Deportation Agreement
THIS AGREEMENT is made and entered into this __________ day
of __________, 20__.
PARTIES:
1. The Federal Republic of Germany, hereinafter referred to
as "Germany", a sovereign state located in Europe,
represented by its Ministry of the Interior, for the purposes of this Agreement.
2. The _____________ (name of the country), hereinafter referred to as "Country of Origin", a sovereign state located in _____________, represented by its Ministry of Foreign Affairs, for the purposes of this Agreement.
WHEREAS:
A. Germany and Country of Origin have a mutual interest in
the orderly and humane management of the return of persons
who are subject to return procedures.
B. Germany and Country of Origin recognize the importance of cooperation in the return process and the need to ensure that the rights and dignity of the persons concerned are respected.
C. Germany and Country of Origin have agreed to conclude this Agreement to facilitate the return of persons who are to be returned to Country of Origin.
NOW, THEREFORE, the Parties agree as follows:
Article 1: Definitions
1.1 "Deportation" means the enforced return of a person to the Country of Origin.
1.2 "Person to be Deported" means a person who is subject to return procedures and is to be returned to the Country of Origin.
1.3 "Return Procedure" means any administrative or judicial procedure leading to the return of a person to the Country of Origin.
Article 2: Scope
2.1 This Agreement shall apply to all persons who are residing in Germany and are subject to return procedures to Country of Origin.
2.2 This Agreement shall not apply to persons who are recognized as refugees under the 1951 Convention relating to the Status of Refugees or its 1967 Protocol.
Article 3: Cooperation
3.1 Each Party shall cooperate with the other Party in the implementation of this Agreement.
3.2 Germany shall provide Country of Origin with all necessary information to facilitate the identification and return of persons to be deported.
3.3 Country of Origin shall provide Germany with all necessary information to facilitate the return procedures.
Article 4: Return Process
4.1 Germany shall notify Country of Origin of the intention to deport a person and provide all relevant information.
4.2 Country of Origin shall confirm the identity of the person and provide the necessary travel documents within a reasonable time.
4.3 The Parties shall agree on the date and place of return.
4.4 Germany shall ensure that the person to be deported is treated with dignity and respect throughout the return process.
Article 5: Voluntary Return
5.1 The Parties shall encourage voluntary return and provide information on the benefits of voluntary return.
5.2 Germany shall provide Country of Origin with all
necessary information to facilitate voluntary return.
5.3 Country of Origin shall provide support to persons who choose voluntary return.
Article 6: Forced Return
6.1 In cases where voluntary return is not possible, forced return shall be carried out in accordance with the applicable laws and regulations of both Parties.
6.2 Germany shall ensure that the forced return is carried out in a manner that respects the rights and dignity of the person to be deported.
6.3 Country of Origin shall ensure that the person to be deported is received and treated in accordance with its laws and international obligations.
Article 7: Data Protection
7.1 The Parties shall ensure that personal data is processed in accordance with their respective data protection laws and regulations.
7.2 The Parties shall ensure that personal data is used
solely for the purposes of this Agreement.
Article 8: Confidentiality
8.1 The Parties shall treat all information exchanged under
this Agreement as confidential.
8.2 The Parties shall not disclose any information without
the prior written consent of the other Party.
Article 9: Amendments
9.1 Any amendment to this Agreement shall be made in writing and shall become effective upon mutual consent of the Parties.
Article 10: Dispute Resolution
10.1 Any dispute arising out of or in connection with this Agreement shall be resolved through consultation and negotiation.
10.2 If the dispute cannot be resolved through consultation and negotiation, it may be submitted to arbitration in accordance with the rules of the United Nations Commission on International Trade Law (UNCITRAL).
Article 11: Termination
11.1 This Agreement may be terminated by either Party with
six months' written notice to the other Party.
11.2 Upon termination, the Parties shall cooperate to ensure the orderly return of persons to be deported.
Article 12: Entry into Force
12.1 This Agreement shall enter into force on the date of the later of the notifications by each Party that the necessary internal procedures have been completed.
Article 13: Language
13.1 This Agreement is drawn up in the English language.
IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective Governments, have signed this。
