试论农村集体土地所有权的行使主体

摘要:1982年《中华人民共和国宪法》虽然以国家根本大法的形式在第十条第二款确立了农村集体土地所有权制度，但“农民集体”作为集体土地所有权的主体，是否直接行使集体土地所有权,换句话说，到底由谁来代表集体土地所有权主体行使权利，一直以来都存在争议。农村集体土地所有权在法律上的界定不明,集体土地权利主体存在多级性法律规定，农民个人既是土地所有者又非土地所有者，而集体行为事实上又被乡（镇）、村政府组织官员的意志支配，导致少数人控制土地, 集体所有权虚化,多数农民的土地经营权被侵害。这是当前农村社会分化和矛盾尖锐的一个根源,也是农村土地流失和部分农民贫困化的一个原因。因此，有必要设立农民集体大会作为所有权主体，由农民集体大会选举一个较为固定的组织，作为农民集体的代表行使所有权有关的事务，赋予其法人的地位，重塑农村集体土地所有权行使主体。

Discussion about the Performing Principal Part

of the Rural Collective Land Ownership

Abstract:In 1982, although the Constitution of the People's Republic of China established the ownership system of rural collective land in the form of the nation's basic law in Article 10 (2),but whether the farmers' collective , which is looked as the principal part of the collective land ownership sometimes, can directly exercise the rights ,and that who represents the principal part of the collective land ownership, have been serious problems all the time.Legal definition of rural collective land ownership is not sure. There is such a multi-level law on principal part of the collective land rights. Individual farmers are landowners without land ownership, and in fact the collective behavior is organized by the governments of township (town) or village , which results a few people controlling over lands, collective ownership disappearing, and most of the farmers' rights of managing lands being infringed.

This is a source of sharp rural social differentiation and contradiction, and it is also one of the reasons for the loss of rural land and impoverishment of some farmers.

Therefore, it is necessary to establish a farmers' collective general assembly to be the principal part of the rural collective land ownership. The general assembly elects a fixed organization, which is looked as the representative of the peasants' collective, dealing with affairs about ownership. And it is given legal status, to reshape the principal part of the rural collective land ownership.
