英国伦敦保险业协会货物保险条款

英国伦敦保险业协会货物保险条款在国际保险市场上,各国保险组织都制定有自己的保险条款。

但最为普遍采用的是英国伦敦保险业协会所制订的《协会货物条款》(Institute Cargo Clause;简称I.C.C.)、我国企业按CIF或CIP条件出口时,一般按《中国保险条款》投保,但如果国外客户要求按《协会货物条款》投保,一般可予接受。

《协会货物条款》的现行规定于1982年1月1日修订公布,共有6种险别,它们是:(1)协会货物条款(A)[简称ICC(A)];(2)协会货物条款(B)[简称ICC(B)];(3)协会货物条款(C)[简称ICC(C)];(4)协会战争险条款(货物)(IWCC);(5)协会罢工险条款(货物)(ISCC);(6)恶意损害险(Malicious Damage Clause)。

以上六种险别中,(A)险相当于中国保险条款中的一切险,其责任范围更为广泛,故采用承保"除外责任"之外的一切风险的方式表明其承保范围。

(B)险大体上相当于水渍险。

(C)险相当于平安险,但承保范围较小些。

(B)险和(C)险都采用列明风险的方式表示其承保范围。

六种险别中,只有恶意损害险,属于附加险别,不能单独投保,其他五种险别的结构相同,体系完整。

因此,除(A)、(B)、(C)三种险别可以单独投保外,必要时,战争险和罢工险在征得保险公司同意后,也可作为独立的险别进行投保。

协会货物(A)、(B)、(C)三种险别的承保风险,主要规定在各该险第一部分承保范围中所列的风险条款(Risks Clause)、共同海损条款(General Average Clause)和船舶互有过失碰撞责任条款(Both to Blame Collision Clause)之中。

三种险别的区别,主要反映在风险条款中。

险条款ICC(A)险的承保责任范围较广,不便把全部承保的风险一一列出,因此对承保风险的规定采用"一切风险减除外责任"的方式,即除了在除外责任项下所列风险所致损失不予负责外,其他风险所致损失均予负责。

伦敦保险协会运输货物保险(B)条款(备案编号:国寿产险(备案)[2008]40号)承保风险(风险条款)1.本保险承保,除下列第4、5、6和7条规定者外的:1.1 保险标的的损失或损害,若可合理归因于:1.1.1 火灾或爆炸;1.1.2 船舶或驳船搁浅、擦浅、沉没或倾覆;1.1.3 陆上运输工具翻倒或出轨;1.1.4 船舶、驳船或运输工具与水以外的任何外部物体碰撞或接触;1.1.5 在避难港卸货;1.1.6 地震、火山爆发或闪电。

1.2 由于下列原因引起的保险标的损失或损害:1.2.1 共同海损牺牲;1.2.2 抛弃或浪击落水;1.2.3 海水、湖水或河水进入船舶、驳船、船舱、运输工具、集装箱、托盘或储存处所。

1.3 装上或卸离船舶或驳船过程中掉落或从船上落入水中或坠落而发生的整件货物的全损。

(共同海损条款)2.本保险承保根据运输合同、准据法和惯例理算或确定的共同海损和救助费用,其产生是为了避免任何原因造成的损失或与避免任何原因造成的损失有关,但此种原因须不是本保险第4、5、6、7条或其他条文除外的危险。

(“双方有责碰撞”条款)3.本保险扩展赔偿被保险人诸如下文可补偿的损失方面根据运输合同中的“双方有责碰撞”条款的比例责任部分。

在船东根据此条款提出索赔的情况下,被保险人同意通知保险人,保险人有权自负费用为被保险人对此种索赔提出答辩。

除外责任(普通除外条款)4.本保险决不承担:4.1 可归咎于被保险人的蓄意恶行的损失、损害或费用。

4.2 保险标的的通常渗漏、通常重量或体积损失或通常磨损。

4.3 保险标的的包装或准备不足或不当引起的损失、损害或费用(在本款意义上,“包装”应视为包括集装箱或托盘内的积载,但仅适用于此种积载是在本保险责任开始前进行或是由被保险人或其雇员进行之时)。

