、载有危险物品的机动车或牵引挂车的机动车;5、使用各种专用机械车、特种车的人员无国家有关部门核发的有效操作证,或驾驶出租机动车或营业性机动车无交通运输管理部门核发的许可证书或其他必备证书;6、法律法规规定的其他属于无有效驾驶资格的情况。

中国太平洋人寿保险股份有限公司团体定期寿险条款(2009年8月呈报中国保险监督管理委员会备案)第一条 合同构成本保险合同(以下简称“本合同”)由保险单及所附条款、投保单、合法有效的声明、批注、附贴批单等构成。
“团体定期寿险”简称“团定寿”。
第二条 合同成立与生效投保人提出保险申请、本公司同意承保,本合同成立。
合同生效日期在保险单上载明。
合同生效日对应日、保险费约定支付日均以该日期计算。
第三条 投保范围一、投保人:机关、企业、事业单位和社会团体可作为投保人,为其成员向本公司投保本保险。
二、被保险人:16周岁以上(含16周岁),64周岁以下(含64周岁),身体健康,能正常劳动或工作的人,可作为本合同的被保险人。
第四条 保险责任在本合同约定的保险责任有效期内,本公司对被保险人负有以下保险责任:一、被保险人在本合同生效之日起180日内因疾病身故或全残,本公司给付保险金额的10%,本公司对该被保险人的保险责任终止。
二、被保险人因遭受意外伤害所致身故或全残,或在本合同生效之日起180日后因疾病身故或全残,本公司给付保险金额全数,本公司对该被保险人的保险责任终止。
第五条 责任免除因下列情形之一导致被保险人身故或全残的,本公司不承担保险责任:一、投保人故意造成被保险人身故、伤残或疾病;二、被保险人故意犯罪或抗拒依法采取的刑事强制措施;三、被保险人自本合同成立或合同效力恢复之日起2年内自杀,但被保险人自杀时为无民事行为能力人的除外;四、被保险人主动吸食或注射毒品;五、被保险人酒后驾驶,无合法有效驾驶证驾驶,或驾驶无有效行驶证的机动车;六、战争、军事冲突、暴乱或武装叛乱;七、核爆炸、核辐射或核污染。
发生上述第一项情形导致被保险人身故的,本公司对该被保险人的保险责任终止,投保人已交足2年以上保险费的,本公司向被保险人的继承人退还相应的现金价值。
发生上述第一项情形导致被保险人全残的,本公司对该被保险人的保险责任终止,投保人已交足2年以上保险费的,本公司向被保险人退还相应的现金价值。

中国太平洋财产保险股份有限公司附加扩展被保险人承保年龄保险条款总则第一条本保险合同附加于含意外伤害保险责任的各类团体人身保险合同(以下简称“所附合同”)。
所附合同效力终止,本保险合同效力亦终止;所附合同无效,本保险合同亦无效。
所附合同与本保险合同相抵触之处,以本保险合同为准。
本保险合同未约定事项,以所附合同为准。
第二条本保险合同被保险人指身体健康、能正常工作或生活的人员,不受所附合同被保险人年龄范围的限制。
被保险人不具有完全民事行为能力的,必须取得其法定监护人书面同意。
保险责任第三条在本保险合同保险期间内,被保险人遭受所附合同保险责任范围内的意外伤害,保险人依照所附合同的约定承担保险金给付责任。
责任免除第四条本保险合同的责任免除如下:一、所附合同无效或失效,保险人不负任何给付保险金责任。
二、所附合同中列明的“责任免除”事项,也适用于本保险合同。
保险金额和保险费第五条保险金额是保险人承担给付保险金责任的最高限额。
保险金额由投保人、保险人双方约定,并在保险单中载明。
保险金额一经确定,中途不得变更。
被保险人为未成年人的,其身故保险金额应符合中国保险监督管理委员会的相关规定。
保险金额一经确定,中途不能变更。
投保人应该按照合同约定向保险人交纳保险费。
保险期间第六条本保险合同的保险期间同所附合同,以保险单载明的起讫时间为准。
投保人、被保险人义务第七条除另有约定外,投保人应当在保险合同成立时交清保险费。
本保险合同约定一次性交付保险费或对保险费交付方式、交付时间没有约定的,投保人应在保险责任起始日前一次性交付保险费;约定以分期付款方式交付保险费的,投保人应按期交付第一期保险费。
投保人未按本款约定交付保险费的,本保险合同不生效,保险人不承担保险责任。
如果发生投保人未按期足额交付保险费或不按约定日期交付第二期或以后任何一期保险费的情形, 从违约之日起,保险人有权解除本保险合同并追收已经承担保险责任期间的保险费和利息,本保险合同自解除通知送达投保人时解除;在本保险合同解除前发生保险事故的,保险人按投保人已付保险费占保险单中载明的总保险费的比例承担保险责任。

对于保险单签发地政府基本医疗保险制度报销范围内的合理且必要的特殊病种门诊医疗费用,本附加险扩展承保。
本附加险特殊病种指保险单签发地政府核准的某些病程较长,需连续治疗或长期服药,符合住院条件而又可在门诊治疗的病种,申请给付特殊病种医疗费用的被保险人事先需向当地社会医疗主管部门申报相应资格并获得其审批同意。
若主保险合同与本附加险合同的条款互有冲突,则以本附加险合同的条款为准。
本附加险合同未尽事宜,以主险合同的条款规定为准。

第二条投保范围一、被保险人范围:凡身体健康,能够正常工作的正式在职员工及其身体健康的亲属(仅限其配偶及子女)均可作为被保险人参加本保险。
二、投保人范围:经被保险人同意的机关、企业、事业单位和社会团体均可作为投保人,向新华人寿保险股份有限公司(以下简称“本公司”)投保本保险。
第三条保险责任一、在本合同保险期间内,被保险人于本合同生效之日起三十日之内(含三十日,保险期间届满时按本合同第八条续保的,不受本条规定的三十日限制)经本公司认可医院(详见释义)的专科医生(详见释义)确诊发生本合同所指的重大疾病(详见释义),本公司按本合同所载保险金额的百分之十给付重大疾病保险金,本合同对该被保险人的保险责任即行终止。
二、在本合同保险期间内,被保险人于本合同生效之日起三十日后经本公司认可医院的专科医生确诊发生本合同所指的重大疾病,本公司按本合同所载的保险金额给付重大疾病保险金,本合同对该被保险人的保险责任终止。
团体补充医疗保险条款(2009版)
永安财产保险股份有限公司团体补充医疗保险条款(2009版)总则第一条合同构成本保险合同由保险条款、投保单、保险单、保险凭证以及批单等组成。
凡涉及本保险合同的约定,均应采用书面形式。
第二条被保险人凡投保团体内身体健康、能正常工作的在职职工(经保险人同意,退休职工也可作为被保险人),均可作为本保险的被保险人。
第三条投保人应为对被保险人有保险利益的机关、企业、事业单位和社会团体,其投保的人数必须占约定承保团体人员的75%以上,且投保人数不低于5人。
第四条受益人除另有约定外,本保险合同的医疗保险金受益人为被保险人本人。
第五条医疗费用损失补偿原则本保险中的医疗费用保险属于费用补偿型保险,即被保险人通过任何途径(包括本合同)所获得的医疗费用补偿金额的总和以被保险人实际支出的、符合本保险单签发地社会医疗保险主管部门规定可报销的、直接用于治疗的、合理且必要的医疗费用为限。
保险责任第六条保险责任在保险期间内,被保险人因遭受意外伤害或自本合同生效之日起90日后(经保险人同意并加费或及时续保者不受本款90日等待期的限制)初次罹患疾病,在保险人认可的医疗机构住院治疗而支出的医疗、医药费用,保险人承担下列给付责任:(一)被保险人住院期间所发生的起付限额以上,符合城镇职工基本医疗保险管理规定及其相关配套文件规定的治疗费、检查费、手术费、药费、床位费,保险人按最高90%的比例(具体以合同约定为准)在保险金额内予以补偿。
本保险共设有11款起付限额供选择(见附表)。
(二)在保险期间内,无论被保险人一次或多次发生住院治疗,保险人均按规定给付保险金,但累计给付金额达到保险金额时,保险人对该被保险人的保险责任终止。
(三)保险事故发生时,被保险人拥有其他医疗费用保险有效保单的,保险人按本合同有效保险金额与全部合同有效保险金额的比例承担医疗费用给付责任。
责任免除第七条原因除外因下列原因造成被保险人住院医疗的,保险人不负给付保险金责任:(一)投保人的故意行为;(二)被保险人自致伤害或自杀,但被保险人自杀时为无民事行为能力人的除外;(三)因被保险人挑衅或故意行为而导致的斗殴、被袭击或被谋杀;(四)被保险人因不孕不育治疗、人工受精、怀孕(含宫外孕)、分娩(含难产及剖腹产)、流产、避孕、堕胎、节育(含绝育)、产前产后检查以及由以上原因引起的并发症;(五)被保险人接受整容手术及其他内、外科手术;(六)被保险人未遵医嘱,私自服用、涂用、注射药物;(七)任何生物、化学、原子能武器,原子能或核能装置所造成的爆炸、灼伤、污染或辐射;(八)恐怖活动;(九)被保险人因中暑、高原病、药物过敏、细菌和病毒感染(因意外伤害导致的感染除外);(十)被保险人从事潜水、滑水、滑雪、滑冰、跳伞、蹦极跳、登山、攀岩运动、探险活动、武术比赛、摔跤比赛、柔道、空手道、跆拳道、拳击、特技表演、蹦极、赛马、赛车、各种车辆表演及车辆竞赛等高风险运动;(十一)凡被保险人出入、身处、驾驶、服务、上落于任何航空装置或航空运输工具,但不包括由商业航空公司在规定的搭客航线上行驶的飞机。

Provided b y European Link S.A. www.europeanlink.grInstitute Time Clauses - Hulls 1.10.83This insurance is subject to English law and practice1NAVIGATION1.1 The Vessel is covered subject to the provisions of this insurance at all times and has leave tosail or navigate with or without pilots, to go on trial trips and to assist and tow vessels or craft in distress, but it is warranted that the Vessel shall not be towed, except as is customary or to the first safe port or place when in need of assistance, or undertake towage or salvage services under a contract previously arranged by the Assured and/or Owners and/or Managers and/or Charterers. This Clause 1.1, shall not exclude customary towage in connection with loading and discharging,1.2 In the event of the Vessel being employed in trading operations which entail cargo loading ordischarging at sea from or into another vessel (not being a harbour or inshore craft) no claim shall be recoverable under this insurance for loss of or damage to the Vessel or liability to any other vessel arising from such loading or discharging operations, including whilst approaching, lying alongside and leaving, unless previous notice that the