根据《中华人民共和国合同法》、《上海市房屋租赁条例》(以下简称:《条例》)的规定,甲、乙双方在平等、自愿、公平和诚实信用的基础上,经协商一致,就乙方承租甲方可依出租(出租)的商品房(房屋/商品房)事宜,订立本合同。

In accordance with the Laws of Contract of the People?s Republic of China and the Tenancy Regulations of the Shanghai Municipality (hereina fter referred to as “the Provisions”), Party A and Party B, having reached an agreement based on the principles of equality, willingness and mutual benefit, hereby enter into this Contract on matters in relation to the Lease of the Property by Party A to Party B.

一、出租房屋情况

Condition of the Lease or Pre-Lease Property

1-1甲方出租(出租)给乙方的房屋座落在本市(区/县)路号(弄/新村)(号/幢)室(部位)(以下简称该房屋)。该房屋实测(【出租】实测)建筑面积为平方米,房屋用途住宅,房屋结构为钢混。甲方已向乙方出示:

1-2甲方作为该房屋的房地产权利人 (房地产权利人/代管人/法律规定的其他权

利人)与乙方建立租赁关系。签订本合同前,甲方已告知乙方该房屋 (已/未)设定

抵押。

Party A being the Owner of the Property and Party B have developed a

lessor/lessee relationship. Before the signing of this Contract, Party A has already

informed Party B that the Property subject to a mortgage.

1-3该房屋的公用或合用部位的使用范围、条件和要求;现有装修、附属设施、设备

状况和甲方同意乙方自行装修和增设附属设施的内容、标准及需约定的有关事宜,由

甲、乙双方分别在本合同附件(二)、(三)中加以列明。甲、乙双方同意该附件作为甲

方向乙方交付该房屋和本合同终止时乙方向甲方返还该房屋的验收依据。

The area and the use of the public or common part of the Property; the existing

fixtures, facilities, condition of equipment and the contents, standard and other

relevant matters to be ascertained in relation to the fixtures and the facilities added

by Party B with the consent of Party A shall be specified in Appendix 2, 3 of this

Contract. Party A and Party B have agreed the said Appendix shall represent the

condition of the Property at the time of hand over of the Property by Party A to Party

B and when Party B deliver up the Property to Party A at the expiry of this Contract.

二、租赁用途

Purpose of the Property

2-1乙方向甲方承诺,租赁该房屋作为住宅使用,并遵守国家和本市有关房屋

使用

和物业管理的规定。

Party B warrants to Party A that the Property shall be used for Residential purpose and follows the regulations of the State and this Municipality in relation to the use

and management of Property.
