询盘(Inquiry)是交易的一方向对方探询交易条件,表示交易愿望的一种行为。
询盘多由买方作出,也可由卖方作出、内容可详可略。
如买方询盘:“有兴趣东北大豆,请发盘”,或者“有兴趣东北大豆,11月装运,请报价”。
询盘对交易双方无约束力。
报盘(Offer),也叫报价,是卖方主动向买方提供商品信息,或者是对询盘的答复,是卖方根据买方的来信,向买方报盘,其内容可包括商品名称、规格、数量、包装条件、价格、付款方式和交货期限等。
报盘有两种:虚盘(non-firm offers), 即无约束力的报盘。
一般情况下,多数报盘均为虚盘,虚盘不规定报盘的有效日期,并且附有保留条件,如:The offer is subject to our final confirmation/prior sale. 该报盘以我方最后确认/事先售出为准。
实盘(firm offers)则规定有效日期,而且卖盘一旦被接受,报盘人就不能撤回。
还盘,(Counter-offer)受盘人不同意发盘中的交易条件而提出修改或变更的意见,称为还盘。
在法律上叫反要约。
还盘实际上是受盘人以发盘人的地位发出的一个新盘。
原发盘人成为新盘的受盘人。
还盘又是受盘人对发盘的拒绝,发盘因对方还盘而失效,原发盘人不再受其约束。
还盘可以在双方之间反复进行,还盘的内容通常仅陈述需变更或增添的条件,对双方同意的交易条件毋需重复。
接受在法律上称为“承诺”,接受一经送达发盘人,合同即告成立。
双方均应履行合同所规定的义务并拥有相应的权利。

• 有客户发电子邮件来问价了, 行话叫做“询盘” (Inquiry)。Inquiry一词, 通常会显示在邮件 的标题 和正文里,英文不好的朋友, 见到这个词要特别关注:生 意上门了。 • 有外商问价,把价格报给 外商,这就是“报价” quote、 offer
• 询盘又称询价,是指交易的 一方为购买或出售某种商品, 向对方口头或书面发出的探 询交易条件的过程。其内容 可繁可简,可只询问价格, 也可询问其他有关的交易条 件。 • 询盘对买卖双方均无约束力, 接受询盘的一方可给予答复, 亦可不做回答。但作为交易 磋商的起点,商业习惯上, 收到询盘的一方应迅速作出 答复。
• FOB条件下,卖方要负责出口 商检、报关,货物越过出口港 船舷之前有什么损坏都要承担。 • 出口港码头在吊装货物的时候, 不慎吊钩松脱导致货物碰撞落 海。码头固然有责任,但谁该 背这个黑锅去跟码头扯皮? • 答案取决于价格术语,以及货 物落海的刹那间是否已经越船 舷。如果是FOB,且已经过舷, 则买方自认倒霉;否则由卖方 来买单。
2.在外国码头交货: CNF (Cost and Freight) 在美国纽约港口交货:CNF New York.在这种方式下,除了FOB 价格之外,还要加上货物运到美 国纽约的运杂费。 CNF = FOB + 远洋运费
3. 在外国码头交货,同时给货物 买上个保险以免途中损坏: CIF (Cost, insurance and freight) 约定在纽约港口交货就叫CIF New York这种方式就是在 CNF价格的基础上,加上一 点保险费。 CIF = FOB + 远洋运费 + 保 险费
• 一项实盘必须具备: 1) 发盘的内容和词句必须肯定,不 能用‘大约(about)’,‘参考价 (reference price)’等摸棱两可的 词。 2) 发盘的内容明确完整,其内容应 包括商品品质(Quality),数量 (Quantity),包装(Packing), 价格(Price),装运(Shipment), 支付(Payment),有效期(Validity ) 等。 3) 发盘中不能有保留条件如:以我 方最后确认为准 subject to our final confirmation ;以货物的未售出为 准 subject to goods being unsold

询盘报盘还盘Enquiry (询盘)1、简介:在国际商务中,要经过多次谈判洽商才能达成一致协议,而其中的流程包括:询盘(Enquiry)报盘(Offer)还盘(Counter-offer)。
2、释义:“询盘”是指交易的一方欲买、卖某项商品向交易方的另一方询问买、卖该项商品的各项交易条件的一种表示。
包括一般询盘(General Enquiry)和具体询盘(Specific Enquiry)。
而一般询盘指买方或卖方向对方索取商品目录、价目表、样品等,具体询盘指买方或卖方就指定商品要求对方发盘。
询盘信函要求简短,具体,合理,有礼貌。
3、信函的写作技巧:开头:1)说明自己的信息来源;2)表明写信目的;正文:1)自我介绍;2)陈述要求(索取商品目录,价目表,样品及其他条款);3)描述市场行情和可接受的合理价格(令对方有希望的句子);结尾:期望得到回复。