Vessel is to be employed in such operations has been given to the Underwriters and any amended terms of cover and any additional premium required by them have been agreed.1.3 In the event of the Vessel sailing (with or without cargo) with an intention of being (a) brokenup, or (b) sold for breaking up, any claim for loss of or damage to the Vessel occurring subsequent to such sailing shall be limited to the market value of the Vessel as scrap at the time when the loss or damage is sustained, unless previous notice has been given to the Underwriters and any amendments to the terms of cover insured value and premium required by them have been agreed. Nothing in this Clause 1.3 shall affect claims under Clauses 8 and/or 11.2CONTINUATIONShould the Vessel at the expiration of this insurance be at sea or in distress or at a port of refuge or of call, she shall, provided previous notice be given to the Underwriters, be held covered at a pro rata monthly premium to her port of destination.3BREACH OF WARRANTYHeld covered in case of any breach of warranty as to cargo, trade, locality towage, salvage services or date of sailing, provided notice be given to the Underwriters immediately after receipt of advices and any amended terms of cover and any additional premium required by them be agreed.4TERMINATIONThis Clause 4 shall prevail notwithstanding any provision whether written typed or printed in this insurance inconsistent therewith.Unless the Underwriters agree to the contrary in writing, this insurance shall terminate automatically at the time of4.1 change of the Classification Society of the Vessel, or change, suspension, discontinuance,withdrawal or expiry of her Class therein, provided that if the Vessel is at sea such automatic termination shall be deferred until arrival at her next port. However where such change, suspension, discontinuance or withdrawal of her Class has resulted from loss or damage covered by Clause 6 of this insurance or which would be covered by an insurance of the Vessel subject to current Institute War and Strikes Clauses Hulls-Time such automatic termination shall only oper ate should the Vessel sail from her next port without the prior approval of the Classification Society.4.2 any change, voluntary or otherwise, in the ownership or flag, transfer to new management,or charter on a bareboat basis, or requisition for title or use of the Vessel, provided that, if the Vessel has cargo on board and has already sailed from her loading port or is at sea in ballast, such automatic termination shall if required be deferred, whilst the Vessel continues her planned voyage, until arrival at final port of discharge if with cargo or at port of destination if in ballast. However in the event a requisition for title or use without the priorexecution of a written agreement by the Assured, such automatic termination shall occur fifteen days after such requisition whether the Vessel is at sea or in port.A pro rata daily net return of premium shall be made.5ASSIGNMENTNo assignment of or interest in this insurance or in any moneys which may be or become payable thereunder is to be binding on or recognised by the Underwriters unless a dated notice of such assignment or interest signed by the Assured, and by the assignor in the case of subsequent assignment, is endorsed on the Policy and the policy with such endorsement is produced before payment of any claim or return of premium thereunder.6PERILS6.1 This insurance covers loss of or damage to the subject-matter insured caused by6.1.1. perils of the seas rivers lakes or other navigable waters6.1.2 fire, explosion6.1.3 violent theft by persons from outside the Vessel6.1.4 jettison6.1.5 piracy6.1.6 breakdown of or accident to nuclear installations or reactors6.1.7 contact with aircraft or similar objects, or objects falling therefrom, lan d conveyance,dock or harbour equipment or installation6.1.8 earthquake volcanic eruption or lightning.6.2 This insurance covers loss of or damage to the subject-matter insured caused by6.2.1 accidents in loading discharging or shifting car go or fuel6.2.2 bursting of boilers breakage of shafts or any latent defect in the machinery or hull6.2.3 negligence of Master Officers Crew or Pilots6.2.4 negligence of repairers or charterers provided such repairers or charterers are no t anAssured hereunder6.2.5 barratry of Master Officers or Crewprovided such loss or damage has not resulted from want of due diligence by the Assured, Owners or Managers.6.3 Master Officers Crew or Pilots not to be considered Owners within the meaning of thisClause 6 should they hold shares in the Vessel7POLLUTI ON HAZARDThis insurance covers loss of or damage to the Vessel caused by any governmental authority acting under the powers vested in it to prevent or mitigate a pollution hazard, or threat thereof, resulting directly from damage to the Vessel for which the Underwriters are liable under this insurance, provided such act of governmental