《国际贸易实务》教学大纲第一章国际贸易的基本流程和适用的法律第一节国际贸易的基本流程(一)国际贸易的特点国际贸易(International Trade)是指从国际范围来看的国家或地区与别国或地区进行货物和服务交换的活动。
国际贸易在交易环境、交易条件、贸易做法等方面所涉及的问题,都远比国内贸易复杂。
(二)出口贸易的基本流程在国际贸易实际业务中,由于交易客户和交易条件不同,其中的业务环节内容也有所不同,但其基本流程一般来说还是相似的。
为使国际贸易能够顺利进行,了解国际贸易的基本流程是非常必要的。
出口贸易的基本流程在通常情况下可分为出口贸易前的准备工作阶段、贸易磋商和签订出口合同阶段以及出口合同履行阶段。
(三)进口贸易的基本流程进口贸易的基本流程也包括三个阶段,但在具体内容上,与出口贸易又有所不同。

第二节国际贸易所适用的法律法规为保证国际贸易能够顺利进行,使国际贸易得到法律的承认与保护,国际贸易业务必须符合法律规范。
但由于国际贸易的当事人一般属于不同的国家或地区,处于不同的法律和制度的管辖之下,因此,国际贸易所适用的法律法规有较大的不同。
概括起来,国际贸易所适用的法律法规主要有国际条约、国际贸易惯例、国内法等。
(一)国际条约国际条约(International Treaty)是指两个或两个以上的主权国家为确定彼此在政治、经济、贸易、文化和军事等方面的权利和义务关系而缔结的诸如公约、协定、议定书等各种协议的总称。
国际条约依法缔结生效后,即对当事各方具有拘束力,必须由当事各方善意地履行。
对此,国际法上有一项“条约必须遵守”的基本原则,即缔结条约以后,各方必须按照条约规定,行使自己的权利,履行自己的义务,不得违反。
因此,国际条约是国际贸易所应遵守的重要法律类别之一。
(二)国际贸易惯例国际贸易惯例,一般是指在国际贸易业务中,经过反复实践形成的、并经过国际组织加以解释和编纂的一些行为规范和习惯做法。
