论民法对人身权的保护

—以隐私权与知情权为对象的分析

摘 要

隐私权与知情权是公民重要的权利内容，但是，隐私权与知情权在实现的过程中，可

能存在冲突，导致隐私权的实现侵犯他人知情权，而知情权的实现侵犯他人隐私权的问题。

本文研究针对隐私权与知情权的冲突展开论述，在介绍两者的法律内涵与法律价值后。从

知政权与官员隐私权、公众知情权与公众人物隐私权、个人信息知情权与普通公民隐私权

的冲突着手，对两者的冲突进行分析。最后，从明确隐私权与知情权的界限，加强对隐私

权与知情权各自的法律保护，并妥善处理官员、公众人物隐私权与公民知情权关系，妥善

处理个人信息知情权与普通公民隐私权关系等角度，制定协调隐私权与知情权冲突的对策。

Abstract

Privacy and the right to information is an important content of rights of citizens, but the

privacy and the right to know in the course of implementation, there may be a conflict, leading to

the realization of infringement of the right to information privacy, and the realization of the right

to information privacy infringement issues . For this study conflict with the right of privacy to

start discussion, both in the legal connotation introduced after the legal value. Government and

officials of privacy, the public's right to know and the privacy of public figures, and ordinary

citizens the right to know personal information privacy conflict proceed from knowledge of both

conflict analysis. Finally, from the clear boundaries of privacy and the right to information, to

strengthen the legal protection of individual privacy and the right to know, and properly handle

the officials, public figures and citizens' right to know the relationship between privacy, the right

to know the proper handling of personal information and the privacy of ordinary citizens

relations point of view, privacy and the right to develop coordinated strategies of conflict.