authority has not resulted from want of due diligence by the Assured, the Owners, or Managers of the Vessel or any of them to prevent or mitigate such hazard or threat. Master, Officers, Crew or Pilots not to be considered Owners within the meaning of this Clause 7 should they hold shares in the Vessel.83/4THS COLLISION LIABILITY8.1 The Underwriters agree to Indemnify the Assured for three-fourths of any sum or sums paidby the Assured to any other person or persons by reason of the Assured becoming legally liable by way of damages for8.1.1. loss of or damage to any other vessel or property on any other vessel8.1.2 delay to or loss of use of any such other vessel or property thereon8.1.3 general average of, salvage of, or salvage under contract of, any such other vessel orproperty thereon,where such payment by the Assured is in consequence of the Vessel hereby insured coming into collision with any other vessel.8.2 The indemnity provided by this Clause 8 shall be in addition to the indemnity provided by theother terms and conditions of this insurance and shall be subject to the following provisions:8.2.1 Where the insured Vessel is in collision with another vessel and both vessels are toblame then, unless the liability of one or both vessels becomes limited by law, theindemnity under this Clause 8 shall be calculated on the principle of cross-liabilities asif the respective Owners had been compelled to pay to each other such proportion ofeach other's damages as may have been properly allowed in ascertaining the balanceor sum payable by or to the Assured in consequence of the collision,8.2.2 In no case shall the Underwriters' total liability under Clauses 8.1 and 8.2 exceed theirproportionate part of three-fourths of the insured value of the Vessel hereby insured inrespect of any one collision.Exclusions8.4 Provided always that this Clause 8 shall in no case extend to any sum which the Assuredshall pay for or in respect of8.4.1 removal or disposal of obstructions, wrecks, cargoes or any other thing whatsoever8.4.2 any real or personal property or thing whatsoever except other vessels or property onother vessels8.4.3 the cargo or other property on, or the engagements of, the insured Vessel8.4.4 loss of life, personal injury or illness8.4.5 pollution or contamination of any real or personal property or thing whatsoever(except other vessels with which the insured Vessel is in collision or property on suchother vessels).8.3 The Underwriters will also pay three-fourths of the legal costs incurred by the Assured orwhich the Assured may be compelled to pay in contesting liability or taking proceedings to limit liability with the prior written consent of the Underwriters.9SISTERSHIPShould the Vessel hereby insured come into collision with or receive salvage services from another vessel belonging wholly or in part to the same Owners or under the same management, the Assured shall have the same rights under this insurance as they would have were the other vessel entirely the property of Owners not interested in the Vessel hereby insured; but in such cases the liability for the collision or the amount payable for the services rendered shall be referred to a sole arbitrator to be agreed upon between the Underwriters and the Assured.10NOTICE OF CLAIM AND TENDERS10.1 In the event of accident whereby loss or damage may result in a claim under this insurance,notice shall be given to the Underwriters prior to survey and also, if the Vessel is abroad, to the nearest Lloyd's Agent so that a surveyor may be appointed to represent the Underwriters should they so desire.10.2 The Underwriters shall be entitled to decide the port to which the Vessel shall proceed fordocking or repair (the actual additional expense of the voyage arising from compliance with the Underwriters. requirements being refunded to the Assured) and shall have a right of veto concerning a place of repair or a repairing firm.10.3 The Underwriters may also take tenders or may require further tenders to be taken for therepair of the Vessel. Where such a tender has been taken and a tender is accepted with the approval of the Underwriters, an allowance shall be made at the rate of 300fo per annum on the insured value for time lost between the despatch of the invitations to tender required by Underwriters and the acceptance of a tender to the extent that such time is lost solely as the result of tenders having been taken and provided that the tender is accepted withoutdelay after receipt of the Underwriters' approval. Due credit shall be given against the allowance as above for any amounts recovered in respect of fuel and stores and wages and maintenance of the Master Officers and Crew or any member thereof, including amounts allowed in general average, and for any amounts recovered from third parties in respect of damages for detention and/or loss of profit and/or running expenses, for the period covered by the tender allowance or any part hereof, Where a part