小产权房法律问题研究

摘要

小产权房是开发单位在不向国家缴纳土地出让金的情况下直接在公共所有的土地上开发建设。没有把农用土地转变为非农建设用地,也没得到国家批准。因此国家不会给他们发放产权证书,他们的房屋仅有乡镇政府或者村委会发放的产权证书,因此小产权房不在国家承认的范围之内,根本没有法律效力。本文将通过文献检索和阅读,总结分析小产权房相关研究现状与进展,并通过调查研究分析方法获取研究资料后,首先阐述小产权房的概念及分类,并系统分析小产权房产生的原因。之后对小产权房的现状进行深入剖析。文章指出小产权房的产生即有城乡区别对待的“城乡分治”土地制度及不动产权利一体化的立法模式等社会方面的原因,也有城市商品房价格的高涨,住房保障体制的不完善及农民和集体与政府的利益博弈等法律方面的原因。解决小产权房问题应把握平等的原则,从中央政策出发,把握小产权房处理的思路,协调好各方利益。进一步完善现有的利益分配体系,实现对集体土地收益的合理分配,能够加速城乡一体化的进程。小产权房不同于普通商品房,在处理的时候要加以区分,切实维护人民的切身利益。目前存在的小产权房问题由来已久,牵一发而动全身,涉及到农民和广大中低收入家庭的根本利益,对当前存量小产权房的处理应严格监管拆除行为,谨慎拆除部分小产权房并考虑逐步实现小产权房合法化。为了顺应住房体制的改革,可以考虑由住房的买受人来承担相关的补交费用,以获得房产证。也可以考虑将其转化成经济适用房,这不仅解决了小产权房的去向问题,还可以增加市场上的经济适用房供应量,帮助中低收入家庭解决住房问题,缓解其住房压力。政府可以收购其所有权并将其转化为廉租住房,面向低收入人群。同时应逐步建立公平合理的城乡土地制度,放宽对农民进行农村集体土地开发利用的限制,切实维护农民

的切身利益。完善小产权房拆迁补偿制度,在制定相关补偿政策的时候,首先要以市场价为基础,将相关的补交费用计算在内,平衡各方利益。
