The Language of Employment Law
Vocabulary:
1.Payroll 工资名单 It is a list of people who work for the business.
2.Remuneration: It is a formal word meaning payment.
3.Salary: It is an amount of money that an employee receive each month or year .
4.Wages: It's the money which a employee usually receives every week.
5. Both salary and wages are sometimes called pay.
6.Maternity leave: A period of maternity leave is the time that a woman is away from work before and after the birth of her baby.
7.C.V: It's a document that tells an employer about a person's previous experience of work and what qualification that person has. This document called "resume" in USA.
8.Applicant: It's a person who asks to have something, especially a job.
9.Covering Letter: It's the name of the letter that a person sends with a job application.
10.Closing date: The closing date for a job application is the last date that the employer will accept the an application from someone.
11.Track record: A person have it in a particular job has previous experience of doing that job.
12.The retail industry: it involved in buying and selling the goods to the public. (opposite to wholesale 批发)
13.Enclosed: "Please find my C.V enclosed", It means that I have put my C.V in the envelop with my covering letter.
14.Cash Register收款机 (Cashier收款员): The machine into which a shop or some other business puts the money when a customer pays for something. Also called a "till"
15.Confidentiality: This clause deals with the employee's obligation not to tell anyone certain information that belongs to the employer.
16.Term of the contract: This clause deals with the period of time that the contract will be valid.
17.Termination: This clause deals with the ways in which the contract of employment can end.
18.Disciplinary Procedure: This clause deals with what the employer must do if he or she is unhappy with the way the employee is behaving at work.
19.Pension: This clause deals with the arrangements for the employee to have money in his or her old age.
20.Holidays: This clause deals with the time that the employee is allowed to stay away from work to rest and relax and still receive his or her pay.
21. Grievance Procedure: This clause deals with what an employee must do if he or she is unhappy at work and wants to complain to the employer.
22.Non-competition: This clause deals with the employee's obligation after the contract of employment end not to start the same business or work for a rival of
the employer for the certain period of time.
23.Sick pay: This clause deals with the money that an employer must pay to an employee when he is ill and cannot work.
24.Fund: An amount of money keep for a special peupose.
25.Material: Important.
26.Notice: A warning period.

27. Resignation(辞呈):
A.It means to tell your employer that you intend to stop working for him or her.

38.Unfair dismissal: It means that the employer dismiss an employee without a good reason.
39.Appraisal: It's a type of assessment of someone's performance, especially at work.If I had 2 appraisals from my employer,he might not want to continually hire me.
40.Contentious work: It's work that lawyer does that involves a dispute or an argument between people.
41.Non-contentious work: Work that does not involve dispute or argument between.
42.Legislation: All of the laws passed by a government or an organization.
43.Regulation: Rules that a person or a country must obey.
44.Seminar: A meeting where a group of people learn and talk about a new subject.
45.Duty of care: it's a duty take care and not to harm others by your actions. (An employer has a duty of care to take care to employees and to any people who visit the employer's premises.)
46.Allegation: A statement that someone has done something wrong, however, it's not proven.
47.To dock pay: To keep part of someone's salary as punishment because that person did something wrong.
48.To be fired on-the-spot: It means that an employee is dismissed immediately without any warning. The more formal way of saying fired on-the-spot is to say that the employer dismissed the employee summarily.
49.Trade union: An organization of workers who unite for better pay and working conditions.
50.Strike: It's a situation where a group of employees stop working for a period of time because of disagreement with an employer.

52.Dismissing an employee for gross misconduct:
Gross misconduct is behaviour that is completely unacceptable. When an employee is guilty of gross misconduct the law does not expect the employer to tolerate it. The employer can usually dismiss the employee without giving him or her any warning. A lawyer can also describe this as dismissing the employee
without notice.
When an employee is dismissed on the grounds of gross misconduct, he or she might file a claim against the employer in a special court called an employment tribunal. The tribunal will take several factors into account when deciding if the employer acted fairly. One of the most important things that an employer must do is make sure that the correct disciplinary procedure is followed. Even in cases of very serious misconduct the employer should: ·Inform the employee in writing what the problem is, as well as speaking to him or her about it. This normally takes the form of a letter.
·Allow the employee a face-to-face meeting to discuss the misconduct. The employer must tell the employee that he or she is entitled to have a trade union representative or some other witness present at that meeting.
·Allow the employee to appeal against the decision if he or she is dismissed.(request an authority to change a decision)
If an employer does not do this, then the employee will almost certainly sue for damages and he or she is very likely to win.

7.Response :The formal answer to a claim
8.Conciliation:A process in which the two parties to a dispute are brought together in order to try to find a solution. Mediation is an example of this.
9.Default judgement: An order issued by the court which says that the claimant has won the case because the respondent failed to file a response to the claim.
10.Case management: The process in which the parties to the dispute agree on the contact of the case, for example agreeing whether expert evidence is needed, what documents must be disclosed to each side and the time allowed for this,etc.
