融资租赁是一种新兴的租赁形式,自本世纪50年代首先在美国出现至今,已有40多年的发展历史。
80年代初,融资租赁在我国的经济生活中开始出现。
1981年,我国成立了第一批专业租赁公司,如中国东方租赁有限公司和中国租赁有限公司。
迄今为止,我国相继成立了近500家专营和兼营融资租赁的企业和机构,为我国航空,轻工、机械制造、电子和邮电等行业近7000个技术项目引进设备和技术共计150亿美元,成为我国利用外资、对国有大中型企业进行技术改造的一条重要渠道。
融资租赁是一种贸易与信贷相结合,融资与融物为一体的综合性交易。
鉴于其复杂的法律关系,不同国家和地区对融资租赁有着不同的理解和定义。
一般来说,融资租赁要有三方当事人(出租人、承租人和出卖人)参与,通常由两个合同(融资租赁合同、买卖合同)或者两个以上合同构成,其内容是融资,表现形式是融物。
我国立法者在借鉴《国际融资租赁公约》和其他国家对融资租赁的定义的基础上,结合我国融资租赁界对融资租赁比较一致的看法后,对融资租赁作出规定。
典型的融资租赁合同具有以下三方面的含义:第一,出租人须根据承租人对出卖人和租赁物的选择出资购买租赁物。

In case of the basic facilities an d structure of the premises being damaged( not including furniture an d appliances damagedby Party B),Party A shall repair o r respond to Party B's complaints within 24 hours ,an d bear all costs relatedthereto.4.4 甲方在此声明及保证甲方为出租房屋的合法拥有人并有合法地位出租此房屋给乙方。
