论文我国工程索赔制度的建立健全

摘要

我国工程索赔是从20世纪80年代在云南鲁布革引水发电工程首次采用国际工程管理模式中出现而开始的，索赔概念也自此进入中国。经历了20多年的风风雨雨，工程索赔工作已取得了进一步的发展，并获得了较为显著的成效，工程索赔无论在数量或金额上都呈不断递增的趋势，备受业主、承包商及有关部门的关注。但工程索赔及其管理还是我国工程建设中一个相对薄弱的环节，一方面，工程承包企业在索赔管理方面还普遍地缺乏经验，有些工程公司领导对施工索赔的作用还估计不足，对索赔业务知之甚少，另一方面，作为从事咨询服务的中介机构咨询监理公司，由于开展业务时间较短，也缺乏索赔管理方面的经验。工程索赔作为工程管理的一部分，涉及到工程技术、工程管理、商贸、财会、法律和公共关系等诸多方面，是一项极其重且具复杂性而又系统性的工作内容，它直接影响合同执行的最终结果，所以探讨和关注建设工程项目管理中的索赔是很有实际意义的。

Abstract

Our country from the 1980 s engineering claims in yunnan lu cloth leather water electricity project adopts the international project management mode for the first time and begin to appear in the claim concept also since then into China. After 20 years of ups and downs, and the engineering claims work has made further development, and access to the more remarkable success, the engineering claims no matter in quantity or value was on the trend of the constantly increasing, is the owner, contractor and relevant departments attention. But the engineering claims and its management or construction in China in a relatively weak link, on the one hand, project contracting enterprise in claims management also generally lack of experience, some engineering company leadership of the construction claims's role is estimate shortage, for claim knew very little about the business, on the other hand, as the intermediary agencies engaged in consultation service of the consultation and supervision company, business because of a relatively short time, also lack claim management experience. The engineering claims as part of the project management, related to engineering technology, engineering management, business, finance, law and public relations, and many other aspects, is a very heavy and with complexity and systematic work content, it directly influence the end result of a contract, so discuss and focus on the construction project management the claim is very practical.
