康耐视或其关联机构的员工(及其直系亲属)无资格参赛。
该竞赛受美国联邦、州及当地法律的管辖。
每个电子邮件地址允许一人参赛(同一电子邮件地址多次报名不予认可)。
报名信息不会被承认或退回。
参加该竞赛后,您在此保证所提供的所有信息均系真实的、完整的、当前的。
不符合本竞赛总规则要求的报名将被视为不合格。
康耐视保留或以其它方式违反本竞赛总规则的人员不符合资格。
第3条–日期
该竞赛时间为2011年5月25日至2011年8月25日北京时间下午17:00(以下简称为“报名期”)。
在报名期内收到的报名者可有资格获奖。
第4条–竞赛组织
将通过公布该竞赛信息,参赛者必须通过该网站注册。
报名参加该竞赛的,参赛者必须遵守报名说明(即:回答调查表中的所有问题并按输入),并在报名期内同意该等竞赛总规则。
已经填妥调查表并在报名期内接受该等竞赛总规则的参赛者可以参加抽奖。
康耐视不对下列问题承担任何责任:互联网无法接入、服务中断或延迟、计算机故障或其他技术问题、任何报名期内未收到的报名。
对于信息的错误、欠准确,不论是否由于参赛者造成、第三人造成、竞赛所涉或使用的设备、程序所导致,康耐视均不承担责任。
第5条–抽奖及获胜者
只有回答了调查表中所有问题的参赛者方可有资格获奖。
将从在报名期内收到的所有合格参赛者中随机抽取获奖者。
如何在每个报名期内奖品分发和奖品的数目具体见下表。
获胜机会有赖于收到的合格报名的总数。
将在抽奖后的30日内通过电子邮件通知获奖者。
将在抽奖后的60日内将奖品寄送给获奖者。
第6条–奖品描述
将向每位获胜者颁发Apple® iPhone4, 16GB(零售价值约为4,999人民币)。
康耐视有权因任何理由(包括无法在参赛者国家/地区获得iPhone4)随时替换奖品(以相同或更大的价值)。
参加本竞赛之时的,获奖者同意苹果公司有关iPhone4操作、使用及转让的相关条款及条件,并单独承担相关责任。
第7条–奖励及奖品交付
康耐视将安排颁发奖品。
是否能够收到奖品则取决于所有应适用于此的法律、法规、规章。
获胜者负责支付与获奖相关的各种应适用的税金并承担与获奖相关的各种其他责任。
任何税负和关税,如果有的话,均属获奖者的责任,获奖者可能为其获奖需要填写IRS Form 1099 for the ARV文件。
奖品不得转让、过户或兑换现金。
本竞赛总规则第6条对于奖项的授予和描,不赋予获奖者向康耐视提起任何主张的权利,不赋予获奖者以任何理由交换或替换该等奖品的权利。
将仅根据第5条规定向获胜者颁发奖品。
如果获胜者未遵守本竞赛总规则,则可向另一获胜者颁发该奖品。
在奖品或获奖通知无法送达的情况下,该获奖者将丧失获奖资格,并被另行选择的获奖者所取代。
第8条–竞赛修改
康耐视有权于任何时间以任何理由中止、缩短、修改或取消该竞赛、修改竞赛总规则,无需就此对参赛者支付任何赔偿。
无论有前述规定,康耐视应通过电子邮件向参赛者告知其中止、修改或取消了该竞赛或修改了本竞赛总规则。
如果竞赛被取消,则康耐视有权在取消日前于所有合格且正确的报名者中选择一名获胜者。
第9条–入选及个人数据与隐私声明
参加本竞赛之时,参赛者向康耐视提供了有关他/她个人数据的所有必要信息(即:参赛者姓名、电子邮件地址、照片及声明等),以便康耐视管理该竞赛。
参与该竞赛的,获胜者还同意康耐视可使用并分发其姓名、声明及其他类似信息(包括照片),以便通过媒体(包括但不限于因特网)进行促销及广告,无需向获胜者支付其他费用、报酬或其他对价。