of the cost of the repair of damage other than a fixed deductible is not recoverable from the Underwriters, t h e allowance shall be reduced by a similar proportion.10.4 In the event of failure to comply with the conditions of this Clause 10 a deduction of 15%shall be made from the amount of the ascertained claim.11GENERAL AVERAGE AND SALVAGE11.1 This insurance covers the Vessel's proportion of salvage, salvage charges and/or generalaverage, reduced in respect of any under-insurance, but in case of general average sacrifice of the Vessel the Assured may recover in respect of the whole loss without first enforcing their right of contribution from other parties.11.2 Adjustment to be according to the law and practice obtaining at the place where theadventure ends, as if the contract of affreightment contained no special terms upon the subject: but where the contract of affreightment so provides the adjustment shall be according to the York-Antwerp Rules.11.3 When the Vessel sails in ballast, not under charter the provisions of the York-AntwerpRules, 1974 (excluding Rules XX and XXI) shall be applicable, and the voyage for this purpose shall be deemed to continue from the port or place of departure until the arrival of the Vessel at the first port or place thereafter other than a port or place of refuge or a port or place of call for bunkering only If at any such intermediate port or place there is an abandonment of the adventure originally contemplated the voyage shall thereupon be deemed to be terminated.11.4 No claim under this Clause 11 shall in any case be allowed where the loss was not incurredto avoid or in connection with the avoidance of a peril insured against.12DEDUCTIBLE12.1 No claim arising from a peril insured against shall be payable under this insurance unlessthe aggregate of all such claims arising out of each separate accident or occurrence (including claims under Clauses 8,11 and 13) exceeds _________________ in which case this sum shall be deducted. Nevertheless the expense of sighting the bottom after stranding, if reasonably incurred specially for that purpose, shall be paid even if no damage be found, This Clause 12,1 shall not apply to a claim for total or constructive total loss of the Vessel or in the event of such a claim, to any associated claim under Clause 13 arising from the same accident or occurrence.12.2 Claims for damage by heavy weather occurring during a single sea passage between twosuccessive ports shall be treated as being due to one accident. In the case of such heavy weather extending over a period not wholly covered by this insurance the deductible to be applied to the claim recoverable hereunder shall be the proportion of the above deductible that the number of days of such heavy weather falling within the period of this insurance bears to the number of days of heavy weather during the sin gle sea passage, The expression "heavy weather" in this Clause 12.2 shall be deemed to include contact with floating ice.12.3 Excluding any interest comprised therein, recoveries against any claim which is subject tothe above deductible shall be credi t ed to the Underwriters in full to the extent of the sum by which the aggregate of the claim unreduced by any recoveries exceeds the above deductible.12.4 Interest comprised in recoveries shall be apportioned between the Assured and theUnderwriters, taking into account the sums paid by the Underwriters and the dates when such payments were made, notwithstanding that by the addition of interest the Underwriters may receive a larger sum than they have paid.13DUTY OF ASSURED (SUE AND LABOUR)13.1 In case of any loss or misfortune it is the duty of the Assured and their servants and agentsto take such measures as may be reasonable for the purpose of averting or minimising a loss which would be recoverable under this insurance.13.2 Subject to the provisions below and to Clause 12 the Underwriters will contribute to chargesproperly and reasonably incurred by the Assured their servants or agents for such measures. General average, salvage charges (except as provided for in Clause 13,5) and collision defence or attack costs are not recoverable under this Clause 13.13.3 Measures taken by the Assured or the Underwriters with the object of saving, protecting orrecovering the subject-matter insured shall not be considered as a waiver or acceptance ofabandonment or otherwise prejudice the rights of either party.13.4 When expenses are incurred pursuant to this Clause 13 the liability under this insuranceshall not exceed the proportion of such expenses that the amount insured hereunder bears to the value of the Vessel as stated herein, or to the sound value of the Vessel at the time of the occurrence giving rise to the expenditure if the sound value exceeds that value, Where the Underwriters have admitted a claim for total loss and property insured by this insurance is saved, the foregoing provisions shall not apply unless the expenses of