一、专利惯用的词组Appl.No.(Application Number)申请号 Ser.No.(Serisl Number)申请书，登记号 Int.Cl.3 (International Patent Classification,3 rd Edition)国际专利分类表（第三版） Abstract of the disclosure发明摘要 Preferred embodiments最佳实施方案 Cross-Sheet 5 第5页（图共5页） Sheet 3 of 4第3页（图共4页）二、常用的句子1.Reference is made to our copending application No.25838/78 filed 31 st May 1978.请参阅我们在1978年5月31日登记的与此有关的申请书，其申请号为25838/78。

专利翻译常见用词与术语
一、常用语言点1. according to vs. based on美国版：in accordance with 更开放，according to 范围更小。
美国律师Paul觉得，based on似乎有direct dependent （直接依附/取决于）的意思，也就说，似乎可理解为直接因素。
欧洲字对字版：字面对应翻译，“根据” according to ; "基于" based on2. can vs. may关于“能够”，要根据实际情况选词：# 表达能力，一般不建议用can，而是capable of# 表示可能性，用can或 may# 如果只是表示具体事实，“能够”多余，可以不翻译（但需IPR确认）补充说明：以前美国律师强调过，can会有主观色彩，不建议用。
但现在没有强调，很多时候也用了。
但如果表示可能，用may更保险。
也有美国律师认为，没说can一定不用能，要看在什么地方。
如果是独权相应的描述，每个特征都是必须的，则不用can, can be, may, may be, optionally, etc. 当然，能够用may的地方，比用can听上去顺耳些，大概是更加正式吧。
3. consist of说明书、权利要求均应避免使用封闭性的短语和词语，例如：consist of, composed of, contain。
翻译时确认是否为封闭式。
如果是，可用；如果不是，用form, formed by, include等开放式表述。
（David: 这一条仍有待外国专家确认，但大家可以先遵守。
）4. comprise说明书部分不用comprise这种法律性很强的词。
只是要用include（注：comprise 和include都属于“包括但不限于”的意思，属于开放性词语）。
5. efficient权利要求避免使用以下词语：big, sufficient, strong, such as, when required, etc. e.g.6. preferred说明书中避免使用preferred，这样会给申请本身造成一定的限制。

一、常用语言点1. according to vs. based on美国版：in accordance with 更开放，according to 范围更小。
美国律师Paul觉得，based on似乎有direct dependent （直接依附/取决于）的意思，也就说，似乎可理解为直接因素。
欧洲字对字版：字面对应翻译，“根据” according to ; "基于" based on2. can vs. may关于“能够”，要根据实际情况选词：# 表达能力，一般不建议用can，而是capable of# 表示可能性，用can或 may# 如果只是表示具体事实，“能够”多余，可以不翻译（但需IPR确认）补充说明：以前美国律师强调过，can会有主观色彩，不建议用。
但现在没有强调，很多时候也用了。
但如果表示可能，用may更保险。
也有美国律师认为，没说can一定不用能，要看在什么地方。
如果是独权相应的描述，每个特征都是必须的，则不用can, can be, may, may be, optionally, etc. 当然，能够用may的地方，比用can听上去顺耳些，大概是更加正式吧。
3. consist of说明书、权利要求均应避免使用封闭性的短语和词语，例如：consist of, composed of, contain。
翻译时确认是否为封闭式。
如果是，可用；如果不是，用form, formed by, include等开放式表述。
（David: 这一条仍有待外国专家确认，但大家可以先遵守。
）4. comprise说明书部分不用comprise这种法律性很强的词。
只是要用include（注：comprise 和include都属于“包括但不限于”的意思，属于开放性词语）。
5. efficient权利要求避免使用以下词语：big, sufficient, strong, such as, when required, etc. e.g.6. preferred说明书中避免使用preferred，这样会给申请本身造成一定的限制。
建议使用exemplary来替换。
7. certain说明书中避免使用certain, about, approximately等含糊的词语。
8. effectively避免使用多余或带有赞美色彩的词。
如：e.g. a duration comprising elements A, B, and C, thus to iron clothes more effectively than heretofore.9. merely vs. only两个都可以用，需要全文统一使用。
10. when vs. if若为忠于中文，用when也行。
补充说明：在权利要求中,when比if的范围更大。
很多时候，会倾向于用when而非if。
If会理解为多选一，是 or 的关系，而when不会有这种理解。
所以，保护范围更大。
11. wherein说明书中不用said, wherein等法律词汇；在权利要求中使用。
12. 参见一般用refer to, 或者 reference is made to, 不用see。
For xxx, refer to FIG. 1.For xxx, reference may be made to FIG. 1.13. 多个表示“多个”，用a plurality of，不用 multiple of；因为multiple有倍数的意思。
表示“一个或多个”时，用 one or more14. 方式可以用manner，就不要翻译为mode；除非就是指“模式”（mode）的意思。
15. 判断/确定判断和确定都用 determine。
judge的主语一般是人。
没有judge whether的表达，只有determine whether 和 determine that.如果中文是"通过判断来确定"，需要根据上下文和IPR确认，是否可以直接处理成determine，而不处理成 determine by judging。
同一文档内，如果同时出现“判断单元/模块”和“确定单元/模块”，为区分名字，可以用judging unit 和 determining unit。
16. 其中说明书：where；权利要求:wherein段落开头的“其中”，如果有实际含义，建议把上一段的对应的句子重复一次，用“xxx, where”。
如果没有实际含义，直接删除。
17. 设置中文的“设置”可能是：配置（set, configure）也可能是“放置”（dispose, arrange, place）18. 特征值指能翻译出数据块一个概貌的词。
建议用sketch value；不用characteristicvalue/feature value。
19. 图例编号用reference numeral；不是legends 或 signs例子：11: First conductive cantilever12: Second conductive cantilever20. 解开打包: package/pack 解开、解包：unpack报文打包是 packetize 解包是 unpacketize压缩 compress 解压缩 decompress/uncompress，推荐用decompress21. buffer vs. cache缓存区/缓冲区 buffer与内存相关的混存 cache (存储器)buffer只临时存储数据，这个数据会释放掉。

27. includingincluding （包含、包括，介词）， for example (例如，习语，by way of illustration) 和 such as （例如，习语，like, for example）。
一般在手册中将它们用来作一些先行词的例举。
在专利领域，如果中文是“例如……等”，可以用：for example, such as 后面不加and the like, or the like, and so on;including 可以是部分列举，也可以是全部列举；such as只可以是部分列举。
所以，including 后面要加 and the like, or the like, and so on。
28. adapted to这个是以前规范中用过的术语，目前以“configured to configure”为准。
这是IPR 确认的表述。
29. 使能、开启属性、能力的“开启”，用 enable30. corresponding to (美 = be equal to) vs. correspond to建议：如果是静态描述，采用 be corresponding to；如果不需要明显区分动静态，两种表达都可以。
31. where vs. in which为了避免读者分不清where究竟是指“其中”，还是“in which”，建议定语从句中的先行词用 in which。

5、条目触摸屏上的联系人列表中，有很多条目。
条目就是一个个联系人。
这个条目是entry.6、源极关于“源极”、“漏极”、“栅极”的表达，有些电路相关的案子中，无需将“极”从字面上表达出来，直接用gate, drain等；而在另外一些案子中，也有把它翻译出来的。
对于相关领域的技术人员来说，都是可以的。
7、QoS不是看到服务质量、业务质量就一定翻译为quality of service。
