身高歧视论文:论身高歧视的劳动法规制
【中文摘要】在我国的就业市场中,用人单位招聘员工时对劳动者的身高提出特别要求并非个别现象,而要求劳动者具备与劳动能力、岗位职责无关的身高要求构成了法律上的不合理差别对待,对劳动者而言无疑是对其平等就业权的侵犯。同时,就业歧视也是国际社会普遍存在的现象,西方国家的法律制度对此已做出了相应的回应以保障公众的平等就业权。我国现有的法律虽有涉及有关就业歧视的规定,但因其过于原则,缺乏具体的操作规则而在司法实践中难以适用,特别是在有关身高歧视概念的界定与法律责任的确定上缺少相关规定,使得受歧视劳动者的权益无法得到保护。必须对现有的劳动法律制度予以相应修改用以满足劳动者对规制就业歧视的需求。本文通过采用案例分析法、数据分析法、比较研究法三个主要研究方法,选择以求职者李某在就业过程中遭受的身高歧视案为例,摘选原、被告双方在就业歧视诉讼中各自的诉讼理由与辩解,并结合受理法院在审判此案中的对事实认定与法律依据裁量,提出我国现有法律制度对因身高等原因引起的就业歧视纠纷如何界定,就业身高歧视定义及其审查标准,确定法律责任以有效规制就业身高歧视行为,用以解决劳动者在求职过程中遭遇的就业歧视问题。对我国规范就业歧视的劳动法规制进行法律理论整理,分别从平等保护劳动者就业权、企业用工自主权与社会公益的调和、劳动法自身的宣告性权利保护不足、顺应反就业歧视立法的国际化趋势这四个方面论述我国的对就业歧视进行规
制的必要性,总结出解决此类问题应当纳入到劳动法的体制框架下的法律与事实依据,得出我国现有的法律制度不足以对劳动者所遭受的就业歧视进行保护及需要对现有法律制度进行完善的结论。在进行必要性论述的基础上提出解决因身高原因遭受的就业歧视问题的具体
建议,即明确在司法的过程中对就业身高歧视进行界定并采用“相关工作资格”原则对就业身高歧视的认定进行具体审查,明确在处理此类案件中加害方相应的法律责任,以期能对我国因身高原因而导致的就业歧视案件处理和反就业歧视法律体系的建构及完善起到推动作用。
【英文摘要】In China’s job market, employers take height into account when they recruit workers is not an isolated phenomenon, which are constituted the irrelevant factors relate to employees’work abilities and responsibilities on consideration of law, undoubtedly it’s an invasion of equal employment to the workers. At the mean time, employment discrimination is also a common existing phenomenon in the international community,the legal system of western countries have made appropriate response to protect the public’s right to equal employment. Although China’s existing legal provisions relating to employment discrimination, but because of too much principles, the lack of specific rules of operation made difficult to apply in judicial practice, Especially lack
the relevant provisions at the height of the concept of discrimination and the legal responsibility, thus making the right of those who are under discrimination cannot be protected, regarding modification must be done on the current labor law system to meet the needs of employment discrimination regulation. This article used case and data analysis and comparison study ,the three main methods of research; chose the employment case of the job seeker Mr Li’s suffering of height discrimination as the breakthrough point for the paper, and selected the view of cause of action and defendant from both the complainants and defendants in employment discrimination proceedings and combined with the case in the trial court accepted the factual findings and legal basis for discretion, make our existing legal system, due to causes such as height discrimination disputes how to comply with law, the existing legal regulation of employment discrimination disputes in the state and improve labor law to address the workers in the job search process encountered discrimination in employment.