suing and labouring exceed the value of such property saved and then shall apply only to the amount of the expenses which is in excess of such value.13.5 When a claim for total loss of the Vessel is admitted under this insurance and expenseshave been reasonably incurred in saving or attempting to save the Vessel and other property and there are no proceeds, or the expenses exceed the proceeds, then this insurance shall bear its pro rata share of such proportion of the expenses, or of the expenses in excess of the proceeds, as the case may be, as may reasonably be regarded as having been incurred in respect of the Vessel; but if the Vessel be insured for less than its sound value at the time of the occurrence giving rise to the expenditure, the amount recoverable under this clause shall be reduced in proportion to the under-insurance.13.6 The sum recoverable under this Clause 13 shall be In addition to the loss otherwiserecoverable under this insurance but shall in no circumstances exceed the amount insured under this insurance in respect of the Vessel.14NEW FOR OLDClaims payable without deduction new for old.15BOTTOM TREATMENTIn no case shall a claim be allowed in respect of scraping gritblasting and/or other surface preparation or painting of the Vessel's bottom except that15.1 gritblasting and/or other surface preparation of new bottom plates ashore and supplyingand applying any "shop" primer thereto,15.2 gritblasting and/or other surface preparation of:the butts or area of plating immediately adjacent to any renewed or refitted platingdamaged during the course of welding and/or repairs, areas of plating damaged during the course of fairing, either in place or ashore,15.3 supplying and applying the first coat of primer/anti-corrosive to those particular areasmentioned in 15.1 and 15.2 above,shall be allowed as part of the reasonable cost of repairs in respect of bottom platin g damaged by an insured peril.16WAGES AND MAINTAINANCENo claims shall be allowed, other than in general average, for wages and maintenance of the Master Officers and Crew, or any member thereof except when incurred solely for the necessary removal of the Vessel from one port to another for the repair of damage covered by the Underwriters, or for trial trips for such repairs, and then only for such wages and maintenance as are incurred whilst the Vessel is under way.17AGENCY COMMISSIONIn no case shall any sum be allowed under this insurance either by way of remuneration of the Assured for time and trouble taken to obtain and supply information or documents or in respect of the commission or charges of any manager, agent. managing or agency com pany or the like, appointed by or on behalf of the Assured to perform such services.18UNREPAIRED DAMAGE18.1 The measure of indemnity In respect of claims for unrepaired damage shall be thereasonable depreciation in the market value of the Vessel at the time this insurance terminates arising from such unrepaired damage, but not exceeding the reasonable cost of repairs.18.2 In no case shall the Underwriters be liable for unrepaired damage In the event of asubsequent total loss (whether or not covered under this insurance) sustained during the period covered by this insurance or any extension thereof.18.3 The Underwriters shall not be liable in respect of unrepaired damage for more than theinsured value at the time this insurance terminates.19CONSTRUCTIVE TOTAL LOSS19.1 In ascertaining whether the Vessel is a constructive total loss, the insured value shall betaken as the repaired value and nothing in respect of the damaged or break-up value of the Vessel or wreck shall be taken into account.19.2 No claim for constructive total loss based upon the cost of recovery and/or repair of theVessel shall be recoverable hereunder unless such cost would exceed the insured value. In making this determination, only the cost relating to a single accident or sequence of damages arising from the same accident shall be taken into account.20FREIGHT WAIVERIn the event of total or constructive total loss no claim to be made by the Underwriters for freight whether notice of abandonment has been given or not.21DISBURSEMENT WARRANTY21.1 Additional insurances as follows are permitted:21.1.1. Disbursements, Managers’Commissions, Profits or Excess or increased Value ofHull and Machinery. A sum not exceeding 25% of the value stated herein.21.1.2 Freight, Chartered Freight or Anticipated Freight, insured for time. A sum notexceeding 25% of the value as stated herein less any sum insured, howeverdescribed, under 21.1.1.21.1.3 Freight, or Hire, under contracts for voyage. A sum not exceeding the gross freightor hire for the current cargo passage and next succeeding cargo passage (suchinsurance to include, if required, a preliminary and an intermediate ballast passage)plus the charges of insurance. In the case of a voyage charter where payment ismade on a time basis, the sum permitted for insurance shall be calculated