4.4 保险标的固有缺陷或性质引起的损失、损害或费用。

4.5 迟延直接造成的损失、损害或费用,即使该迟延是由承保风险引起的(但根据上述第2条支付的费用除外)。

ICC(B)条款承保的风险包括火灾、爆炸、船舶或驳船触礁、搁浅、沉没或倾覆、陆上运输工具倾覆或出轨、船舶、驳船或运输工具同水以外的任何外界物体碰撞、在避难港卸货、地震、火山爆发、雷电、恶劣气候、洪水等自然灾害以及共同海损牺牲、抛货、浪击落海等。

ICC(B)条款的除外责任与 ICC(A)条款类似,但在某些方面可能更加严格。

三、ICC(C)条款ICC(C)条款的承保范围是三种险别中最狭窄的。

它同样采用“列明风险”的方式确定承保范围,但所承保的风险种类相对较少。

第四,依照"仓至仓条款",被保险货物遭损的时间和地点是在保险期间之内。

这四个条件须同时具备,缺少其中任何一个,索赔人都不会得到赔偿。

在此案例中是按照FOB价格条件成交的业务,说明是需要买方投保,而在FOB价格条件下,货物执行的是象征性交货,也就是说买方只承当货物越过船舷以后的风险,对于货物从卖方仓库运往船舷期间是不存在保险利益的,卖方与保险公司不存在合同关系,所以保险公司不予赔偿,而买方虽然与保险公司有保险合同,但是却对保险标的没有保险利益所以也得不到赔偿。

货到目的港后适逢码头工人罢工,港口无人作业,货物无法卸载。

11.3 伦敦保险协会海洋运输货物保险条款在国际保险市场上,英国伦敦保险业协会所制定的《协会货物条款》(Institute Cargo Clauses,简称L.C.C.)对世界各国有广泛的影响。

目前,仍有许多国家和地区的保险公司在国际货物运输保险业务中直接采用经英国国会确认的L.C.C.条款,或者在制定本国保险条款时参考采用了L.C.C.条款。

I.C.C条款( 01/01/2009 ):L.C.C.(A)险的承保责任范围较广,不便把全部承保的风险一一列出,因此对承保风险的规定采用“一切风险减除外责任”的方式,即除了在除外责任项下所列风险所致损失不予负责外,其他风险所致损失均予负责I.C.C.(B) 险对承保风险的规定是采用“列明风险”的方式,即把所承保的风险一列举,凡属承保责任范围内的损失,无论分损失,保险人按损失程度均负责赔偿。

C险除外责任与B险完全相同L.C.C.(C) 险的风险责任规定,也采用“列明风险”的方式,可是仅对“重大意外事故”所致损失负责,对非重大意外事故和自然灾害所致损失均不负责。

2009年协会货物条款(A)、(B)、(C)Institute Cargo Clauses (A) (1/1/09) / Institute Cargo Clauses (B) (1/1/09) / Institute Cargo Clauses (C) (1/1/09)在时间上本书的出版(第一版与第二版)也十分适合,因为除了重点介绍有关船舶保险的2003年国际船舶保险条款外,海上货物保险也有了新的条款刚刚在2009年1月1日拟定并在2月份推出。

虽然相比1982年的协会货物条款改变不多,但可以去把几个主要的实质性改变在本书本章中略为介绍。

事实上,更重要的改变是早在1982年的协会货物条款已经有,这已经在本书第一版有所介绍。

这就是从几百年来英国一直援用的劳合社S.G.保单,一下变了去使用1982年的协会货物条款(A)、(B)与(C)。

这一个主要的改变可以说是海上保险的革命,主要的推动是来自联合国1975年的报告对S.G保单与海上保险作出严厉批评与其他一连串的建议,例如要以联合国的保险条款替代伦敦的保险条款等,所带来。

