甲方：
乙方：
由于甲方向乙方借用钱款______元(大写：____________圆)，在短期
内无力偿还，所以经甲乙双方协定，在平等、自愿的基础下达成如下协议：
1、甲方的宅基地面积______平方米，(有证/无证)，该宅基地位于
______省______县______乡(镇)______村，四至界线为：北接______，南接______，东接______，西接______，将其抵押于乙方，抵押之后，甲方不再欠乙方任何款项。
2、乙方在使用过程中，如果因地界发生争议，甲方负责协调解决，若解决过程中发生费用由甲方负责。
3、乙方在使用过程中如发生国家征用，甲方协助办理手续。所获得的补偿费用全部归乙方所有，甲方不得发任何借口索要和拒付。同样，在办理房产证、土地使用证时，甲方均协助乙方，办成与否，甲方不对其结果负责。但办理、协助于乙方过程中所发生的费用全部由乙方负责，乙方不得以任何借口有责于甲方。
4、甲方抵押宅基地后，如果其村民小组根据其户头，调整新宅基地块、分红等，由甲方支配和使用，乙方无权享受。
5、乙方取得宅基地可以自由转让、转卖，甲方不得干涉。乙方转让、转卖过程中，需要签字的甲方应无偿配合积极给予办理。
6、甲方所抵押的宅基地如不符实或有假或以其他人有争议而不能抵押时，甲方需按乙方支出总价3倍还予乙方。同样，甲方宅基地抵押乙方后，从此证明不再欠乙方任何事项，乙方在以后不得以任何借口、任何方式向甲方索要，反之按其抵押价3倍赔偿甲方。
7、上述协议条款，甲乙双方必须认真遵守，如不认真履行协议条款之一者均视为违约。违约方按其成交款的3倍返还给对方。
8、协议书包括合同书及平面图1份，合同自甲乙双方签字认定后生效，任何一方不得反悔。
9、本协议一式二份，甲乙双方各执一份。附件：甲乙双方身份证。

(1) 无民事行为能力人实施的;
(2) 限制民事行为能力人依法不能独立实施的;
(3) 一方以欺诈、胁迫的手段或者乘人之危，使对方在违背真实意思的情况下所为的;

(5) 违反法律或者社会公共利益的;
(6) 经济合同违反国家指令性计划的;
(7) 以合法形式掩盖非法目的的;

(1)一方以欺诈、胁迫的手段订立合同，损害国家利益;
(2)恶意串通，损害国家、集体或者第三人利益;

(5)违反法律、行政法规的强制性规定。
