试述物权的效力
答:所谓物权的效力,是指合法行为发生物权法上之效果的保障力。
物权的效力问题在全部物权法中占据极其重要的问题。

1、支配效力。
(1分)物权的支配效力,是指物权具有的、保障物权人对标的物为一定行为并享受其效益的作用力。
物权的支配效力可因物权类型及物权状况的不同而划分为直接支配力和间接支配力。

2、排他效力。
(1分)物权的排他效力,是指同一物之上不得同时成立两个或两个以上内容相互矛盾、相互冲突的物权。

3、优先效力。
(1分)物权的优先效力,是指权利效力的强弱,即同一标的物上有数个利益相互矛盾、冲突的权利并存时,具有较强效力的权利排斥或先于具有较弱效力的权利的实现。

六、案例分析题(本大题共15分)
答:1、投资公司不应当承担保证责任。
(3分)理由如下:首先,商贸公司与服务公司所签的联营合同名为联营实为借贷,我国法律禁止企业法人相互之间进行拆借资金,商贸公司与服务公司所签的名为联营实为借贷的合同,违背我国法律的禁止性规定,因而是无效的。
(2分)其次,保证合同是从合同,主合同无效,保证合同也无效。
本案中,投资公司与商贸公司所签订的保证合同本是商贸公司与服务公司所签订的联营合同的从合同,因此,在商贸公司与服务公司所签订的联营合同无效的情况下,其担保合同即投资公司与商贸公司之间的保证合同也无效,故投资公司不承担保证责任。
(3分)2、服务公司返还商贸公司本金200万元,对商贸公司与服务公司约定的利息予以收缴,并对服务公司处以罚款。