我国海上货物运输保险附加险条款我国海上运输货物保险附加险所承保的由于外来原因引起的风险种类很多,有的属于国家行政管理和政策措施、战争和罢工等特殊原因所引起的风险,因而附加险的险别也很多。

为了易于区分,并从保险经营中对风险管理的需要出发,我国保险业习惯将附加险分为一般附加险、特别附加险和特殊附加险三类。

(一〕一般附加险一般附加险负责赔偿一般外来原因所致的损失.我国海运货物保险规定的一般附加险有11种。

由于一般附加险已包括在一切险中,所以若已投保一切险,则无需加保。

1.货物海上运输的短量险承保被保险货物在运输过程中数量短少和重量短缺的损失。

如果是包装货物,必须有外包装发生异常的现象,如以外包装是否破裂、破口、扯缝、脱线等为依据来进行判断。

但本险别并非对任何原因所致的提货不着均予负责,例如货物在中途被作为危险品扣押,被保险人并不能据此险别获得赔偿。

对于散装货物,则往往以装船重量和卸船重量的差额作为损失的依据,至于运输途中的正常损耗,并不属于短量险的责任范围,必须事先扣除,因此双方往往在保险单中约定一个免赔额,保险人仅赔付超过免赔额部分的损失。

2.偷窃、提货不着险这一险别主要承保在保险有效期限内,被保险货物被偷走或窃取以及货物抵达目的地后整件未交的损失。

偷窃是指暗中进行的偷摸、窃取的行为,不包括使用暴力手段的公开劫夺。

提货不着是指货物的全部或整件未能在目的地交付给收货人。

3.混杂、沾污险本险别承保两类损失:(1)被保险货物在运输工程中,因混进杂质而致的损失。

例如,矿砂、矿石等混进了泥土、草屑等而使其质量受到影响;又如装过矿砂的千货舱没有清扫千净,以致另一航程运送黄豆时导致砂石混进豆中,造成黄豆杂质过多而只能降价出售,或为清除杂质必须支付一笔费用,保险人对此贬值损失或清理费用予以负责。

4.货物损坏的淡水雨淋险这一险别承保被保险货物运输途中直接由于淡水、雨淋、冰雪融化所造成的损失。

淡水包括船上淡水仓、水管漏水和舱汗等。

4.协会货物战争险条款
4.1承保范围(Risks Covered) 战争、内战、革命、叛乱、颠覆,或由此引起的内 哄,或交战国的或对抗交战国的敌对行为。 上述引起的捕获、扣押、拘留、禁止或扣留及其后 果,或这方面的任何企图造成的损失。 遗弃的水雷、鱼雷、炸弹或遗弃的其他战争武器。 承保风险引起的共同海损牺牲、分摊和救助费用。

