Foreign Teacher Employment ContractAgreement dated__________________, by and betweenThe TEFL AcademyAnd Mr./MS .____________________________.,In order to perfect teaching and improve educational quality, to ensure The TEFL Academy for international standard, and in consideration of the mutual promises and obligations hereinafter set forth, both parties agree to sign the contract on the principle of willingness, equality and mutual benefit.Under this contract, both parties have the following obligations and rights:1. Employment & Termination1).The TEFL Academy hereby employs Employee for a definite period commencing from _________________ and expiring on ______________________. The working hours may be scheduled between 9:00 to 21:00 from Monday to Sunday.3)Employee may work overtime outside of normal working hours whenever appropriate performance of his/her duties approved by his/her manager. EvaluationAccording to the evaluation of the school and students, the director will fix upon the amount of bonus the employee will get. The bonus = RMB600×evaluation score%. For example, if the employee gets an evaluation score of 80 for this month( students’ feedback will be carried out at the end of each month.), the bonus he/she will get is 600×80%. So the final bonus for this month is 480. However, if the one who has got the evaluation score below 60, he/ she will get no bonus. The evaluation details include school evaluation and students evaluation two parts.6. EMPLOYMENT CONTRACTEmployer School:Official Represe ntative:Koreig n Teacher:I.Employee* duties and Responsibilities1.The foreign teacher willingly comes to the Employer School to be a part-time English teacher. The foreign teacher should be a native speaker of English, have higher education, have certain language teaching experience, and be in good health (he/she must pass the physical exam in ati on at an assig ned Chin ese hospital after he/shc enters China) and possess required documents, such as TEFL certificate, foreig n expert certificate, reside nee permit, etc.. Materials submitted to the Employer School in support of the employee's application for this part-time position must be true and not mislead ing in any sen se.2.The foreig n teacher will complete teach ing tasks duri ng the con tract period, in clud ing prepari ng less ons and teach ing materials well prior to teachi ng, con duct ing less ons and access ing studentwork. Besides, the foreig n teacher will give less ons on time in accordance with the class time required by the school.3.The foreig n teacher will use strictly the teach ing materials and the tcachi ng pla n provided by the Employer School, con scie ntiously accomplish ing the teachi ng pla n, to assure high quality teach ing. The foreig n teacher must keep all in formatio n regard ing to the Employer School's teach ing methods and admi nistratio n con fide ntial and not use the teach ing methods and materials for any other purpose.4.During the required lecture time, if the foreign teacher leaves Shenzhen hc/she should inform the Coord in ator. When traveli ng outside of Guan gdo ng provin co, Hong Kong, or Macao, the foreign teacher is further responsible for announcing his/her travel pla ns to the Employer School through his/her con tact teacher and the Coord in ator, a week in adva nee in writ ing or via e-mail.5.I n the eve nt of ill ness that preve nts the foreig n teacher from teachi ng, hc/she is resp on sible to no tify both his/her con tact teacher and the Coord in ator in adva nee, and further is required to provide the Employer School with written documentation. If this notification is not done, there will be a reduction of pay by RMB 100 per time of abse nee; this pen alty also applies to any un approved tard in ess from class. (For instance, if the foreign teacher is late for over one hour, he or she will lose RMB300: wage RMB 200 added a fine of RMB 100). After receiving the written warning letter from the employer, a total of three such occurre nces arc grounds for dismissal.6.During the lessons, the foreign teacher will make his or her own meal and tran sportati on arran gome nts.7.The foreig n teacher is to respect the moral sta ndards and customs of the Chin ese people. This specifically in eludes mai nta ining an appropriate professi onal appeara nee and standard of behavior. The foreign teacher must not harm the image of the Employer School or other staff with the Employer School.8.The foreign teacher will follow the Employer School * s working regulations andthe releva nt Foreig n Expert rcgulati ons of the Chin ese gover nment.9.The foreign teacher is to follow Chinese law and regulations, and not interfere in Chi nese internal affairs.II.Employer School Responsibilities1.The foreign teacher * mployment period is from signing date to .Teach ing duties start from and end by . The Employer School will provide a wage of RMB200/hour to the foreig n teacher duri ng the employme nt period. The wage should be paid by month and the foreign teachers remuneration will be calculated according to his/her actual t. caching hours. If there is any fine, the teacher will be in formed in adva nee. The 12 of each mon th is pay day and the foreig n teacher will receive last month's wage in cash.2.The Employer School will provide in troductory in structio n on releva nt worki ng regulations of the Employer School * side and Chinese government regulations on foreig n experts.3.The Employer School will guide, check, and evaluate the foreign teacher * s work.4.The Employer School will note the foreign teacher one week ahead if there is any cha nge upon the agreed teach ing schedule or class time.5.The Employer School will arrange a bi-lingual co-worker or assistant, referred to as the“ contact teacher ”, to assist the foreign teachch oo Ithespecially for infants' or junior primary school foreign teachers.III.Modificati on, Dissoluti on an d/or Terrain ati on of the Con tract1.Both sides must abide by the con tract. Neither side can modify, dissolve, or termi nate the con tract, except as specified below.2.With the agrecme nt of the Employer School, the foreig n teacher, the con tract can be modified, dissolved, or term in ated. Un til reach ing such an agrecme nt, all sides should strictly carry out the con tract.3.The Employer School has the right, with written notification to the foreign teacher, to termi nate the employme nt con tract and stop all bon efits and payme nts to a foreig n teacher un der the follow ing con diti ons:(a.) If the foreign teacher receives fifteen (15) days written notice from the Employer School or the Coord in at or specify ing his/her failure to comply with the terms of the con tract, and fails to correct the non complia nee; or(b.) When, in the judgment of a qualified medical doctor, the foreign teacher is unable to resume his/her duties and responsibilities after the expiration of thirty (30) con ti nu ous days of sick leave.(c.) During the con tract period, the foreig n teacher shall be careful not to make improper stateme nts that violate the political safety of the country and Chin ese laws and result in adverse effects. Otherwise the employer school has the right to terminate the employ me nt con tract and releva nt resp on sibilities shall be inv estigated accordi ng to laws.4.The foreign teacher has the right, with written notification to the Employer School to termi nate the con tract without further obligatio n to the Employer School un der the follow ing con diti ons:(a.) If, after thirty (30) days written notice from the foreign teacher to the Employer School and the Coordinator, the Employer School fails to provide the work ingand liv ing con diti ons promised in the con tract; or(b.) If t he Employer School does not pay in a timely manner the foreign teacher salary, and fails to correct the problem after ten (10) days written notification from the foreig n teacher to the School and the Coord in ator : or(c.) If the foreig n teacher seeks to termi nate the employme nt con tract due to a serious health an d/or medical con diti on, and the foreig n teacher provides appropriate documentation from a qualified medical doctor, and the Employer School agreesto such term in atio n for medical rcas on s. If the Employer School does not agree to the terrain atio n for medical reas ons, the pen alty provisi on of Secti on IV of the con tract will apply.III. Disagreement and AttributionThis con tract is based on Chin ese law, and if there is disagreeme nt, arbitrati on will be held at the Employer Scho ol's local court.V. Con tract Copies, Arbitrati on Locati on, and Effective PeriodThis con tract has two copies; each copy will be in both Chin ese and En glish. Copies in both Ian guages have the same effect, but becausethe En glish versi on is based on the Chin ese versi on, if the two versi ons (En glish and Chin ese) do not match, the Chin ese versi on will be the one to be followed. This con tract will be effective upon sig ning by both sides of both its En glish and Chin ese vers ions.