on theestimated duration of the voyage, subject to the limitation of two cargo passages aslaid down herein. Any sum insured under 21.1.2 to be taken into account and onlythe excess thereof may be insured, which excess shall be reduced as the freight orhire is advanced or earned by the gross amount so advanced or earned.21.1.4 Anticipated Freight if the Vessel sails in ballast and not under Charter. A sum notexceeding the anticipated gross freight on next cargo passage, such sum to bereasonably estimated on the basis of the current rate of freight at time of insuranceplus the charges of insurance. Any sum insured under 21.1.2 to be taken intoaccount and only the excess thereof may be insured21.1.5 Time Charter Hire or Charter Hire for Series of Voyages. A sum not exceeding 50%of the gross hire which is to be earned under the charter in a period not exceeding18 months. Any sum insured under 21,1,2 to be taken into account and only theexcess thereof may be insured, which excess shall be reduced as the hire isadvanced or earned under the charter by 50% of the gross amount so advanced orearned but the sum insured need not be reduced while the total of the sums insuredunder 21.1.2 and 21.1.5 does not exceed 50% of the gross hire still to be earnedunder the charter An insurance under this Section may begin on the signing of thecharter.21.1.6 Premiums. A sum not exceeding the actual premiu ms of all interests insured for aperiod not exceeding 12 months (excluding premiums insured under the foregoingsections but including, if required, the premium or estimated calls on any Club orWar etc. Risk insurance) reducing pro rata monthly.21.1.7 Returns of Premium. A sum not exceeding the actual returns which are allowableunder any insurance but which would not be recoverable thereunder in the event ofa total loss of the Vessel whether by insured perils or otherwise.21.1.8 Insurance irrespective of amount insured against:Any risks excluded by Clauses 23, 24, 25 and 26 below.21.2 Warranted that no insurance on any interests enumerated in the foregoing 21.1.1 to 21.1.7in excess of the amounts permitted therein and no other insurance wh ich includes total loss of the Vessel P P.I., F I.A., OI subject to any other like term, is or shall be effected tooperate during the currency of this insurance by or for account of the Assured, Owners, Managers or Mortgagees, Provided always that a breach of this warranty shall not afford the Underwriters any defence to a claim by a Mortgagee who has accepted this insurance without knowledge of such breach.22RETURNS FOR LAY-UP AND CANCELLATION22.1 To return as follows:22.1.1 Pro rata monthly net for each uncommenced month if this insurance be cancelled byagreement.22.1.2 For each period of 30 consecutive days the Vessel may be laid up in a port or in alay-up area provided such port or lay-up area is approved by the Underwriters (withspecial liberties as hereinafter allowed)(a) per cent not under repair(b) per cent under repairIf the Vessel is under repair during part only of a period for which a return isclaimable, the return shall be calculated pro rata to the nu mber of days under (a)and (b) respectively.22.2 PROVIDED ALWAYS THAT22.2.1 a total loss of the Vessel, whether by insured perils or otherwise, has not occurredduring the period covered by this insurance or any extension thereof.22.2.2 in no case shall a return be allowed when the Vessel is lying in exposed orunprotected waters, or in a port or lay-up area not approved by the Underwriters but,provided the Underwriters agree that such non-approved lay-up area is deemed tobe within the vicinity of the approved port or lay-up area, days during which theVessel is laid up in such non-approved lay-up area may be added to days in theapproved port or lay-up area to calculate a period of 30 consecutive days and areturn shall be allowed for the proportion of such period during which the Vessel isactually laid up in the approved port or lay-up area.22.2.3 loading or discharging operations or the presence of cargo on board shall not debarreturns but no return shall be allowed for any period during which the Vessel is beingused for the storage of cargo or for lightening purposes.22.2.4 in the event of any amendment of the annual rate, the above rates of return shall beadjusted accordingly.22.2.5 in the event of any return recoverable under this Clause 22 being based on 30consecutive days which fall on successive insurances effected for the sameAssured, this insurance shall only be liable for an amount calculated at pro rata ofthe period rates 22.1.2 (a) and/or (b) above for the number of days which comewithin the period of this insurance and to which a return is actually applicable. Suchoverlapping period shall run, at the option of the Assured, either from the first day onwhich the Vessel is laid up or the first day of a period of 30 consecutive days asprovided under 22.1.2 (a) or (b), or 22.2.2 above.The following clauses (23-26) shall