Divorce Agreement
This Divorce Agreement (the "Agreement") is made and entered into on
this [Date] (the "Effective Date") by and between [Full Name of Husband], hereinafter referred to as "Husband," and [Full Name of Wife],
hereinafter referred to as "Wife," collectively referred to as the "Parties."
BACKGROUND:
The Parties are husband and wife, respectively, and were legally married on [Date of Marriage]. Unfortunately, due to [reason for divorce, e.g., irreconcilable differences], the Parties have decided to terminate their marriage. In order to facilitate an amicable resolution and to avoid protracted litigation, the Parties have voluntarily entered into this Divorce Agreement.
AGREEMENT:
1. Division of Property: The Parties agree to divide their property in accordance with the terms set forth below.
2. Assets: The Parties acknowledge and agree that the following assets shall be divided as follows:
a. Real Property: The Parties shall divide their real property in accordance with the following schedule:
i. [Description of Property 1] shall be solely owned by [Husband/Wife];
ii. [Description of Property 2] shall be solely owned by [Husband/Wife];
iii. [Description of Property 3] shall be jointly owned by the Parties, and they shall execute a quitclaim deed to transfer ownership
to [Husband/Wife] upon the terms and conditions set forth in Exhibit A attached hereto.
b. Personal Property: The Parties shall divide their personal
property in accordance with the following schedule:
i. [List of Personal Property 1] shall be solely owned by [Husband/Wife];
ii. [List of Personal Property 2] shall be solely owned by [Husband/Wife];
iii. [List of Personal Property 3] shall be jointly owned by the Parties, and they shall execute a quitclaim deed to transfer ownership to [Husband/Wife] upon the terms and conditions set forth in Exhibit B attached hereto.
3. Debts: The Parties acknowledge and agree that the following debts shall be divided as follows:
a. Joint Debts: The Parties shall be jointly and severally liable for the payment of the following joint debts:
i. [Description of Debt 1];
ii. [Description of Debt 2];
iii. [Description of Debt 3].
b. Sole Debts: [Husband/Wife] shall be solely liable for the payment of the following sole debts:
i. [Description of Debt 1];
ii. [Description of Debt 2];

4. Support: The Parties agree that [Husband/Wife] shall pay [amount] per month in spousal support to [Wife/Husband] for a term of [duration], beginning on the Effective Date of this Agreement and continuing until [termination date]. The Parties further agree that [Husband/Wife] shall maintain health insurance coverage for [Wife/Husband] as required by
this Agreement.
5. Custody and Visitation: The Parties agree that [Wife/Husband] shall have primary physical custody of [Children's Names], and [Husband/Wife] shall have [frequency and duration] of visitation with the children. The
Parties further agree to comply with all court orders and guidelines regarding the custody and visitation of the children.
6. Confidentiality: The Parties agree to maintain the confidentiality of this Agreement, except as required by law or court order.
7. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State/Province of [State/Province], without regard to its conflict of laws principles.
8. Entire Agreement: This Agreement constitutes the entire agreement between the Parties and supersedes all prior agreements and understandings, both written and oral, between the Parties with respect to the subject matter of this Agreement.
