论依法治税法治是人类文明发展的必然产物,是社会健康发展的根本保障,建设法治社会已经成为我国政治、经济和社会发展的必然趋势。
在税收领域坚持法治原则即坚持依法治税不仅是当前治税的内在需要,也是适应外部挑战,顺应时代潮流,与时俱进的一项战略举措。
依法治税是一项系统工程。
当前,依法治税作为依法治国的重要组成部分,已经成为全社会的共识。
依法治税体现在依法纳税与依法征税两个方面,前者是就纳税人而言,后者是就税务机关而言。
目前我国依法纳税的情况并不乐观,原因是多方面的。
一是历史原因。
“税收是国家履行公共职能的需要”这种现代观念始终没有树立起来,更说不上深入人心,在税收实践中表现为不少社会公众对税收潜意识的反感与抵触。
二是体制转轨原因。
三是社会环境原因。
因此,随着经济意识的觉醒,纳税人在“经济人”思想的支配下,在国家监管即外在约束又相对不完善的情况下容易滋长违法心理,表现为税收违法犯罪活动还比较猖獗。
依法征税的情况也不是很乐观,特别是权力的运用还不够规范。
只有充分尊重、明确纳税人的权利并明确权利保障的途径,采取各种措施鼓励纳税人去争取权利,才可以有效制约税务机关的执法权力。
由于以上种种原因,我国税收法治的现状并不乐观,一是在税收立法方面,既存在着税收规范性文件与税收法律、法规和规章相抵触,或者同级税收规范性文件之间相互矛盾的现象,同时又存在着不少漏洞,有些方面尚无法可依,一些税种的立法进程滞后,税法级次较低,影响了税法的刚性等。
二是在税收执法方面,既有执法随意、执法监督不力的问题,又有执法难的问题。
协税护税网络和机制尚不健全,税收执法的外部环境仍然不容乐观,税收执法确实面临着不少困难。
三是在纳税人方面,对税收法律法规知之甚少,纳税意识淡薄。
笔者认为,要想真正做到依法治税,必须从以下几个方面着手。
一、进一步完善我国税收立法全面推进依法治税要求进一步完善税收立法,我国加入世界贸易组织也给税收立法提出了新的要求。
完善我国税收立法,应与我国的国体、政体、国情、经济体制和分税制财政体制相适应,与改革开放的形势相吻合。
