摘要

死刑是以剥夺犯罪分子生命为代价的刑事处罚措施，也是刑罚体系中最为严厉的惩戒措施，具有极高的法律威慑力。我国立法机构和司法界对于死刑制度的存废问题争论已久，在前不久颁布的《刑法》修正案中也对我国死刑制度的适用进行了重新规定，由于死刑本身具有不可挽回以及重大震慑的作用，历代统治者都非常重视对死刑的使用。死刑制度的存废问题与死刑制度的改革方向一直是中国理论与立法界争议的热点问题之一。这些争议促进了死刑司法实践的发展，促使人们对死刑制度的适用进行了理性思考，进而推动死刑制度的改革，从长远来看，其对促进我国建设法治社会具有重要意义。笔者认为根据目前我国政治、经济等基本国情，应当保留死刑的使用，并坚决贯彻“少杀慎杀”的政策。本文通过对死刑的概念、价值分析，死刑制度存与废的比较和我国对待死刑制度的态度，来阐述我国现阶段还不能废除死刑，但要慎重适用的观点，并对死刑制度的改革和完善进行阐述。

ABSTRACT

The death penalty is deprived of the criminal life at the expense of criminal punishment measures, is also the most severe punishment system of disciplinary measures, has a very high legal deterrent. Legislature and judiciary in China for the death penalty system of problem has long debate, the recently enacted in the criminal law amendment on the application of the death penalty system in China from the rules, because of the death penalty itself is irreversible and major deterrent effect, all previous dynasties rulers have attached great importance to the use of the death penalty. The death penalty system of problems and the direction of reform for the death penalty has been China theory and the legislative boundary dispute is one of the hot issues. These disputes will promote the development of the death penalty judicial practice, encourage people on the application of the death penalty has carried on the rational thinking, thus promote the reform of the system of death penalty, in the long

run, it is of great significance to promote the construction of our country under the rule of law society. The author thinks that according to the current our country basic national conditions, such as political economy should retain the use of the death penalty, and resolutely carry out the policy of less dead kill cautiously. This article through to the concept of death penalty value analysis, the comparison of the death penalty to save and waste and attitude toward death penalty system in our country, elaborated our country present stage is not to abolish the death penalty, but be careful to apply point of view, and to the reform and perfection of death penalty.