Where, as a result of the operation of a risk covered by this insurance the insured transit is terminated at a port or place other than that to whichthe subject-matter is covered under this insurance, the Underwriters will reimburse the Assured for any extra charges properly and reasonably incurred in unloading storing and forwarding the subject-matter to the destination to which it is insured hereunder.This Clause 12, which does not apply to general average or salvage charges, shall be subject to the exclusions contained in Clauses 4, 5, 6 and7 above, and shall not include charges arising from the fault negligence insolvency or financial default of the Assured or their servants.13. No claim for Constructive Total Loss shall be recoverable hereunder unless the subject-matter insured is reasonably abandoned either onaccount of its actual total loss appearing to be unavoidable or because the cost of recovering, reconditioning and forwarding the subject-matter to the destination to which it is insured would exceed its value on arrival.14. 14.1 If any Increased Value insurance is effected by the Assured on the cargo insured herein the agreed value of the cargo shall be deemed tobe increased to the total amount insured under this insurance and all Increased Value insurances covering the loss, and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured.In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under all other insurances.14.2 Where this insurance is on Increased Value the following clause shall apply:The agreed value of the cargo shall be deemed to be equal to the total amount insured under the primary insurance and all IncreasedValue insurances covering the loss and effected on the cargo by the Assured, and liability under this insurance shall be in suchproportion as the sum insured herein bears to such total amount insured.In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under all other insurances. BENEFIT OF INSURANCE15. This insurance shall not inure to the benefit of the carrier or other bailee.MINIMISING LOSSES16. It is the duty of the Assured and their servants and agents in respect of loss recoverable hereunder16.1 to take such measures as may be reasonable for the purpose of averting or minimizing such loss,and16.2 to ensure that all rights against carriers, bailees or other third parties are properly preserved and exercisedand the Underwriters will, in addition to any loss recoverable hereunder, reimburse the Assured for any charges properly and reasonably incurred in pursuance of these duties.17. Measures taken by the Assured or the Underwriters with the object of saving, protecting or recovering the subject-matter insured shall not beconsidered as a waiver or acceptance of abandonment or otherwise prejudice the rights of either party.AVOIDANCE OF DELAY18. It is a condition of this insurance that the Assured shall act with reasonable despatch in all circumstances within their control.LAW AND PRACTICE19. INSTITUTE CARGO CLAUSES (B)、协会货物保险条款(B)承保风险(风险条款)1 本保险承保除下列第4、5、6和7条规定者外的,1.1 保险标的的损失或损害,若可合理归因于1.1.1 火灾或爆炸1.1.2 船舶或驳船搁浅、擦浅、沉没或倾覆1.1.3 陆上运输工具翻倒或出轨1.1.4 船舶、驳船或运输工具与水以外的任何外部物体碰撞或接触1.1.5 在避难港卸货1.1.6 地震、火山爆发或闪电,1.2 由下列原因引起的保险标的损失或损害1.2.1 共同海损牺牲1.2.2 抛弃或浪击落水1.2.3 海水、湖水或河水进入船舶、驳船、船舱、运输工具、集装箱、托盘或储存处所,1.3 装上或卸离船舶或驳船过程中掉落或从船上落入水中或坠落而发生的整件货物的全损。

(共同海损条款)2 本保险承保根据运输合同、准据法和惯例理算或确定的共同海损和救助费用,其产生是为了避免任何原因造成的损失或与避免任何原因造成的损失有关,但此种原因不是本保险第4,5,6,7条或其他条文除外的危险。

(“双方有责碰撞”条款)3 本保险扩展赔偿被保险人诸如下文可补偿的损失方面根据运输合同中的“双方有责碰撞”条款的比例责任部分。

在船东根据此条款提出索赔的情况下,被保险人同意通知保险人,保险人有权自负费用为被保险人对此种索赔提出答辩。

除外责任(普通除外条款)4 本保险决不承保;4.1 可归咎于被保险人的蓄意恶性的损失、损害或费用。

4.2 保险标的的通常渗漏、通常重量或体积损失、或通常磨损4.3 保险标的的包装或准备不足或不当引起的损失、损害或费用(在本款意义上,“包装”应视为包括集装箱或托盘内的积载,但仅适用于此种积载是在本保险责任开始前进行或是由被保险人或其雇员进行之时)4.4 保险标的固有缺陷或性质引起的损失、损害或费用4.5 迟延直接造成的损失、损害或费用,即使该延迟是由承保风险引起的(但根据上述第2条支付的费用除外)4.6 因船舶的所有人、经理人、承租人或经营人的破产或经济困境产生的损失、损害或费用4.7任何人的错误行为对保险标的或其组成部分的善意损害或善意毁坏4.8 因使用原子或核裂变和/或聚变或其类似反应或放射性力量或物质所制造的战争武器产生的损失、损害或费用。

(不适航和不适运除外条款)5 5.1 本保险决不承保损失、损害或费用,如其起因于5.1.1 船舶或驳船不适航5.1.2 船舶、驳船、运输工具、集装箱或托盘对保险标的的安全运输不适合,而且在保险标的装于其上时,被保险人或其雇员对此种不适航或不适运有私谋。

