Statement of Claim
1. Summary of Claim
Request for Extension of Time and Reimbursement of Additional Costs pursuant to Clause 12.2 in respect of encountering unforeseeable underground obstructions whilst Pipe Jacking DN3000 pipes between Shafts S17-S18

2. Introduction
DN3000 Pipe Jacking Shafts S17 to S18 has a total span of 189.4m and is included in Section 1 Part C of the works.
The break-out of the boring machine started on 24 March 2006, and first pipe was jacked on 28th March 2006.
Pipe jacking between Shafts S17 to S18 was a critical activity and lies on the Critical Path.
During pipe-jacking, the electrical current of the reduction gear in the boring machine increased suddenly, this situation made it hard for the screw conveyor to convey soil. Several days later, five steel bars was conveyed out (for details, please see the picture). Because the screw conveyer had been working at excess load for several days, the bearing in reduction gear of the screw conveyer broke down on 11 May 2006, a new one was replaced, but it broke down again on 22 May 2006, replaced with a new one once more, finally, it worked normally. The boring machine finally broke into to the shaft 18 on 28 May 2006.
Because of the underground obstruction, the progress of pipe jacking slowed down obviously from 11 May 2006 to 27 May 2006.
The Daily Dairy and Daily Pipe Jacking Record were contemporarily recorded for your reference to make such a conclusion that the underground obstruction definitely had given rise to the delay of the period of this span of pipe jacking.
3. Contract Provisions
Clause 12.2 of the General Conditions of Contract provides the Contractor relief in the event of not foreseeable physical obstructions or conditions being met, namely:-
“If…during the execution of the Works the Contractor encounters…physical conditions…which…conditions were, in his opinion, not foreseeable b y an experienced contractor, the Contractor shall forthwith give notice thereof to the Engineer, with a copy to the Employer.
