摘要
“四川泸州遗赠案”及“杭州百万遗赠案”引起了社会舆论和法学界对限制遗嘱自由的激烈争论。

遗嘱自由原则是私法意思自治原则在继承法上的体现，现已为世界各国所承认。

其法理基础是财产所有权中的处分权能。

从限制遗嘱自由的历史演进过程看，对遗嘱自由进行限制具有重要的现实意义。

纵观各国继承立法，通常采用外部限制即公序良俗原则，和内部限制即特留份制度两种方法来限制遗嘱自由。

而我国现行法律对遗嘱自由过于放任，仅有《民法通则》中笼统的公序良俗原则和《继承法》中的必留份制度，存在很多缺陷及漏洞。

我国应确立继承法上的公序良俗原则并在实践中合理适用该原则，同时从制度层面构建我国的特留份制度。

Abstract
“Sichuan Luzhou Devise Case” and “Hangzhou Devise Case” have become a highly debatable issue. The limitation of freedom of testament also sparked heated controversy by law circles. As the reflection of the rule autonomy of the will in Inheritance law, freedom of testament system is an important principle in the inheritance law of every country. The basis of legal principle of freedom of testament system is disposal power of property right. Author analyzing the origin of the limitation of freedom of testament, it is practically significant to restrict the freedom of testament. Across inheritance legislation in the world, external limitation ( principle of customs in Inheritance law ) and internal limitation ( legal portion ) are used to limit freedom of testament system by main states’ legislative system. The freedom of testament in the present inheritance law of China is too excessive, while ambiguous principle of customs in civil law and certain heirdom in Inheritance law have numerous defects. The legislature should establish the limitation of the freedom of testament by the principle of customs in China, and use it properly in cases. In the meantime, the legislature should carry out an advanced legal portion in china from the point of view of the institutions.
