(二) 依发盘条件是否确定分
(1) 实盘(Firm offer):指发盘人明确指出了特 定的被要约人、货物内容、数量、价格、有效期限 及相关交易条件,并毫无保留的表示愿意按发盘的 各项条件订立合同。实盘在法律上是典型的“要 约”,只要被发盘人(被要约人) 表示接受,合同 即告成立,发盘人(要约人) 自当受该发盘条件的 约束。 (2) 虚盘(Non-firm offer):指不含确定意思的 发盘,即使被发盘人接受发盘,也不构成合同成立。 非稳固发盘在法律上并非“要约”,只是“要约的 邀请”,因此不能约束发盘人。

一、询盘的意义 进口商收到出口商希望建立业务关系的信函后,如觉得可 以接受,即可向出口商询问购 买该货物的种种条件,称为询盘(Inquiry、Enquiry或Trade Inquiry),也称为询价,实际上就是“要求发盘” (Request for offer)。询盘可以由买方发出,也可以由卖 方发出。

二、询盘的种类
(一) 买方询盘 是买方主动发出的向国外厂商询购所需货物的函电。在实际业 务中,询盘一般多由买方向卖方发出。买方询盘过程中应注意 的问题是: (1) 同时向不同地区、国家的厂商分别询盘; (2) 要询问价格,详细规格、数量等; (3) 避免丧失信誉。 (4) 提出较多品种,要求对方一一报价。 (二) 卖方询盘 是卖方向买方发出的征询其购买意见的函电。卖方对国外客户 发出询盘大多是在市场处于动荡变化及供求关系反常的情况下, 为探听市场虚实、选择成交时机,主动地寻找有利的交易条件。

二、发盘的种类
