《当代法律英语》翻译第四章公法在所有的民法法系(civil law)中所做的基础分辨便是公法（public law)与私法(private law)的区分。
这种分类方法，对于普通法系(common law)而言仅仅是潜在的或者默示性质的，但对于民法法系而言却是一种基础性的理解方式。
一方面，正如我们所了解的一样，这种分类为民法法系国家提供了法庭组织系统的分辨模板。
随着公法领域的争端于19世纪可受法院裁判(justiciable)开始，独立的特别法庭(tribunal)被建立起来并约束起公法行为。
在今天，除了刑事案件(criminal matters)这一主要例外，普通法院的管辖权(jurisdiction)依旧限于私法领域的争端。
除了这些司法管辖权的推论以外，公法和私法的分别还产生了一种存在于法律专业中的工作(labor)性质的差别。
大量的法学教师倾向于证明他们是“公法专家”(publicist)或者是“私法专家”(privatist)。
课程和论文(treatise)倾向于公法或私法的其中一个领域，尽管事实上如今已经考虑到的案由(subject matter)至少更倾向于许多公法方面。
即使在民法法系世界中公法与私法的分别被广泛承认，但这类法系的法学家(lawyer)对其法系划分的理论基础或者法理正当性仍未达成一致，各国对于这种划分方法的范围和效果也未达成一致。
然而，一般来说，公法所关注的是国家机关之间的关系或者国家与公民之间的关系。
公法至少包括宪法(constitutional law)，行政法(administrative law)和刑法(criminal law)。
而私法是处理公民或私人团体之间的关系，它至少包括民法(civil law)和商法(commercial law)。
这种分类方法的其他几个领域是争论的主题所在。
举个例子，民法程序是包含于一些主体的私人组织的些许法系之中，并且被其他主体认为包含于公法领域。
劳动法(labor law)，农业法(agricultural law)，社会保障(social security)，同时也包括大量的现代规则领域，这些法律有些时候被解释为公法与私法领域的混合，有时又被说成自成一类(拉丁文：sui generis)。
即使公法与私法的划分已经扎根于罗马法系(Roman law)中，然而直到当代与公法相关的领域仍有一种未开发的因素。
这便是对于主权(sovereign)的保护，法理学家(jurist)总是谨慎的将其放在一边。
正如我们注意到的对于民法法系传统的历史介绍，几乎所有流传下来并被我们所掌握的罗马法律文献都是关注于私法领域，并且大陆法系(continental legal)科学的传统也是关注于私法领域。
我们观察到的也是如此：在地方主义(localism)和法律多样化的中世纪，公法的研究余地是很小的。
但是当集权化(centralize)的国家以及它的行政机构(administrative organ)开始出现于欧洲大陆的时候（与逐步产生影响的法律训练专业化吻合），这对行政法的发展产生了有利的条件。
在19世纪，由于行政法开始繁荣昌盛，似乎一般的适用于私人个体或者组织的私法规则并不能简单的维持各主体之间的关系，这是因为国家已被政党所垄断。
在法国它似乎也是这样的，普通法院(ordinary court)不能被委托(entrust)从事牵扯到解决国家争端的任务。
正如我们已经了解到的一样：法国对权利分立学说(separation of powers led)的理解，导致其在行政机构中建立起了一系列独立的公法法院。
在德国就是另外一回事了，该国关心被行政权力压迫的普遍性胜过对于司法裁判的不信任。
因此，为了避免当公民与行政机构发生争端时是由后者裁决(adjudicate)，德国建立了存在于司法机构中并独立于行政法院的裁判体系。
如今，法国国家委员会已经建立并独立于行政机关，已完全先进的保护个人权利并且拓展了该委员会控制行政程序的力度，然而事实上这并不是减少法院重要性的技术性问题。
在当代的民法法系国家中，对行政行为合法性(legality)审查效力的增加正在变成一种趋势。
如今，当有人谈论民法法系的公法时，一般而言大致讨论的是行政法。
正如与宪法相关的形式，国家的结构以及机构，这些因素仍旧被认为相类似于政治学。
正如我们认识到的一样，只是在相对较近的时代，法院及其他机构才获得了对政府行为合宪性进行审查的权利。
正如刑法，虽然在技术上被归类到公法领域，但传统上依旧被“私法学家”所关注，并且在世界各地都由普通法院享有管辖权。
因此，在民法法系国家中大量的公法依旧由行政法组成。
即使是用一个单一的国家进行研究，依旧很难精确的详述行政法概念中究竟包括什么。
一般来说，行政法由一系列调整除了政治和司法机构(judicial authority)以外的公共机构(public authority)的组织，职能和相互关系的规范，以及规范行政机构与公民之间关系的规则组成。
税法(Tax law)已经变成了行政法领域中的一个主要特色。
行政法并不是完全的与行政法院的裁判权所吻合，这是因为在所有的民法法系国家中，特定的行政法案由是由普通法院依据特别法(special legislation)享有管辖权的。
也许正如我们期许的一样，公法和私法经常在面对类似法律问题时采用类似的解决办法。