be paramountand shall override anything in this insurance inconsistent therewith23WAR EXCLUSIONIn no case shall this insurance cover loss damage liability or expense caused by23.1 war civil war revolution rebellion insurrection or civil strife arising therefrom, or any hostileact by or against a belligerent power.23.2 capture seizure arrest restraint or detainment (barratry and piracy excepted), and theconsequences thereof or any attempt thereat.23.3 derelict mines, torpedoes bombs or other derelict weapons of war.24STRIKES EXCLUSIONIn no case shall this insurance cover loss damage liability or expense cause d by24.1 strikers, locked-out workmen, or persons taking part in labour disturbances, riots or civilcommotions.24.2 any terrorist or any person acting from a political motive.25MALICIOUS ACTS EXCLUSIONIn no case shall this insurance cover loss damage liability or expense arising from25.1 the detonation of an explosive25.2 any weapon of warand caused by any person acting maliciously or from a political motive.26NUCLEAR EXCLUSIONIn no case shall this insurance cover loss, damage, liability or expense arising from any weapon of war employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter.Provided by European Link S.A. www.europeanlink.gr。

中国太平洋财产保险股份有限公司附加团体补充重大疾病保险(深圳地区)条款总则第一条本附加保险合同(以下简称“本附加险合同”)可附加于团体重大疾病保险合同(以下简称“主险合同”),依主险合同投保人的申请,经保险人审核同意而订立。
只有在投保主险合同的情况下,方可投保本附加险合同。
主险合同效力终止,本附加险合同效力即行终止。
本附加险合同由保险条款、投保单、保险单、保险凭证以及批单等组成。
凡涉及本附加险合同的约定,均应采用书面形式。
第二条凡主险合同的被保险人,均可作为本附加险合同的被保险人。
保险责任第三条在本附加险合同保险期间内,保险人承担下列保险责任:被保险人经中华人民共和国境内(不含港、澳、台地区,下同)二级以上(含二级)或保险人认可的医院诊断于本附加险合同保险责任生效日起30日后(续保从续保生效日起)初次患本附加险合同所附补充重大疾病,保险人按保险金额给付补充重大疾病保险金,对该被保险人保险责任终止。
被保险人经中华人民共和国境内二级以上(含二级)或保险人认可的医院诊断于本附加险合同保险责任生效日起30日(含)内(续保除外)初次患本附加险合同所列补充重大疾病,保险人对投保人无息返还该被保险人对应的所交保险费,对该被保险人保险责任终止。
责任免除第四条一、主险合同无效或失效,保险人不负任何给付保险金责任。
二、主险合同中列明的“责任免除”事项,也适用于本附加险合同。
保险期间第五条除另有约定外,本附加险合同保险期间为一年。
条款适用第六条本附加险合同所记载事项,如与主险合同相抵触之处,以本附加险合同为准,未尽事宜,适用主险合同的规定。
释义第七条除另有约定外,本附加险合同中的下列词语具有如下含义:补充重大疾病:指被保险人初次患的下列疾病:1.脑炎后遗症或脑膜炎后遗症由病毒或细菌侵袭脑皮(髓)质引发的脑组织炎症,并且日常生活活动评估证实被保险人无能力独立完成下列六项日常生活活动中的三项或三项以上:洗澡、更衣、如厕、进食、步行及移动。

保险人在合同订立时已经知道投保人未如实告知的情况的,保险人不得解除合同;发生保险事故的,保险人应当承担给付保险金责任。
第十八条 投保人住所或通讯地址变更时,应及时以书面形式通知保险人。投保人未通知的,保险人按本附加保险合同所载的最后住所或通 讯地址发送的有关通知,均视为已发送给投保人。
第 二 十 条 投保人、被保险人或者保险金受益人知道保险事故发生后,应当在48小时内及时通知保险人。故意或者因重大过失未及时通 知,致使保险事故的性质、原因、损失程度等难以确定的,保险人对无法确定的部分,不承担给付保险金责任, 但保险人通过其他途径 已经及时知道或者应当及时知道保险事故发生的除外。
上述约定,不包括因不可抗力而导致的迟延。
第十七条 订立保险合同,保险人就保险标的或者被保险人的有关情况提出询问的,投保人应当如实告知。
投保人故意或者因重大过失未履行前款规定的义务,足以影响保险人决定是否同意承保或者提高保险费率的,保险人有权解除本 附加保险合同。
投保人故意不履行如实告知义务的,保险人对于合同解除前发生的保险事故,不承担给付保险金责任,并不退还保险费。
(7)若保险金申请人委托他人申请的,还应提供授权委托书原件、委托人和受托人的身份证明等相关证明文件。
(二)被保险人申请门诊急诊医疗保险金时,应按门诊急诊日期顺序提出索赔,并于门诊急诊之日起六十日内提出。
第二十二条 保险金申请人向保险人请求给付保险金的诉讼时效期间为二年,自其知道或者应当知道保险事故发生之日起计算。
第十三条 保险人认为投保人、被保险人或者受益人提供的有关索赔的证明和资料不完整的,应当及时一次性通知投保人、被保险人或者受 益人补充提供。

中国太平洋财产保险股份有限公司机身一切险、零备件一切险及航空公司责任险条款鉴于被保险人同意支付保单中约定的保险费,中国太平洋财产保险股份有限公司(以下称为保险人)同意按照本保单所列明的责任限额、除外责任、条件及其他条款承担保险责任:第一部分1. 机身一切险1.1. 保障范围保险人将对在保单明细表中列明的被保险人拥有、操纵、使用或负责的航空器在保单期限内发生的损失或损坏承担赔偿责任。
1.2. 失踪的航空器如航空器起飞后失踪,并且在十天后仍无任何消息,则将视为已经因本保单所保障的风险导致航空器发生损失,保险人同意赔付该航空器的协议价值。
1.3. 拆卸成本、救援开支及费用本部分保单也将保障:1.3.1. 即便没有损失发生,航空器因不可抗力或错误判断而降落于不能再次起飞的地点所发生的航空器拆卸的成本,以及从降落地点运输至最近适宜起飞机场的运输及重新组装的成本。
1.3.2. 为保障保险标的的安全,保护或恢复保险标的,被保险人所发生的救援开支和费用保险人应赔付部分,尽管保险人可能已经按全损赔付。
上述成本或费用将在本部分可能赔付的其他金额之外支付。
1.4. 维修成本如果发生被保险航空器的损坏,保险人将在扣除相应的免赔额后支付维修的成本。
维修成本包括进行维修所需人员、材料、工具和设备往返维修地点的运输成本和/或航空器或受损部件往返维修地点的运输成本。
运输应以最可行的方法通过水陆运输或空运。
如果由被保险人对受损发动机进行维修(包括本部分1.3.1.款下进行的工作),可按实际支付的工资另加250%计算工时费,或由被保险人选择,按照被保险人当时的平均工时费用标准计算工时费。
材料费用应为材料实际重置成本(加上与交付至被保险人基地有关的保险和运输成本)加上适用的进口关税。
航空器维修的成本也可包括必要试飞的成本,重新获得适航证的成本,及由被保险人选择,将修复的航空器调至距损失发生地最近的适宜该航空器运行的机场或其主运营机场的成本。

中国太平洋财产保险股份有限公司产品责任保险条款总则第一条本保险合同由保险条款、投保单、保险单、保险凭证以及批单等组成。
凡涉及本保险合同的约定,均应采用书面形式。
第二条凡在中华人民共和国(不含香港、澳门特别行政区和台湾地区,下同)境内依法设立的各类生产、销售、维修等企业均可成为本合同的被保险人。
保险责任第三条在保险期间或追溯期内,在保险单约定的承保区域内,由于被保险产品存在缺陷,造成第三者人身伤害或财产损失且被保险人在保险期限内首次受到赔偿请求,依照中华人民共和国法律(不含香港、澳门特别行政区和台湾地区法律,下同)应由被保险人承担的经济赔偿责任,保险人按照本保险合同约定负责赔偿。
第四条保险事故发生后,被保险人因保险事故而被提起仲裁或者诉讼的,对应由被保险人支付的仲裁或诉讼费用以及事先经保险人书面同意支付的其它必要的、合理的费用(以下简称“法律费用”),保险人按照本保险合同约定也负责赔偿。
责任免除第五条出现下列任一情形时,保险人不负责赔偿:(一)被保险产品本身的损失或其修理、改装、重置、退换、回收或召回引起的损失及费用;(二)因产品未达到其设计功能、第三者不当使用或因被保险人或其雇员错误地提供了产品所引发的赔偿责任;(三)被保险产品尚未离开被保险人或其经销商等代表方的控制或管理范围时所发生之赔偿责任;(四)被保险产品作为其他产品的材料、零部件、包装等组成部分时导致其他产品的损失,但保险合同另有约定者不在此限;(五)被保险产品尚未离开被保险人或其经销商等代表方的控制或管理范围时,被保险人或其经销商等代表方已经发现或知晓该产品已有缺陷;(六)被保险产品用于船舶、飞机或其他航空器;(七)由石棉、电磁场、霉变、铅毒或其相关问题引起的责任。
第六条下列原因造成的损失、费用和责任,保险人不负责赔偿:(一)投保人、被保险人及其代表的故意行为或重大过失;(二)战争、敌对行为、军事行动、武装冲突、罢工、骚乱、暴动、恐怖活动、恶意行为、强力占用或被征用;(三)核辐射、核爆炸、核污染及其它放射性污染;(四)大气污染、土地污染、水污染或其他各种污染;(五)计算机或其他电子装置内的数据信息或软件程序之损坏或该些装置之使用功能丧失。

中国太平洋财产保险股份有限公司雇主责任保险条款总则第一条本保险合同(以下简称为“本合同”)由保险条款、投保单、保险单或其他保险凭证、与本合同有关的投保文件、声明、批注、附贴批单或其他书面文件构成。
凡涉及本合同的约定,均应采用书面形式。
第二条凡中华人民共和国境内(不含香港、澳门特别行政区和台湾地区,下同)的政府机构、企事业单位、社会团体、个体经济组织及其他合法成立的组织均可成为本合同的被保险人。
保险责任第三条在保险期间内,被保险人的工作人员在中华人民共和国境内因下列情形导致伤残或死亡,依照中华人民共和国法律(不含香港、澳门特别行政区和台湾地区法律,下同)应由被保险人承担的经济赔偿责任,保险人按照本保险合同约定负责赔偿:(一)在工作时间和工作场所内,因工作原因受到事故伤害的;(二)工作时间前后在工作场所内,从事与工作有关的预备性或者收尾性工作受到事故伤害的;(三)在工作时间和工作场所内,因履行工作职责受到暴力等意外伤害的;(四)被诊断、鉴定为职业病;(五)因工外出期间,由于工作原因受到伤害或者发生事故下落不明的;(六)在上下班途中,受到机动车事故伤害的;(七)在工作时间和工作岗位,突发疾病死亡或者在48小时之内经抢救无效死亡的;(八)在抢险救灾等维护国家利益、公共利益活动中受到伤害的;(九)被保险职员原在军队服役,因战、因公负伤致残,已取得革命伤残军人证,到被保险人处工作后旧伤复发的;(十)法律、行政法规规定应当认定为工伤的其他情形。