5.2 保险人放弃载运保险标的到目的港的船舶不得违反默示适航或适运保证,除非被保险人或其雇员对此种不适航或不适运有私谋。

(战争除外条款)6 本保险决不承保损失、损害或费用,如其起因于6.1 战争、内战、革命、造反、判乱或由此引起的内乱或交战方之间的敌对行为6.2 捕获、扣押、扣留、拘禁或羁押(海盗除外),和此种行为引起的后果或进行此种行为的企图6.3 被遗弃的水雷、鱼雷、炸弹或其他被遗弃的战争武器。

(罢工除外条款)7 本保险决不承保损失、损害或费用7.1 罢工者、被迫停工工人,或参加工潮、暴动或民变的人员造成者7.2 罢工、停工、工潮、暴动或民变造成者7.3 任何恐怖份子或出于政治动机而行为的人员造成者。

保险期间(运送条款)8 8.1 本保险责任始于货物运离载明的仓库或储存处所开始运送之时,在通常运送过程中连续,终止于:8.1.1 在载明的目的地或之前交付到收货人的或其他最后仓库或储存处所,8.1.2 在载明的目的地或之前交付到任何其他仓库或储存处所,其由被保险人用作8.1.2.1 通常运送过程以外的储存或8.1.2.2 分配或分派8.1.3 或者被保险货物在最后卸货港全部卸离海船满60天,以上各项以先发生者为准。

8.2 如果在最后卸货港卸离海船后,但在本保险终止之前,货物被发送到非本保险承保的目的地,本保险,在依然受前述规定的终止所制约的同时,截止于开始向此种其他目的地运送之时。

8.3 保险人不能控制的迟延、任何绕航、强制卸货、重装或转载期间以及船东或承租人行使根据运输合同赋予的自由权产生的任何航海上的变更期间,本保险继续有效(但须受上述规定的终止和下述第9条规定的制约)。

(运输合同终止条款)9 如果由于被保险人不能控制的情况,运输合同在载明的目的地以外的港口或地点终止,或运送在如同上述第8条规定的交付货物前另行终止,那么本保险也终止,但若立即通知了保险人并在本保险有效时提出继续承保的要求,以受保险人要求的附加保险费的约束为前提,本保险继续有效。

9.1 直至货物在此种港口或地点出售并交付,或者,除非另有特别约定,直至被保险货物到达此种港口或地点满60天,二者以先发生者为准,或者9.2 如果货物在上述60天(或任何约定的延展期间)内被运往载明的目的地或其他目的地,直至根据上述第8条的规定而终止。

(航程改变条款)10 如果在本保险责任开始后,被保险人改变了目的地,就按有待重新商定的保险费率和条件续保,但以立即通知了保险人为前提。

索赔(保险利益条款)11 11.1为了根据本保险取得赔偿,被保险人在损失发生时对保险标的须具保险利益。

11.2 除了上述第1款另有规定外,被保险人有权取得本保险承保期间发生的承保损失的赔偿,尽管该损失产生在本保险合同订立之前,除非当时被保险人知道该损失而保险人不知道。

(续运费用条款)12 由于本保险承保的一种风险发生作用的结果,承保的保险标的运送在根据本保险承保的目的地以外的港口或地方终止,承保人将适当合理偿付被保险人在卸下、储存和发运保险标的至所承保的目的地而适当和合理遭受的额外费用。

不适用于共同海损或救助费用的本条规定,须受上述第4、5、6和7条包含的除外责任的制约,且不包括由被保险人或其雇员的过失、疏忽、破产或经济困境所引起的费用。

(推定全损条款)13 推定全损得不到赔偿,除非因实际全损看来不可避免,或由于把货物恢复、整理和发运保险标的到承保目的地的费用会超过其抵达时的价值,保险标的被合理放弃。

(增加价值条款)14 14.1如果对保险货物由被保险人办理了增加价值保险,货物保险价值就应视为增加至承保损失的本保险和所有增加价值保险的保险金额的总和,本保险的责任按照本保险的保险金额占此保险金额的总和的比例计算。

