AUTOMOBILE LEASE CONTRACT
Party A: Lessor
Party B: Lessee
In accordance with the laws of the People’s Republic of China and principles of equality and mutual benefit, both Party A and Party B, after friendly negotiation, agree to conclude this automobile lease contract.
Article 1: Lease Object
Party A agrees to lease its automobile with Brand __________ Model __________ to Party B. The details of the automobile are specified in Appendix 1.
Article 2: Lease Term
The lease term is from ________ (Lease Start Date) to ________ (Lease End Date).
Article 3: Lease Rent
The monthly rent is ________ RMB. Party B shall pay the rent every ________ (payment frequency) to Party A’s designated account.
Article 4: Payment and Security
1. Party B shall provide a valid credit card as a security for this lease. The details of the credit card are specified in Appendix
2.
2. In case of any default by Party B, Party A has the right to use the credit card for payment of outstanding amounts.
Article 5: Rights and Obligations of Both Parties
1. Party A shall ensure the automobile is in good condition before the commencement of the lease. Any defects shall be disclosed to Party B immediately.
2. Party B has the right to use the automobile for the agreed purpose only. Party B shall bear all responsibilities for the automobile during the lease term. Any damage caused by Party B shall be borne by Party B.
3. Party B shall not alter the automobile or engage in any activities that may cause damage to the automobile without the consent of Party A.
4. At the end of the lease term, Party B shall return the automobile to Party A in the same condition as at the beginning of the lease (except for normal wear and tear).
Article 6: Termination
Either party may terminate this contract in case of any breach by the other party which cannot be rectified within a reasonable period.
Article 7: Disputes and Applicable Laws
Any disputes arising from or in connection with this contract shall be settled through friendly negotiation. If no settlement can be reached, either party may submit the dispute to the court located in ________ for resolution. This contract is governed by the laws of the People’s Republic of China.
Article 8: Miscellaneous
1. This contract constitutes the entire agreement between both parties and may not be modified except by written agreement signed by both parties.
2. Any amendment or supplement to this contract shall be made in writing and shall be deemed as an integral part of this contract.
3. Failure by either party to exercise any right or remedy under this contract shall not be deemed as a waiver of such right or remedy.
4. This contract is made in both Chinese and English, both versions being equally authentic. In case of any discrepancies, the Chinese version shall prevail.
