2006年成人高考英语试题及答案上(高起点)代理词审判长、审判员:河北决策律师事务所接受原告高伟国委托,指派我担任其诉讼代理人。

庭审前我查阅了本案的有关证据材料,现提出代理意见如下:一、原告高伟国同二被告之间系雇佣关系被告赵永杰向一审法院提交的证据--《合同书》显示,被告赵永杰承包大同煤矿集团有限责任公司煤气厂(该厂为本案另一被告)粉煤、焦煤的装卸工作,赵永杰作为负责人在该合同书中盖了章。

此后,赵永杰便开始雇佣、组织员工进厂工作。

高伟国于2009年6月19日来到煤气厂为赵永杰打工。

从事火车外运、平煤装焦工作,高伟国根据赵永杰的指示提供劳务,赵永杰接受劳务向高伟国支付报酬,显然是一种雇佣关系。

二、原告高伟国在从事雇佣活动中,身体遭受侵害,被告赵永杰作为雇主和管理者,应当承担赔偿责任,被告大同市同煤集团煤气公司煤气厂疏于防范,也应当承担相应的赔偿责任。

现实生活中,雇佣活动的界定非常复杂,应该结合案件的具体情况进行综合判断。

具体到本案来说,原告高伟国所提供的劳务是火车外运装煤工作,无固定具体的工作时间,有其特殊性,被告赵永杰规定上诉人须在二十四小时在工作地点待命,火车何时到,就何时装车。

大同市公安局云泉分局刑侦大队出具的《证明》可证实原告高伟国遭受侵害的地点为:“同煤集团煤气厂工棚内。

”曾经同原告一同打工的吴军喜等三个的证明也可以证实这一事实。

高伟国在工棚内待命,是依照雇主即被告赵永杰指定的地点等候装车。

高伟国的行为完全是为了服务于赵永杰的目的,促进雇主的利益。

所以理应界定高伟国是在从事雇佣活动中遭受的人身损害。

依据最高人民法院《关于审理人身损害赔偿案板适用法律若干问题的解释》第十一条之规定:“雇员在从事雇佣活动中遭受人身损害,雇主应当承担赔偿责任。

雇佣关系以外的第三人造成雇员人身损害的,赔偿权利人可以请求第三人承担赔偿责任,也可以请求雇主承担赔偿责任。

雇主承担赔偿责任后,可以向第三人追偿。

”被告赵永杰应当承担赔偿责任。
