法律史学研究需要运用法学分析方法，坚持论从史出、思古悟今，以史料中揭示出中华民族历史上关于法的制度选择与价值思考，揭示出中国传统法律的特有品质、思维方式、逻辑体系、行为模式及价值内涵，力求从法律演变的历史中寻找文明秩序的一般原则和规律，为回答当前法治建设中的现实问题提供有益借鉴，同时推动中华优秀传统法律文化创造性转化、创新性发展。
这是中国法律史学的当代价值和时代使命。
近年来，一些法律史学者采用新史料、新方法进行研究，为学科发展注入了新活力。
例如，利用契约、方志、司法档案等进行研究，综合运用社会学、人类学等其他学科研究方法。
这些新材料和新方法，使得法律史学研究内容从国家、中央扩展至地方和基层，从律例典章扩展至民间法律实践，拓宽了研究视野。

在儒家关于国家的制度文明设计中，由《诗经》而衍生出的风雅精神是奠基性的，它构成了中国美学乃至中华民族精神中最受推崇的侧面。
按照现代学科分类，诗被纳入文学，其价值仅被定性为审美愉悦；与此密切相关的风雅，则仅指文人士大夫所追慕的生活格调和情趣，这种定位，不仅使“文学”“诗学”之于传统中国的意义被狭隘化，而且使风雅之于中国传统制度文明建构的意义也变得逼仄了。
那么。
关于风雅，我们如何理解它的价值，并认识它的现代意义呢?首先，奠基于诗教的风雅之教是一切人文教化的始基。
孔子之所以将诗教排在“三教”首位，原因无非在于诗总是传达关于自然和人生的美好情愫，能够使人在受教育之初，就因感悟世界美好而兴发良善心志，进而使人性变得积极、健康、乐观。
这种心志，是风雅赖以形成的心理基础，否则就极可能成为缺乏内在根据的假风雅或附庸风雅。
其次，孔子以“温柔敦厚”为风雅定调，并不意味着为人处世柔顺软弱，而恰恰是要由此彰显超越世俗价值的雄强和果敢。
在儒家看来，以泰然心态面对方为真勇者和大丈夫。
如公元前202年，刘邦率大军围困鲁国曲阜，面对行将降临的屠城灾难，“鲁中诸儒尚讲诵习礼，弦歌之音不绝”，这种对文明价值的无畏坚守，显然是一种大风雅和大勇敢。
同时，儒家的温柔敦厚，也不是不讲原则，而是外圆内方，怨刺而不失善意，坚持原则而不伤大雅。
第三，在中华文明史上，风雅不仅关乎士人个体的精神养成，更关乎家国天下的风尚再造。
在个体层面，风雅表现为士人文质一体、彬彬有礼的君子之风，即孔子所讲的“质胜文则野，文胜质则史；文质彬彬，然后君子”。
在家族层面，它表现为对人文教养和知识文化学习的重视，古人所谓诗礼传家、耕读传家、“忠厚传家远，诗书继世长”，无一不是将良好家风的养成作为家族延续的最重要的支撑力量。
在国家层面，周公制礼作乐是中国数千年风雅传统的开端，此后的中国史就是对这一传统的不断追忆、回溯、复归和发扬。
需要指出的是，风雅在传统中国，虽然具有多元价值取向，但它归根结底奠基于中国人对美和艺术的崇尚。
在一个以礼乐风雅为标识的国度，美和艺术因为对中国文明乃至国家建构的深度参与而显现出崇高性和神圣性。
我们今天提倡的“美丽中国”建设，不仅应指自然界山川秀美，同时也应将人文礼乐风雅纳入其中。
这种具有鲜明审美特质的立人、立国之道，在世界文明史中，成为中华民族独特而不可替代的优良传统。