任何参赛者的个人数据将仅在符合当前数据保护立法的情况下被使用且未经该参赛者同意,不会向任何第三方披露该等信息。
就康耐视为管理竞赛而收集的参赛者的个人数据而言,各参赛者均有权让康耐视披露其拥有的有关他/她的信息。
此外,各参赛者均有权纠正或删除该等信息。

第10条–网络费用
康耐视不负责报销由于该竞赛而引起的网络费用。
第11条–保证
康耐视不对奖品提供任何质量保证。
在法律允许的情况下,康耐视特别不对任何奖品提供明示或默示陈述或保证(包括有关适销性或适用于某特定目的的保证以及由于处理或履约引起的默示保证)。
第12条–责任
如果康耐视不恰当地拒绝给予参赛者任何奖品,则康耐视的全部责任以及参赛者的唯一补偿将仅限于上述规定中同等价值的奖品。
参赛者以放弃相关行为、事件、条件或不作为首次发生的一(1)年后就此等事件提起权益主张或诉讼的权利为条件而参与本竞赛。
参加本竞赛之时,对于参赛、接受、占有、使用或误用奖项所引起的任何权利主张、责任、损失、侵害或伤害(包括第三者的权益主张),参赛者放弃、解除、保护并使得康耐视(包括其管理人员、董事、员工)免除责任。
任何情况下,康耐视均不对参与竞赛所导致的或相关联的偶发的、间接的、特殊的、后果性的损害(包括但不限于计算机使用、因特网接入、任何电子故障、邮件延误、邮件或电子邮件的丢失)承担责任。
参加本竞赛之时,参赛者同意如果参加此次竞赛或接受、拥有、使用或错误使用奖品引起任何权利主张、责任、损失、损害或伤害(包括第三方权利主张)的,参赛者将对康耐视(包括其高级职员、董事及员工)进行赔偿并保证其免受损害。
在任何情况下,康耐视均无需对由于参加此次竞赛或与之相关的事项引起的偶发、间接、特别或后果性损害赔偿(包括但不限于使用计算机、因特网接入、电子故障、邮政延误或电子邮件丢失)承担责任。
任何试图欺骗或以任何方式干预竞赛的人员将可能在法律允许的最大范围内被追究法律责任。
第13条–知识产权
根据有关知识产权法的所有相关法律规定,复制或传播部分或全部构成该竞赛之要素的行为均被严格禁止。
就此次竞赛或Apple产品使用的所有商标、服务标识、图形和/或标志均为其各自所有人的商标。
参赛者(包括获胜者)均有被授予一项有关上述商标或其使用权的权利或许可。
Apple以及iPhone为苹果公司的商标。
本文件为独立出版物,未经苹果公司资助、授权或以其他方式批准。
第14条–规则遵守
如果您申请注册竞赛或如果您接受竞赛奖品,则您接受了本竞赛规则。
参加该竞赛的,参赛者无条件同意接受本竞赛总规则及其修订版本以及康耐视决定的约束,前者系竞赛所有事项的终局性的、具有约束力的规范。
任何本竞赛相关的权利主张,必须以书面形式向康耐视的法务部(康耐视公司,ID IQ Quiz Contest颁奖工作组,马塞诸塞州
Natick 郡One Vision Drive,邮编01760-2059)提交,并应随附一份贴有邮票并写明地址的信封。
任何此类权利主张必须在于报名期结束前抵达收件方。
有关本竞赛规则的解释及应用的所有权利主张均应由康耐视独立决定。
任何参赛者均无权进一步追究责任或起诉。
第15条–管辖法律
本竞赛总规则受美国马塞诸塞州法律(不包括其冲突法规则及《联合国国际货物销售合同公约》)管辖。
由本竞赛总规则引起的或与之相关的争议,应仅提交美国马塞诸塞州波士顿具有司法管辖权的法院审理。