索赔时被保险人须向保险人提供所有其他保险的保险金额的证据。

14.2 如果本保险是增加价值保险,应适用下述条款:货物的保险价值应视为等于由被保险人对货物办理的承保损失的原始保险和所有增加价值保险的保险金额的总和的比例计算。

索赔时被保险人须向保险人提供所有其他保险的保险金额的证据。

保险受益(不适用条款)15 本保险不使承运人或其他保管人受益。

尽量减少损失(被保险人的义务条款)16 对可取得赔偿的损失,被保险人及其雇员和代理人有义务16.1 采取为避免或尽量减少此种损失可能是合理的措施,并16.2 保证对承运人、保管人或其他第三方追偿的所有权利被适当保护和行使而保险人负责在可取得赔偿的损失之外补偿被保险人履行这些义务而适当合理地招致的任何费用。

(弃权条款)17 被保险人和保险人采取的旨在拯救、保护或恢复保险标的的措施不得视为放弃或接受委付或在其他方面损害任何一方的权利。

避免迟延(合理速办条款)18 本保险的条件之一是被保险人在所有其力所能及的情况下合理迅速地行动。

法律和惯例INSTITUTE CARGO CLAUSES (B)(Risks Claus)RISKS COVERED1. This insurance covers, except as provided in Clauses 4, 5, 6 and 7 below,1.1 loss of or damage to the subject matter insured reasonable attributable to 1.1.1 fire or explosion1.1.2 vessel or craft being stranded grounded sunk or capsized1.1.3 overturning or derailment of land conveyance1.1.4 collision or contact of vessel craft or conveyance with any external object other than water1.1.5 discharge of cargo at a port of distress1.2 loss of or damage to the subject-matter insured caused by1.2.1 general average sacrifice1.2.2 jettison or washing overboard1.2.3 entry of sea lake or river water into vessel craft hold conveyance containerliftvan or place of storage1.3 total loss of any package lost overboard or dropped whilst loading on to, or unloading from, vessel or craft.(General Average Clause)2. This insurance covers general average and salvage charges, adjusted or determined according to the contract of affreightment and/or the governing law and practice, incurred to avoid or in connection with the avoidance of loss from any cause except those excluded in Clauses 4, 5, 6 and 7 or elsewhere in this insurance.(“Both to Blame Collision” Clause)3. This insurance is extended to indemnify the Assured against such proportion of liability under the contract of affreightment “Both to Blame Collision” Clause as is in respect of a loss recoverable hereunder. In the event of any claim by shipowners under the said Clause the Assured agree to notify the Underwriters who shall have the right, at their own cost expense, to defend the Assured against such claim.(General Exclusions Clause)EXCLUSIONS4. In no case shall this insurance cover4.1 loss damage or expense attributable to wilful misconduct of the Assured4.2 ordinary leakage, ordinary loss in weight or volume, or ordinary wear and tear of the subject-matter insured4.3 loss damage or expense caused by insufficiency or unsuitability of packing or preparation of the subject-matter insured (for the purpose of this Clause 4.3 “packing” shall be deemed to include stowage in a container or liftvan but onlywhen such stowage is carried out prior to attachment of this insurance or by the Assured or their servants)4.4 loss damage or expense caused by inherent vice or nature of thesubject-matter insured4.5 loss damage or expense proximately caused by delay, even though the delay be caused by a risk insured against (except expenses payable under Clause 2 above)4.6 loss damage or expense arising from insolvency or financial default of the owners managers charterers or operators of the vessel4.7 deliberate damage to or deliberate destruction of the subject-matter insured or any part thereof by the wrongful act of any person or persons4.8 loss damage or expense arising from the use of any weapon of war employing atomic or nuclear fission and/or other like reaction or radioactive force or matter. (Unseaworthiness and Unfitness Exclusion Clause)5 5.1 In no case shall this insurance cover loss damage or expense arising from unseaworthiness of vessel or craft.unfitness of vessel craft conveyance container or liftvan for the safe carriage of the subject-matter insured.where the Assured or their servants are privy to such unseaworthiness or unfitness, at the time the subject-matter insured is loaded therein.5.2 The Underwriters waive any breach of the implied warranties of seaworthiness of the ship and fitness of the ship to carry the subject-matter insured to destination, unless the Assured or their servants are privy to such unseaworthiness or unfitness.(War Exclusion Clause)6 In no case shall this insurance cover loss damage or expense caused by6.1 war civil war revolution rebellion insurrection, or civil strife arising therefrom, or any hostile act by or against a belligerent power6.2 capture seizure arrest restraint or detainment (piracy excepted), and the consequences thereof or any attempt thereat.6.3 derelict mines torpedoes bombs or other derelict weapons of war.