第四条保险事故发生后,被保险人因保险事故而被提起仲裁或者诉讼的,对应由被保险人支付的仲裁或诉讼费用以及事先经保险人书面同意支付的其他必要的、合理的费用(以下简称“法律费用”),保险人按照本保险合同约定也负责赔偿。
责任免除第五条由于下列原因造成的任何损失、费用或赔偿责任,保险人不负责赔偿:(一)被保险人或其代表的故意行为或重大过失;(二)战争、敌对行为、军事行动、武装冲突、恐怖主义活动、罢工、暴动、民众骚乱;(三)行政行为、司法行为;(四)核辐射、核爆炸;(五)被保险人职员接触、使用含有放射性物质的材料;(六)被保险人职员接触、使用石棉、石棉制品或含有石棉成份的物质。

中国太平洋财产保险股份有限公司团体重大疾病保险条款总则第一条本保险合同由保险条款、投保单、保险单、保险凭证以及批单等组成。
凡涉及本保险合同的约定,均应采用书面形式。
第二条被保险人应为3周岁(含)至65周岁(含),身体健康、能正常工作或正常生活的自然人。
第三条投保人应为对被保险人有保险利益的机关、企业、事业单位和社会团体,其投保的人数必须占约定承保团体人员的75%以上,且投保人数不低于5人。
第四条除另有约定外,本保险合同的保险金的受益人为被保险人本人。
保险责任第五条在本保险合同保险期间内,保险人承担下列保险责任:被保险人经中华人民共和国境内(不含港、澳、台地区,下同)二级以上(含二级)或保险人认可的医院诊断于其保险责任生效日起30日后(续保从续保生效日起)初次患本保险合同所附重大疾病,保险人按保险金额给付重大疾病保险金,对该被保险人保险责任终止。
被保险人经中华人民共和国境内二级以上(含二级)或保险人认可的医院诊断于其保险责任生效日起30日(含)内(续保除外)初次患本保险合同所附重大疾病,保险人对投保人无息返还该被保险人对应的所交保险费,对该被保险人保险责任终止。
责任免除第六条因下列情形之一,导致被保险人发生疾病、达到疾病状态或进行手术的,保险人不承担保险责任:(一)投保人对被保险人的故意杀害、故意伤害;(二)被保险人故意自伤、故意犯罪或拒捕;(三)被保险人服用、吸食或注射毒品;(四)被保险人酒后驾驶、无合法有效驾驶证驾驶,或驾驶无有效行驶证的机动车;(五)被保险人患艾滋病或感染艾滋病病毒;(六)战争、军事冲突、暴乱、武装叛乱、恐怖活动;(七)核爆炸、核辐射或核污染;(八)遗传性疾病,先天性畸形、变形或染色体异常。
保险金额和保险费第八条保险金额是保险人承担给付保险金责任的最高限额。
保险金额由投保人、保险人双方约定,并在保险单中载明。
保险金额一经确定,中途不得变更。
投保人应该按照合同约定向保险人交纳保险费。
保险期间第九条本保险合同保险期间为一年,以保险单载明的起讫时间为准。
保险人义务第十条订立保险合同时,采用保险人提供的格式条款的,保险人向投保人提供的投保单应当附格式条款,保险人应当向投保人说明保险合同的内容。
对保险合同中免除保险人责任的条款,保险人在订立合同时应当在投保单、保险单或者其他保险凭证上作出足以引起投保人注意的提示,并对该条款的内容以书面或者口头形式向投保人作出明确说明;未作提示或者明确说明的,该条款不产生效力。
第十一条本保险合同成立后,保险人应当及时向投保人签发保险单或其他保险凭证。
第十二条保险人依据第十七条所取得的保险合同解除权,自保险人知道有解除事由之日起,超过三十日不行使而消灭。
保险人在合同订立时已经知道投保人未如实告知的情况的,保险人不得解除合同;发生保险事故的,保险人应当承担给付保险金责任。
第十三条保险人认为被保险人提供的有关索赔的证明和资料不完整的,应当及时一次性通知投保人、被保险人补充提供。
第十四条保险人收到被保险人的给付保险金的请求后,应当及时作出是否属于保险责任的核定;情形复杂的,应当在三十日内作出核定,但保险合同另有约定的除外。
保险人应当将核定结果通知被保险人;对属于保险责任的,在与被保险人达成给付保险金的协议后十日内,履行赔偿保险金义务。
保险合同对给付保险金的期限有约定的,保险人应当按照约定履行给付保险金的义务。
保险人依照前款约定作出核定后,对不属于保险责任的,应当自作出核定之日起三日内向被保险人发出拒绝给付保险金通知书,并说明理由。
第十五条保险人自收到给付保险金的请求和有关证明、资料之日起六十日内,对其给付的数额不能确定的,应当根据已有证明和资料可以确定的数额先予支付;保险人最终确定给付的数额后,应当支付相应的差额。
投保人、被保险人义务第十六条除另有约定外,投保人应当在保险合同成立时交清保险费。
保险费未交清前,本保险合同不生效,对保险费交清前发生的保险事故,保险人不承担保险责任。
第十七条订立保险合同,保险人就保险标的或者被保险人的有关情况提出询问的,投保人应当如实告知。
投保人故意或者因重大过失未履行前款规定的义务,足以影响保险人决定是否同意承保或者提高保险费率的,保险人有权解除本保险合同。
投保人故意不履行如实告知义务的,保险人对于合同解除前发生的保险事故,不承担给付保险金责任,并不退还保险费。
投保人因重大过失未履行如实告知义务,对保险事故的发生有严重影响的,保险人对于合同解除前发生的保险事故,不承担给付保险金责任,但应当退还保险费。
第十八条年龄计算与错误处理如下:一、被保险人的年龄以周岁计算。
二、投保人在申请投保时,应将被保险人的真实年龄在投保单上填明,如果发生错误应按照下列规定办理:1.投保人申报的被保险人年龄不真实,并且其真实年龄不符合本保险合同约定年龄限制的,保险人可以解除本保险合同或取消该被保险人资格,并在扣除手续费后向投保人退还保险单或该被保险人的未满期净保险费;2.投保人申报的被保险人年龄不真实,致使投保人的实交保险费少于应交保险费的,保险人有权更正并要求投保人补交保险费。
若已经发生保险事故,在给付保险金时按实交保险费和应交保险费的比例给付;3.投保人申报的被保险人年龄不真实,致使投保人实交保险费多于应交保险费的,保险人应将多收的保险费无息退还投保人。
第十九条投保人住所或通讯地址变更时,应及时以书面形式通知保险人。
投保人未通知的,保险人按本保险合同所载的最后住所或通讯地址发送的有关通知,均视为已发送给投保人。
第二十条在保险期间内,投保人因其人员变动,需增加、减少被保险人时,应以书面形式向保险人提出申请。
保险人同意后出具批单,并在本保险合同中批注。
被保险人人数增加时,保险人在审核同意后,于收到申请之日的次日零时开始承担保险责任,并按约定增收未满期净保险费。
被保险人人数减少时,保险人在审核同意后,于收到申请之日的次日零时起,对减少的被保险人终止保险责任(如减少的被保险人属于已离职的,保险人对其所负的保险责任自其离职之日起终止),并按约定退还未满期净保险费,但减少的被保险人本人或其保险金申请人已领取过任何保险金的,保险人不退还未满期净保险费。
减少后的被保险人人数不足其在职人员75%或人数低于5人时,保险人有权解除本保险合同,并按约定退还未满期净保险费。
第二十一条投保人、被保险人或者保险金受益人知道保险事故发生后,应当及时通知保险人。
故意或者因重大过失未及时通知,致使保险事故的性质、原因、损失程度等难以确定的,保险人对无法确定的部分,不承担给付保险金责任,但保险人通过其他途径已经及时知道或者应当及时知道保险事故发生的除外。
上述约定,不包括因不可抗力而导致的迟延。
保险金申请与给付第二十二条保险金申请人向保险人申请给付保险金时,应提交以下材料。
保险金申请人因特殊原因不能提供以下材料的,应提供其他合法有效的材料。
保险金申请人未能提供有关材料,导致保险人无法核实该申请的真实性的,保险人对无法核实部分不承担给付保险金的责任。
(1)保险金给付申请书;(2)保险单原件;(3)保险金申请人的身份证明;(4)中华人民共和国境内二级以上(含二级)或保险人认可的医院出具的附有病理显微镜检查、血液检验及其它科学方法检验报告的疾病诊断证明书;(5)保险金申请人所能提供的与确认保险事故的性质、原因、损失程度等有关的其他证明和资料;(6)若保险金申请人委托他人申请的,还应提供授权委托书原件、委托人和受托人的身份证明等相关证明文件。
受益人为无民事行为能力人或者限制民事行为能力人的,由其监护人代为申领保险金,并需要提供监护人的身份证明等资料。
诉讼时效期间第二十三条保险金申请人向保险人请求给付保险金的诉讼时效期间为二年,自其知道或者应当知道保险事故发生之日起计算。
争议处理和法律适用第二十四条因履行本保险合同发生的争议,由当事人协商解决。
协商不成的,提交保险单载明的仲裁机构仲裁;保险单未载明仲裁机构或者争议发生后未达成仲裁协议的,依法向中华人民共和国法院起诉。
第二十五条与本保险合同有关的以及履行本保险合同产生的一切争议处理适用中华人民共和国法律(不包括港澳台地区法律)。
其他事项第二十六条在本保险合同成立后,投保人可以书面形式通知保险人解除合同,但保险人已根据本保险合同约定给付保险金的除外。
投保人解除本保险合同时,应提供下列证明文件和资料:(1)保险合同解除申请书;(2)保险单原件;(3)保险费交付凭证;(4)投保人身份证明或投保单位证明。
投保人要求解除本保险合同,自保险人接到保险合同解除申请书之时起,本保险合同的效力终止。
保险人收到上述证明文件和资料之日起30日内退还保险单的未满期净保险费。
释义第二十七条除另有约定外,本保险合同中的下列词语具有如下含义:周岁:以法定身份证明文件中记载的出生日期为基础计算的实足年龄。
保险人:指与投保人签订本保险合同的中国太平洋财产保险股份有限公司。
医院:指保险人指定医院或中华人民共和国境内合法经营的区(县)级以上公立医院,但不包括主要作为诊所、康复、护理、休养、静养、戒酒、戒毒等或类似的医疗机构。
该医院必须具有符合国家有关医院管理规则设置标准的医疗设备,且全天二十四小时有合格医师及护士驻院提供医疗及护理服务。
重大疾病:指被保险人初次患的下列疾病:(一)恶性肿瘤指恶性细胞不受控制的进行性增长和扩散,浸润和破坏周围正常组织,可以经血管、淋巴管和体腔扩散转移到身体其它部位的疾病。
经病理学检查结果明确诊断,临床诊断属于世界卫生组织《疾病和有关健康问题的国际统计分类》(ICD-10)的恶性肿瘤范畴。
下列疾病不在保障范围内:(1)原位癌;(2)相当于Binet 分期方案A 期程度的慢性淋巴细胞白血病;(3)相当于Ann Arbor 分期方案I 期程度的何杰金氏病;(4)皮肤癌(不包括恶性黑色素瘤及已发生转移的皮肤癌);(5)TNM分期为T1N0M0期或更轻分期的前列腺癌;(6)感染艾滋病病毒或患艾滋病期间所患恶性肿瘤。
(二)急性心肌梗塞指因冠状动脉阻塞导致的相应区域供血不足造成部分心肌坏死。
须满足下列至少三项条件:(1)典型临床表现,例如急性胸痛等;(2)新近的心电图改变提示急性心肌梗塞;(3)心肌酶或肌钙蛋白有诊断意义的升高,或呈符合急性心肌梗塞的动态性变化;(4)发病90 天后,经检查证实左心室功能降低,如左心室射血分数低于50%。
(三)脑中风后遗症指因脑血管的突发病变引起脑血管出血、栓塞或梗塞,并导致神经系统永久性的功能障碍。
神经系统永久性的功能障碍,指疾病确诊180 天后,仍遗留下列一种或一种以上障碍:(1)一肢或一肢以上肢体机能完全丧失;(2)语言能力或咀嚼吞咽能力完全丧失;(3)自主生活能力完全丧失,无法独立完成六项基本日常生活活动中的三项或三项以上。