尽管如此，当学生比较此二者关系时必须意识到这样一种可能性：关于私法与公法分类的争论将演绎一种相当不同的实质性规则，亦或者产生一种不同的解释法。
举例如下：法国在第一次世界大战以后遇到也严重的通货膨胀，私法法院拒绝对因通货膨胀而变得一文不值的固定金额合同的债权人(creditor)给予救济，而最高法院则发展了“不可预见性原则(doctrine)”来救济依据公法管辖的合同的债权人(obligee)。
行政法便是这样被形容的：基于其频繁变化的可影响性而独立于私法，基于行政法所允许的宽广范围的官方判断力(discretion)以及该法所留下的对于政党辨别力的狭小空间，还包括变动的和日渐模糊的法律概念。
然而，我们应该注意到的是：私法的一般原则经常持续的作为行政法的补充或者填补行政法的空白。
第五章私法正如“公法”这个词一般被用来定义行政法一样，“私法”也经常与民法交替使用。
然而，在民法法系中，有两个种类的区别包含于私法之中：即民法与商法。
在原则上，民法适用于每个人，其基本的规定（provision）均见于民法典中，并由辅助性（auxiliary）的条款加以补充。
而商法关注的是特定群体的人或者特定种类的活动，并且在大多数民法系国家的法统中包含独立的商法。
意大利与瑞士是没有商法典的，然而商法仍然被认为并在教学中视为一门独立的私法学科。
除商法以外，仍有大量的其他领域的法律通常被归类独立于民法，但这些法律却又包含于私法领域，如版权或艺术财产（literary and artistic property），海商法（maritime law），保险（insurance）以及工业产权（industrial property）。
劳动法的发展源于个人雇佣合同的民法中。
然而，当今对私法有各种各样的独特的分类方法;这种方法是公法与私法的混合；这种方法可以说是相对于其自身的一种分类，既不属于公法也不属于私法。
A.民法在传统上，民法【民事权利（droit civil）Burgerliches Recht or Zivilrecht】是基于如下的主题被安排为论文或者作为教学目的的：人法（the law of person）;家庭法（family law）；婚姻财产法（marital property law）；财产法（property law）；继承法（succession law）以及债法（the law of obligations）。
这种分类并不是穷尽的，这并不是基于各个国家的民法典且精确的与法典的主题分布相一致的。
举个例子，瑞士拥有独立的债法典，而在法国，婚姻法包含于人法之中。
人法由所有关于作为法律主体的个人和法律实体的低位的规范组成。
它包含一系列与类似于姓名，居住地（domicile），民事地位（civil status）以及保护法律上无民事行为能力（persons under legal incapacities）的各种人等主体相关的法律规则。
大多数的法律实体长久的隶属于行政法，商法以及劳动法的特殊规则，因为如今仅仅有很少一部分组织脱离于民法典的范围之中。
婚姻法包括婚姻的成立（marriage formation），婚姻的法律效力（the legal effect of marriage），由于离婚（divorce），分居（separate），宣告婚姻无效（annulment of marriage）而导致的婚姻终止（marriage termination）；私生子父亲的确认（filiation）；以及家庭成员的抚养义务（family support obligation）在这里领域的第一方面依旧相当的稳定，民法法系采取了来源于法国的要求合法婚姻的成立必须进行一个世俗仪式。
在婚姻法的其他所有领域所发生的三个主要趋势影响了法典修改的扩大化：离婚基点的自由化；在家庭决策和财产权方面男女低位的平等化，费婚生子女与婚生子女低位平等。
与婚姻法，财产法和继承法密切相关的婚姻财产法，在传统上被视为民法的一个独立领域。
民法典建立并且管理着“婚姻财产制度”，这一体系管理着未选择可变更婚姻合同的所有配偶。
这种法律机制是共同财产制（community property）的一种典型形式，通常来说，婚前财产（pre-marital property）以及若能证明是通过赠与或者继承获得的财产依旧归各自所有。
现代的趋势是更倾向于“延缓共同财产制（defer community）”，在这种制度下，无论是否是在婚姻存续期间各自获得的财产，各配偶的财产均被认为是其独立财产，但是在婚姻结束或者一方四方时，婚姻存续期间所获得的财产将会平等的一分为二。
另外建立起来的法律制度是基于特别创建和管理一系列可被选择的变更制度并包含于民法典中的婚姻财产制度，犹如制作或变成婚姻合同的程序。
民法法系的财产法承认动产（movable）和不动产（immovable）的划分，这大致相当于普通话系中关于动产（personal）和不动产（real property）的划分。
同普通法系国家一样，土地比动产（chattel）的重要性要大的多，尤其一些相对较旧的法典完全反映了国家的实事。
在自由资本主义时期，所有权（right of ownership）被认为是绝对的，保护私有财产被看成是国家的一项重要职能。