(Strikes Exclusion Clause)7 In no case shall this insurance cover loss damage or expense7.1 caused by strikers, locked-out workmen, or persons taking part in labour disturbances, riots or civil commotions7.2 resulting from strikes, lock-outs, labour disturbances, riots or civil commotions 7.3 caused by any terrorist or any person acting from a political motive. (Transit Clause)DURATION8 8.1 This insurance attaches from the time the goods leave the warehouse or place of storage at the place named herein for the commencement of the transit, continues during the ordinary course of transit and terminates either8.1.1 on delivery to the Consignees’ or other final warehouse or place of storage at the destination named herein8.1.2 on delivery to any other warehouse or place of storage, whether prior to or at the destination named herein, which the Assured elect to use either8.1.2.1 for storage other than in the ordinary course of transit or8.1.2.2 for allocation or distribution.or8.1.3 on the expiry of 60 days after completion of discharge over side of the goodshereby insured from the oversea vessel at the final port of discharge. Whichever shall first occur.8.2 If, after discharge over side from the oversea vessel at the final port of discharge, but prior to termination of this insurance, the goods are to be forwarded to destination other than that to which they are insured hereunder, this insurance, whilst remaining subject to termination as provided for above, shall not extend beyond the commencement of transit to such other destination.8.3 This insurance shall remain in force (subject to termination as provided for above and to the provisions of Clause 9 below) during delay beyond the control of the Assured, any deviation, force discharge, reshipment of transshipment and during any variation of the adventure arising from the exercise of a liberty granted to ship owners or charterers under the contract of affreightment.(Termination of Contract of Carriage Clause)9 If owing to circumstances beyond the control of the Assured either the contract of carriage is terminated at a port or place other than the destination named therein or the transit is otherwise terminated before delivery of the goods as provided for in Clause 8 above, then this insurance shall also terminate unless prompt notice is given to the Underwriters and continuation of cover is requested when the insurance shall remain in force, subject to an additional premium if required by the Underwriters, either9.1 until the goods are sold and delivered at such port or place, or, unless otherwise specially agreed, until the expiry of 60 days after arrival of the goods hereby insured at such port or place, whichever shall first occur,or9.2 If the goods are forwarded within the said period of 60 days (or any agreedextension thereof) to the destination named herein or to any other destination, until terminated in accordance with provisions of Clause 8 above.(Change of Voyage Clause)10 Where, after attachment of this insurance, the destination is changed by the Assured, held covered at a premium and on conditions to be arranged subject to prompt notice being to the Underwriters.(Insurable Interest Clause)CLAIMS11 11.1 In order to recover under this insurance the Assured must have an insurable interest in the subject-matter insured at the time of the loss.11.2 Subject to 11.1 above, the Assured shall be entitled to recover for insured loss occurring during the period cover by this insurance, notwithstanding that the loss occurred before the contract of insurance was concluded, unless the Assured were aware of the loss and the Underwriters were not.(Forwarding Charge Clause)12 Where, as a result of the operation of a risk covered by this insurance, the insured transit is terminated at a port or place other than that to which the subject-matter is covered under this insurance, the Underwriters will reimburse the Assured for any extra charges properly and reasonably incurred in unloading storing and forwarding the subject-matter to the destination to which it is insured
