第二条交货时间、地点和方式Delivery time, place

and style

1.交货时间：全部货款到账之日起五个工作日内或另行约定的时间。

Time of Delivery: 5 days since the 100% payment received or other appointed time. 2 .交货地点：上海

市松江工业区洞泾路39号普茨迈斯特机械（上海）有限公

司

Place of Delivery: Putzmeister Shanghai, 39 Dongjing Road, Songjiang Industrial Zone , Shanghai , China

3 .交货方式：自行提货。乙方提货时必须出具加盖乙方公章的货物交接单。甲方可以派员协助乙方办理运输，费用由乙方承担。保险事宜及路途安全事宜由甲方承担。

Delivery Style: Pick up by Party B. Party B should

pick up the goods from the delivery place with offering signed receipt by Party B. In case Party A assists to manage the transportation &

insurance, all the relevant fees shall be borne by Party B.

4 .因不可抗力原因，致使甲方迟延交货的，则交货日期相应顺延，甲、乙双方互不承担责任。

The delivery date shall be postponed accordingly

in case of force majeure occurred. Party A and Party

B will not take responsibilities.

本项所称不可抗力是指不能预见、不能避免并不能克服的客观情况。

The force majeure here indicates objective situation which

could not be predicted, avoided or overxxe.

第三条包装：整机裸装，附件木箱包装。

Package: Nude machine and accessories packed with wooden box.

第四条产品质量：普茨迈斯特(上海)制造。Quality Standard: Made by Putzimeister (Shanghai).

第五条随机备品：见随机附件一。Spare parts and tools: See appendix 1.

第六条验收Inspection & Acceptance

乙方有权在交货时和交货后对货物进行检验，并将发现

的任何暇疵在货物交付之日起30日内立即以书面方式通知

甲方。若乙方怠于通知，则视为标的物的质量和数量已符合合同约定。

Party B is entitled to check the goods during and

after delivery, and if there is any defect, Party B

sends written notice to Party A immediately within 30

days since the delivery date. The quality & quantity

of the goods should be deemed as according with regulations of this contract if Party B fails to make notice mentioned above.

第七条保修Repairing Guarantee

1.甲方对货物的品质保证期为货物交付后的12个月

或工作1,500工作小时（以先达到者为准），底盘的品质保

证期为货物交付后的12个月或行驶25,000公里内（以先达

到者为准）。如果并非由于甲方的过错而导致交货和/或验

收迟延，保证期限最迟在货物交付之日起12个月终止。在

整机修理和部件调换的情况下，甲方对所修理或调换部件的品质保证期与整机的保修期同时结束。

Guarantee period should be one year since the delivery or 1,500 working hours, whatever xxes earlier subject to prior one. Quality guarantee period for chassis should be 12 months since delivery or within 25,000 km running, subject to prior one whatever xxes earlier. In the event that delivery and/or acceptance is delayed due to circumstance which is not the supplier ' s fault, the guarantee period shall expire 12 months from since the delivery.

The same applies for

to repairs and replacement.

2 .在保证期内因正常使用而导致的机器故障或损害，甲方有义务进行修理、更换或其他补救，并承担费用。

For damages caused by normal use in the period of guarantee, Party A shall repair, replace or make other necessary remedy and bear the relevant expenses.
