随着农村经济体制改革的深入开展，农村联产承包责任制已普遍推行，农村承包合同纠纷大量发生。

为了解决各地人民法院在审理农
村承包合同纠纷案件中遇到的一些问题，现根据有关政策和法律、法规，结合各地人民法院的审判实践经验，提出意见如下：
农村承包合同纠纷案件的受理问题
处理农村承包合同纠纷，应当发挥有关农村基层组织以及承包合同管理部门的作用，绝大多数纠纷可以由它们调处。

当事人不服处理向人民法院起诉的，人民法院应当依法受理;当事人直接向人民法院起诉的，人民法院也应当依法受理。

有些农村承包合同的履行因受自然条件的制约，季节性很强。

因此，人民法院对此类合同纠纷要及时立案，尽快审理，必要时可裁定先行恢复生产，然后解决纠纷。

无效农村承包合同的确认和财产处理问题
审理农村承包合同纠纷案件，首先要审查合同是否有效，具有下列情况之一的应确认合同无效：
属于违反国家法律、政策的;损害国家利益和社会公共利益的;违背民主议定原则的;采取欺诈、胁迫或其他不正当手段签订的;发包人无权发包的;承包人私自转让、转包承包合同以及转包渔利的。

承包合同被确认无效后，对产生的财产问题应当依照法律、政策合理解决。

有过错的一方应当赔偿对方因此而遭受的经济损失;如果双方都有过错，各自承担相应的责任。

农村承包合同的转让与转包问题
转让是指承包人自找对象，由第三者代替自己向发包人履行承包合同的行为。

转让的合同内容虽无改变，但是变更了承包人，终结了原承包人与发包人的权利义务关系，确立了受让人与发包人的权利义务关系。

转包是指承包人把自己承包项目的部分或全部，以一定的条件发包给第三者，由第二份合同的承包人向第一份合同的承包人履行，再由第一份合同的承包人向原发包人履行合同的行为。

承包人将承包合同转让或转包给第三者，必须经发包人同意，并不得擅自改变原承包合同的生产经营等内容，否则转让或转包合同无效。

承包人在履行承包合同中有安排劳务的经营自主权，某些临时性的劳务，如季节性的农活，果子的摘收、销售等，可以不经发包人同意包给他人。

承包人承包后自己既不从事经营或生产活动，又不承担任何风险，坐收管理费或者高价转包的，属于转包渔利。

如果转包的价额超出承包价额，而其超出部分大致接近于承包人的投资加上由于投资应当获得的正常利润，可以视为合理;如果悬殊过大，则应作为转包渔利论处。

转包渔利部分应当收归集体或追缴国库。

承包合同的变更和解除问题
出现下列情况之一的，应当允许变更或者解除承包合同：
当事人双方协商同意，并且不损害国家、集体利益的;订立承包合同依据的计划变更或者取消的;因国家税收、价格等政策的调整，致使收益情况发生较大变化的;由于自然灾害等不可抗力的原因，致使承包合同无法履行的;因发包方或承包方不履行承包合同规定的义务，致使承包合同无法继续履行或者没有必要继续履行的;承包人丧失承包能力的;承包人进行破坏性、掠夺性生产经营经发包人劝阻无效的。

因变更或解除合同使对方遭受损失的，应当负责赔偿，但依法可以免除责任的除外。

因自然灾害而产生的责任免除问题
由于自然灾害等不可抗力的外因，致使合同不能履行或者不能完全履行的，可以全部或者部分免除承包人的责任。

审理涉及这类问题的案件，必须查明自然灾害所造成的损害程度和承包人对自然灾害的抗御情况，然后决定对承包人的责任是部分还是全部免除。

如果承包人已经尽了自己应尽的责任，仍不能避免标的物遭受损失，可以全部免除承包人的责任;如果既有自然灾害的影响，又有承包人经营不善的原因，则应按两个因素所占的比例，酌情免除承包人的部分责任。

发包方单方任意毁约问题
有些农村承包合同纠纷是因为发包方任意毁约或有关行政部门违法干预造成毁约而引起的。

审理这类案件，应当依法维护原合同的效力。

承包人要求继续履行合同的，应予支持。

发包方毁约给承包人造成的经济损失，应当予以赔偿。

因行政部门违法干预而毁约的应由行政部门承担违约责任，给承包人造成的经济损失，应当先由发包方赔偿，再由应负责任的行政部门负责处理。

发包方无力赔偿的，如果承包合同尚未到期，可以按赔偿数额抵除承包人应缴交的承包金额;如果承包合同已经到期，可适当延长承包期，并在承包期内按赔偿数额抵除承包人应缴交的承包金额，或者延期给付赔偿金。

承包指标过高或过低问题
审理因承包指标过高或过低而发生的纠纷案件，应对承包指标的高低作具体分析，主要审查指标是否符合客观实际。

承包指标一般可根据承包前三至五年平均产量并考虑合理增产比例予以确定。

目前，农村承包合同中的承包指标一般都以投标方式确定。

有的承包人为了取得承包权，违背客观实际，盲目地提高承包指标，导致指标明显过高而无法履行。

对于因此而发生的承包合同纠纷，应当通过调解，引导双方当事人协商，实事求是地确定合理指标。

但对指标基本合理，主要由于承包人本身不努力而完成不成指标的，应当维持原合同的承包指标。

对于发包人因缺乏经验，导致指示明显过低而发生的承包合同纠纷，应当通过调解，引导双方当事人协商，确定合理的承包指标。

如果承包指标基本合理，承包人通过积极努力和科学管理取得较好的经济效益，发包人为此要求提高指标的，则不予支持，而应维持原合同的承包指标。

对于承包指标的调整，双方当事人协商不成的，由法院依法判决。

承包人搞破坏性京夺性生产问题
承包人在承包期间进行生产经营活动，应当注意对自然资源的保护，例如：
承包土地不得破坏地力;承包山林不得乱砍乱伐;承包矿业生产不得乱开乱采;承包果园不得为短期收益而破坏果树的长期生长。

承包人在承包期间搞破坏性、掠夺性生产经营，发包人劝阻无效要求解除合同的，应予支持，因此而造成的损失应当由承包人负责赔偿，情节严重的可责令加倍赔偿，直至依法追究刑事责任。

农村的乡镇企业承包中对外发生债务的承担问题
承包人对于企业在其承包前的债务，如果在承包合同中规定由其承担的，应按合同规定承担;如果承包合同中未作规定的，应由发包人
承担，亦可酌情由承包人先予偿付，然后从应向发包人缴纳的承包金中扣除。

承包人对于企业在其承包期内所欠的债务，应当承担清偿责任，发包人应负连带责任。

承包人逃匿或无力清偿债务的，由发包人负责清偿。

合伙承包人的诉讼地位问题
合伙承包人在诉讼过程中，应作为共同诉讼人对待。

合伙人众多的，可由他们选派代表参加诉讼。

执行问题
