中西政党入宪的比较分析--基于宪法文本的考察

【摘要】As an integral part of political life, political parties exert an essential impact on a state’s performance. As the fundamental law of a state, constitution is supposed to regulate the political parties. This is not only the re⁃quirement of constitutional development but also an inevitable historical progress. The word Party went into China’ s constitution just a few decades ago compared with the Western’s that took a long period of centuries The differ⁃ences of the process between the Chinese Party and Western political parties that went into Constitution is reflect⁃ed both in the time interval and the constitutional texts. An inspection of the text of the Constitution can help us to sort out the general rules of construction in political system.% 政党作为当代政治生活中不可或缺的一环，其存在与运行深刻影响着一国的政治效能。

宪法作为一国的根本大法，理应对政党加以规范。

这不仅是宪政发展的要求，更是历史进步的必然。

西方政党入宪历经几个世纪的漫漫长路，与之相比，中国的政党入宪却疾风劲雨似的在短短的几十年内“完成”，独具特色。

中西政党入宪的差异不仅体现在时间间隔上，更体现在宪法文本之中。

考察中西宪法文本中有关“政党条款”的差异，可以理清制度建构的一般规律
