摘要

食品是人民用来维持生命的物质，是人们赖以生存的物质，但是食品安全问题频频的被曝光，引起了人们的惊慌影响了社会秩序的稳定。食品安全犯罪的危害是非常的巨大的，不法分子通过制造伪劣的食品在市场上进行销售来获取暴利，这样严重的影响了我国的食品市场经济的秩序，通过这些食品在市场上进行销售严重的影响了我国人民的身体健康以及生命安全，给我国的经济造成了巨大的损失，食品安全问题被曝光会影响我国人民的人心，造成全国人民的恐慌，严重的阻碍了我国社会和谐社会的发展的进程。其次，通过我国制定相关的刑法，能够更好的打击食品安全犯罪的行为，刑法具有强制性以及严厉性，刑法对于犯罪者的惩罚的力度是非常的大的，不仅仅是对违法者进行相关的罚款以及停业等处罚，还对于食品安全犯法者根据食品安全的问题的大小剥夺政治权利甚至是生命权利进行剥夺，只有这样能够有效的保证食品安全，只有这样才能够更好的打击食品安全违法者，做到有法可依，严格的对于食品安全违法者进行严厉的处理，更好的保证人民的身体健康以及生命的安全。针对于此对于本文的研究是非常有一定的现实的意义的，希望本文的研究的结果能够对于刑法对于食品安全的保护有一定的借鉴的作用。

Abstract

Food is the material that people use to maintain life, and it is the material that people rely on for survival. However, the frequent exposure of food safety problems has caused people's panic and affected the stability of social order. The dangers of food safety crime is very huge, criminals by shoddy food for sale in the market to obtain huge profits, such a serious affected the food order of market economy in our country, through these food for sale in the market seriously affected the people's life safety and health in our country, caused a great loss to our country's economy, food safety problems are exposed affects the hearts of our people, lead to the national people's panic, seriously hindered the development of the harmonious society in our country. Second, through the related criminal law in our country, to better impact food safety crime, the criminal law are mandatory and severity, the criminal law for the perpetrators of the magnitude of the punishment is very big, is not only the offender related fines and penalties such as closed also for food safety offenders deprived of political rights according to the size of the food safety problem and even deprived of right to life, only in this way can effectively guarantee the food safety, only in this way can better against food safety violators, legal, strict harsh treatment for food safety violators, Better guarantee people's health and life safety. In view of this, it is of practical significance to the study of this paper. It is hoped that the results of this study can provide some reference for the protection of food safety by criminal law.
